BOARD OF SELECTMEN MINUTES August 12, 2019
CALL TO ORDER: Chairman Richard Vaillancourt called the meeting to order at 6:30PM in Meeting
Room at Town Hall.
ATTENDANCE: The following were present: Chairman Richard Vaillancourt, Clerk Rosemary Smedile,
Licensing Chairman, Regina Kean, Chris Nobile (remotely), Phil DeCologero and Acting Town Manager
Lyne Savage.
EXECUTIVE SESSION
Regina Kean made a MOTION, seconded by Rosemary Smedile that the Board of Selectmen enter
into Executive Session pursuant to Massachusetts General Laws, Chapter 30A, Section 21(a)(2) to
discuss strategy with respect to litigation (Recreation Complex) and to return to Open Session at
the conclusion of Executive Session.
Chairman Vaillancourt declared an open meeting may have a detrimental effect on the Board’s litigating
position.
Roll call vote: Smedile: Yes, Nobile: Yes, Vaillancourt: Yes, Kean: Yes, DeCologero: Yes. Motion
approved 5-0.
The Board returned to open session at 7:00PM.
PLEDGE OF ALLEGIANCE
PUBLIC COMMENT
Dave Rand of 280 Dale Street proposed that the Board set up a committee of volunteers to help find a
solution for the Stevens Estate.
Ellen Mosier of 135 Kara Drive and member of Stevens Estate Advisory Committee disclosed that she
owns an event planning business who refers clients to the Stevens Estate. Ms. Mosier read a statement
regarding the Stevens Estate.
APPROVAL OF MINUTES
Rosemary Smedile made a MOTION, seconded by Phil DeCologero to approve the Open Session
Minutes of July 15, 2019 as presented. Motion approved 5-0.
CONSENT ITEMS (taken out of order)
Request of Police Chief, Charles Gray, to close Main Street from Waverly Road to Second Street, First
Street at the entrance to the First and Main Parking Lot and Cleveland Street at Main Street on
September 13, 2019 from 6:00PM-9:00PM for a community event
Police Chief, Charles Gray, presented the proposal for a block party on September 13, 2019.
Regina Kean made a MOTION seconded by Rosemary Smedile that the Board of Selectmen
approve the request of Chief Charles Gray to close Main Street from Waverly Road to Second
Street, First Street at the entrance to First and Main parking lot and Cleveland Street at Main Street
from 6:00PM-9:00PM on September 13, 2019. Motion approved 5-0.
NEW BUSINESS
Stevens Coolidge Place presentation
Katherine MacDonald of the Trustees explained the plans for revitalization of the gardens at Stevens
Coolidge Place. There are three phases which will add a visitor center and new entry from Chickering
Road, additional gardens and open space and trails. The Trustees will be going before the Planning
Board and Conservation Commission. The Board raised some concerns about traffic.
GOVERNMENTAL REPORTS
Update from Cultural Council
Anna Choi, Chair of the Cultural Council, provided an update on grants for the current year. For the past 2
years they have been part of a pilot program where they accept applications and fund projects
immediately instead of grantees being reimbursed which seems to be working well.

Update on Senior Center
Acting Community and Economic Development Director, Jean Enright, updated the Board regarding the
construction of the new Senior Center which is currently going through the Planning Board process. Ms.
Enright stated they hope to have construction begin in the spring and should take 12-14 months to
complete.
Update from DPW Director, Jim Stanford
Jim Stanford, Director of Public Works, updated the Board on various DPW projects in Town. The road
reconstruction (sidewalks and roads) project and Grogan’s Field repairs that are being funded by the
st
Columbia Gas settlement will begin in the fall. There will be a meeting with residents on August 21 at
Grogan’s. The other major project is the road paving program throughout town. Ms. Smedile was
concerned about making sidewalks at the expense of losing trees. The Route 125 Massworks grant
sidewalk project is almost complete. The traffic signal is waiting for utilities to relocate the poles. The
Mass Avenue project will begin in the fall.
CONSENT ITEMS (continued)
Request of Columbia Gas to excavate Rea Street Extension for the purpose of installing a new gas line
Ken Wells from Columbia Gas presented the proposal for a new main extension on Rea Street. All
relevant departments have reviewed the request and have no issues. In response to a question from the
Board, Mr. Wells indicated there will be a high pressure regulator on the line.
Rosemary Smedile made a MOTION, seconded by Phil DeCologero that the Board of Selectmen
approve the request of Columbia Gas to excavate on Rea Street Extension for the purpose of
installing a new gas line. Motion approved 5-0.
Accept donation in the amount of $230 from Samuel and Sally Brooks to the Fire Department
Rosemary Smedile made a MOTION, seconded by Phil DeCologero that the Board of Selectmen
accept the donation from Samuel and Sally Brooks in the amount of $230 to be used for fire
department equipment. Motion approved 5-0.
Accept bequest of books to the Library from Mildred Matasso
Rosemary Smedile made a MOTION, seconded by Phil DeCologero that the Board of Selectmen
accept the bequest of books to the Library from Mildred Matasso. Motion approved 5-0.
Accept donations to the Youth Center for the summer shows
Phil DeCologero made a motion, seconded by Regina Kean that the Board of Selectmen accept
the donation from MP Roberts Insurance Agency in the amount of $200, Trombly Brothers, Inc. in
the amount of $50, NAHS Class of 1959 in the amount of $300, St. Michael’s Church in the amount
of $500 and Licciardello Financial Services in the amount of $50 to be used toward the cost of the
summer shows at the common. Motion approved 5-0.
Appointment of Denise Casey as Acting Town Manager
Per Town Charter, Lyne Savage may only serve as Acting Town Manager until August 16, 2019;
therefore the Board needed to appoint a new Acting Town Manager.
Phil DeCologero made a MOTION, seconded by Rosemary Smedile that the Board of Selectmen
appoint Denise Casey as Acting Town Manager effective August 16, 2019 through September 15,
2019. Motion approved 5-0.
Board and Committee Appointments:
Sustainability Committee- Elizabeth Guilbeault, Pranali Ashara, Kristi Cunningham and Fawad Khan
Phil DeCologero made a MOTION, seconded by Rosemary Smedile that the Board of Selectmen
appoint Elizabeth Guilbeault, Pranali Ashara, Kristi Cunningham and Fawad Khan to the
Sustainability Committee for a term ending June 30, 2022. Motion approved 5-0.
Jessica Furtado- Poet Laureate Committee
Regina Kean made a MOTION, seconded by Rosemary Smedile that the Board of Selectmen
appoint Jessica Furtado to the Poet Laureate Committee for a term ending June 30, 2022. Motion
approved 5-0.

Linda Byers- Disability Commission
Phil DeCologero made a MOTION, seconded by Rosemary Smedile that the Board of Selectmen
appoint Linda Byers to the Commission on Disabilities for a term ending June 30, 2020. Motion
approved 5-0.
Reappointment of John Savastano to Board of Registrars
This reappointment was inadvertently left off of the list of reappointments submitted at the last meeting.
Rosemary Smedile made a MOTION, seconded by Phil DeCologero that the Board of Selectmen
reappoint John Savastano to the Board of Registrars for a term ending June 30, 2022. Motion
approved 5-0.
LICENSING COMMISSIONERS
Rosemary Smedile made a MOTION, seconded by Regina Kean to open a meeting of the North
Andover Licensing Commission. Motion approved 5-0.
Request from Burton’s Grill of North Andover, LLC d/b/a Burtons Grill, 145 Turnpike Street for change of
manager
The current manager of Burton’s Grill was present to answer any questions.
Rosemary Smedile made a MOTION, seconded by Phil DeCologero that the Board of Selectmen,
acting as Licensing Commissioners, approve the request of Burton’s Grill of North Andover, LLC
d/b/a Burton’s Grill for a change of manager. Motion approved 5-0.
Request of Butlers and Bars for the following one day licenses in the tent at Smolak Farms:
1. Wine and malt license for wedding on August 23, 2019 from 4:00PM-10:00PM
2. All alcohol license for a wedding on August 24, 2019 from 4;00PM-10:00PM
3. All alcohol license for a wedding on August 31, 2019 from 4:00PM-10:00PM
Richard Vaillancourt made a MOTION, seconded by Rosemary Smedile that the Board of
Selectmen, acting as Licensing Commissioners, approve the request of Butlers and Bars for a one
day wine and malt license for a wedding on August 23, 2019 and two one day all alcohol licenses
for weddings on August 24, 2019 and August 31, 2019, from 4:00PM-10:00 PM in the tent at
Smolak Farms and waive the police detail for the three events. Motion approved 5-0.
Request of Smolak Farms for five one day wine and malt licenses for festivals on the following dates:
August 17, 2019 from 12;00PM-5:00PM
August 18, 2019 from 12:00PM-5:00PM
August 31, 2019 from 10:00AM-5:00PM
September 1, 2019 from 10:00AM-5:00PM
September 2, 2019 from 10:00AM-5:00PM
Rosemary Smedile made a MOTION, seconded by Phil DeCologero that the Board of Selectmen,
acting as Licensing Commissioners, approve the request of Smolak Farms for five one day wine
and malt licenses for festivals on August 17, 18, 31, September 1 and 2, 2019, as presented.
Motion approved 5-0.
Phil DeCologero made a MOTION, seconded by Phil DeCologero to close the meeting of the North
Andover Licensing Commission. Motion approved 5-0.
OLD BUSINESS
Discussion regarding rental fees for The Stevens Estate
Acting Town Manager, Lyne Savage, explained that there is more research to be done regarding the
fees. Mr. DeCologero suggested an advisory board be formed. Chairman Vaillancourt suggested there be
a Board of Selectmen subcommittee to come up with a proposal for an advisory board, membership and
charge.
Phil DeCologero made a MOTION, seconded by Chris Nobile that Rosemary Smedile and Regina
Kean be appointed to a subcommittee to develop a proposal for an advisory board. Motion
approved 5-0.
TOWN MANAGERS REPORT
The Board was provided with the job posting/vacancy log.

SELECTMENS REPORT
The Board thanked Lyne Savage for her work as Acting Town Manager. The Board also thanked Rick
Gorman and the Youth Center staff for the wonderful summer programs.
ADJOURNMENT
Chris Nobile made a MOTION, seconded by Phil DeCologero to adjourn the meeting at 9:00 p.m.
Motion approved 5-0.
