Dear Mr. Todd,
I am writing to explain my concern with your recent construction activity for the wastewater
system at 345 Boston Street. Our inspector reported a number of simple construction problems
that you should have never allowed to occur nor even called for an inspection until they had been
resolved. They also reported that there were also a series of misleading statements, which you
issued that were inappropriate.
Examples include:
➢ A design plan for a different property was provided to our inspector for use. When he
questioned that the leach laterals in the ground were at right angles to what was specified
in the design plan, you indicated that the designer had a meeting with our office and this
change was permitted. Although we have had many meetings and changes, I cannot recall
attending or hearing of such meeting or discussion ever occurred. Once you realized you
had provided our inspector the plan for a different property, it became apparent that the
leach lines were in fact in the correct orientation.
➢ The approved design plan was not on the site at the time of construction inspection, nor
was it in your possession; rather you had to come to our office to obtain a copy
➢ The design plan specified a particular effluent filter be installed in the primary(septic)
tank, yet none was provided. You informed our inspector that I or others from the Health
Department had asked that they be removed from previous wastewater installations you
performed in North Andover. I spoke with Michele Grant who recalled an issue about a

filter, but it was about conformance to the plan as I understand it. If you ever have
questions please don't hesitate to ask.
➢ Our inspector asked about the water line location and you indicated it was placed in the
driveway then into the garage of the house. When our inspector asked about the water
line that was found to be coming into the basement on the opposite end of the house, it
became apparent that the water line was in fact laid in a different, and non-complying,
location from where you indicated.
➢ The distribution box was found to be poorly constructed and leaking water in at least three
locations. It appeared that you had clearly attempted to cover up some of the leaks by
placing rocks over those locations. When exposed and the leaks shown to you by our
inspector, you acknowledged that the component was deficient and needed to be replaced.
Pleases be advised that this type of poor craftsmanship and misleading of our inspectors is not
tolerated by this office. I was personally disappointed to hear of these problems. As you may
recall, I had just mentioned to you on site that our office was pleased that there was a competent
installer on the Boston and Gray Street projects. Please let this letter serve as a formal warning to
you that continued poor workmanship and deliberate misstatements will serve as cause for
suspension and/or revocation of your license to perform work as a Disposal Systems Installer in
the Town of North Andover.

Charlie Todd has advised me that the "standard" (6' long) infiltrator unit has been
discontinued and that a 4 foot long unit has replaced it. I authorized the change, provided
that the total length of each chamber run was at least that which was shown on the
approved plan.

This final made me think about this time of year and COC sign offs. If anyone calls for a final grade (as long as
there is not snow on the ground)we can check the loam and grade, but it is way too late for seeding. If the owner,
or new homeowner to be, will write a letter to the effect that they understand that we usually require seeding prior
to sign off for their protection, (this is not a title v requirement) however they are requesting a sign off with the
understanding that they are taking full responsibility for the final seeding. Then we can give them the COC if all
else is ok.

It is getting cold. Please do not give anymore DWC's for full installations, but of course there are a couple of
failures that I will let in.l I do hope they come soon. I am mostly thinking of the Credit Union. (waiting for a DEP
approval)
FYI I called Mike about 44 Cricket. Riley is holding off picking his up until he finishes the one he is working on.

Dear Property Owner,
The North Andover Board of Health has completed the review of the septic system.design plans,for the above
referenced property.These plans dated September 28,2004,final revision date of March 20,2005,have been
approved for a five(5)bedroom,maximum 11-room home.
As stated in the previous approval,the design has been approved for use in the construction of a new onsite septic
system.This approval is valid for three years from the date of this letter and during this time a licensed septic system
installer must obtain a permit and complete this work,and a Certificate of Compliance must be endorsed by the
installer,designer and the Town of North Andover.
This approval is subject to the following conditions:
1. If site conditions are found in the field to be different from those indicated on the design plan and/or
soil evaluation,the originally issued Disposal System Construction Permit is void,installation shall
stop,and the applicant shall reapply for a new Disposal Systems Construction Permit(310 CMR
15.020(1)).
2. The issuance of the disposal works construction permit is contingent upon the receipt of a foundation
as-built of the dwelling.The as-built must be in a scale of 1"=20`.Also,please submit a floor plan of
the proposed home.
3. It is the responsibility of the applicant and/or the applicant's septic system designer,septic system
installer or other representative to ensure that all other state and municipal requirements are met. These
may include review by the Conservation Commission,Zoning Board,Planning Board,Building
Inspector,Plumbing Inspector and/or Electrical Inspector. The issuance of a Disposal System
Construction Permit shall not construe and/or imply compliance with any of the aforementioned
requirements.
Your effort to provide a properly functioning septic system for your dwelling is greatly appreciated. The Health

response, I offer the following:
1. The lot number has been added to sheet 2 of 2. As stated in previous letters,
lot addresses will not be issued until the assessor has received a copy of the
subdivision plan and revised his maps.
2. The name of the witness has been revised per your comment.
3. The plan revision date has been added to both sheets.
4. The names of abutters, based on assessor's records, have been completed. Any
lots that are part of the subdivision are simply listed by lot numbers.
5. Elevations have been added to the proposed driveway.
6. A stockpile area has been noted away from the leaching area.
7. Distances have been added to the plan per your comment.
8. The distance to the water service has been added.
9. An additional conventional layout plan has been provided.
10. The height of the spike has been added to the plan.
11. Existing contours have been more fully labeled.
12. Additional grades have been shown at the soil absorption area.
13. The access manhole has been shown over the pump location.
14. A pump curve has been added to the plans.
15. The plan now demonstrates that the pump chamber has 24 hour emergency
storage.
16. Minimum and maximum cover dimensions have been added to the profile.
17. Additional spot grades have been shown to shed water away from the
dwelling.

22. The number of Infiltrators in each trench has been specified.
23. A vent and vent detail have been provided for the trenches. The vent pipe is
attached to the chamber in the same way that the inlet pipe is attached.
24. The ESHGW for trench 1 was taken from test pit 11-2, which is closer than
test pit 11-05-03.1 have,however, revised the}Mans to comply with your
reasoning.

including construction details necessary for attaching a vent to Infiltrator-brand

soil test data. By interpolation, Trench 2 should have an Estimated High
Groundwater which is 34"below grade.
