BOARD OF SELECTMEN MINUTES July 15, 2019
CALL TO ORDER: Chairman Richard Vaillancourt called the meeting to order at 7:03PM in Meeting
Room at Town Hall.
ATTENDANCE: The following were present: Chairman Richard Vaillancourt, Clerk Rosemary Smedile,
Licensing Chairman, Regina Kean, Chris Nobile, Phil DeCologero, Acting Town Manager Lyne Savage,
Deputy Town Manager, Denise Casey and Executive Assistant, Laurie Burzlaff.

None
APPROVAL OF MINUTES
Rosemary Smedile made a MOTION, seconded by Chris Nobile to approve the Open Session and
Executive Session Minutes of July 8, 2019 as presented. Motion approved 5-0.
GOVERNMENTAL REPORTS
Update from Commission on Ability Assistance
Phyllis Jones, Chair of the Commission on Ability Assistance updated the Board about what they have
accomplished this year, including having a series of television shows on NACAM and updating their logo.
They asked the Board to appoint additional members as a quorum is hard to achieve with their current
membership. They also asked for buildings to be more ADA compliant.
Update from Cultural Council
This matter was moved to the next meeting.
Update from NACAM regarding legislative changes
Brian Fraser gave an update on the legislative changes to the funding for public cable television and
asked the Board to send a letter of support to stop the fee changes.
Rosemary Smedile made a MOTION, seconded by Regina Kean to send a letter of support to the
Town’s legislative delegation. Motion approved 5-0.
Report from OPEB committee
Brian Perry and Denise Casey presented the report of the OPEB committee.
CONSENT ITEMS (taken out of order)
Accept donation in the amount of $2,500 from Lowell Five Bank for the 4th of July fireworks

Lowell Five Bank once again generously donated funds for the 4 of July fireworks.
Rosemary Smedile made a MOTION, seconded by Chris Nobile that the Board of Selectmen accept

the donation from Lowell Five Bank in the amount of $2,500 to be used toward the cost of the 4
of July fireworks. Motion approved 5-0.
Request of St. Michael Parish to use the Town Common on September 29, 2019 from 9:00AM to 7:00PM
and close Mass Ave from Osgood Street to Andover Street for the 150th Anniversary Picnic Celebration
St. Michael Parish requested permission to use the Common and close Mass Ave for their annual Mass
and picnic. All relevant departments have reviewed and have no issues. A certificate of insurance has
been provided.
Rosemary Smedile made a MOTION, seconded by Chris Nobile that the Board of Selectmen
approve the request of St. Michael Parish to use the Town Common on September 29, 2019 from
9:00AM-7:00PM and to close Mass Ave from Osgood Street to Andover Street. Motion approved 5-
0.
Request of the Exchange Club of Lawrence to use the Town Common from May 30, 2020 through June
13, 2020 for the Field of Honor flag display and ceremony on June 13, 2020
Rick Blain and Sean Devan of The Exchange Club of Lawrence requested permission to use the
Common for the Field of Honor flag display. They are expanding this year to start on Memorial Day and
end with a ceremony on June 13, 2020. All relevant departments reviewed and have no issues.

Rosemary Smedile made a MOTION, seconded by Phil DeCologero that the Board of Selectmen
approve the request of The Exchange Club of Lawrence to use the Town Common from May 30,
2020 to June 13, 2020 for the Field of Honor flag display. Motion approved 5-0.
Request of the North Andover Democratic Town Committee to use the Town Common for a picnic on July
27, 2019 from 12:00PM-2:00PM
The North Andover Democratic Town Committee requested permission to use the Common for a picnic.
All relevant departments have reviewed the request and have no issue.
Regina Kean made a MOTION, seconded by Phil DeCologero that the Board of Selectmen approve
the request of the North Andover Democratic Town Committee to use the Town Common on July
27, 2019 from 12:00PM -2:00PM for a potluck picnic. Motion approved 5-0.
Request of Pure Barre North Andover to use the Town Common on July 29, 2019, July 30, 2019 and July
31, 2019 from 9:00AM-11:30AM for a fitness class
Gabby Pacheco of Pure Barre was present to request permission to use the Common for three days for a
fitness class. All relevant departments have reviewed the request and have no issues. A certificate of

insurance has been provided. The children’s show is already booked for July 30 so the applicant will
have her class later in the day.
Rosemary Smedile made a MOTION, seconded by Phil DeCologero that the Board of Selectmen
approve the request of Pure Barre North Andover to use the Town Common on July 29, 2019, July

30, 2019 and July 31, 2019 for fitness classes, with the understanding that July 30’s class will be
scheduled between 12:00PM and 5:00PM. Motion approved 5-0.
FY19 year-end budget reallocation
Included in the packet was documentation provided by Lyne Savage regarding the end-of-year FY19
budget reallocations.
Rosemary Smedile made a MOTION, seconded by Phil DeCologero that the Board of Selectmen
approve the FY19 budget reallocations, as presented. Motion approved 5-0.
Request of John Smolak on behalf of Hillwood Enterprises, LP to amend the Planning Board fee schedule
for Site Plan Review
This matter was withdrawn by Mr. Smolak prior to the meeting.
LICENSING COMMISSIONERS
Regina Kean made a MOTION, seconded by Rosemary Smedile to open a meeting of the North
Andover Licensing Commission. Motion approved 5-0.
Request of Smolak Farms for a one day wine and malt license for a Murder Mystery Dinner on July 20,
2019 from 7:00PM-9:30PM in the tent
Rosemary Smedile made a MOTION, seconded by Chris Nobile that the Board of Selectmen,
acting as Licensing Commissioners, approve the request of Smolak Farms for a one day wine and
malt license for a Murder Mystery Dinner on July 20, 2019 from 7:00PM-9:30PM. Motion approved
5-0.
Request of 1634 Meadery for a one day wine and malt license for the Thursday Picnic Series at the
Stevens-Coolidge Place on August 8, 2019 from 5:00PM-8:00PM
Richard Vaillancourt made a MOTION, seconded by Rosemary Smedile that the Board of
Selectmen, acting as Licensing Commissioners, approve the request of 1634 Meadery for a one
day wine and malt license for the Thursday Picnic Series at the Stevens Coolidge Place on August
8, 2019 from 5:00PM-8:00PM. Motion approved 5-0.
Request of Merrimack College for a one day wine and malt license for a Beer Garden in the Sakowich
Parking Lot on August 3, 2019 from 6:00PM-11:00PM (rain dated August 4, 2019)
Richard Vaillancourt made a MOTION, seconded by Chris Nobile that the Board of Selectmen,
acting as Licensing Commissioners, approve the request of Merrimack College for a one day wine
and malt license for a Beer Garden in the Sakowich Parking Lot on August 3, 2019 from 6:00PM-
11:00PM with a rain date of August 4, 2019 and waive the requirement for a police detail provided
Merrimack College police are present. Motion approved 5-0.

Request of Aaronap Cellars, LLC for a one day wine and malt license for a summer picnic series on
August 1, 2019 from 5:00PM to 8:00PM
Richard Vaillancourt made a MOTION, seconded by Rosemary Smedile that the Board of
Selectmen, acting as Licensing Commissioners, approve the request of Aaronap Cellars, LLC for
a one day wine and malt license for a summer picnic series at the Stevens Coolidge Place on
August 1, 2019 from 5:00PM-8:00PM. Motion approved 5-0.
Request for Change of Manager at The Stevens Estate at Osgood Hill d/b/a The Stevens Estate, 723
Osgood Street
Rosemary Smedile made a MOTION, seconded by Phil DeCologero that the Board of Selectmen,
acting as Licensing Commissioners, approve the request of The Stevens Estate at Osgood Hill
d/b/a The Stevens Estate for a change of manager. Motion approved 5-0.
Request for Change of Manager at Chipotle Mexican Grill of Colorado, LLC d/b/a Chipotle Mexican Grill,
93 Turnpike Street
Chris Nobile made a MOTION, seconded by Richard Vaillancourt that the Board of Selectmen,
acting as Licensing Commissioners, approve the request of Chipotle Mexican Grill of Colorado,
LLC d/b/a Chipotle Mexican Grill for a change of manager. Motion approved 5-0.
Richard Vaillancourt made a MOTION, seconded by Rosemary Smedile to close the meeting of the
North Andover Licensing Commission. Motion approved 5-0.
OLD BUSINESS
Discussion regarding Stevens Estate
Included in the packets was information regarding how the fees at Stevens Estate compare with other
municipally owned function facilities. The Board asked the Town Manager to have Joanna Ouellette,
Director of the Stevens Estate, provide a recommendation for fees at the next meeting. The Board
discussed appointing a new committee to provide recommendations on the future of the Stevens Estate.
Phil DeCologero made a MOTION, seconded by Rosemary Smedile, that the Board of Selectmen
lift the moratorium on bookings for the Stevens Estate. Motion approved 5-0.
NEW BUSINESS
Discussion regarding Senior Tax Work Off Program
The Senior Tax work off program had 70 applicants for 50 spots. The cost to the Town for each new hire
is $1100.00. A resident requested the Board consider hiring 10 more applicants. Acting Town Manager,
Lyne Savage, explained that the funds for the program are from the overlay and not the general budget.
Phil DeCologero made a MOTION, seconded by Rosemary Smedile, that the Board of Selectmen
increase the number of positions for the Senior Tax Work Off Program from 50 to 60. Motion
approved 5-0.
TOWN MANAGERS REPORT
Acting Town Manager, Lyne Savage, explained that an issue has arisen regarding a property the Town
foreclosed on. The owners want to pay the balance and redeem the title. The Board needs to vote on
whether they have any objection to the redemption.
Rosemary Smedile made a MOTION, seconded by Chris Nobile that the Board of Selectmen
support and have no objection to the property owner of 33 Martin Avenue's request to redeem the
tax title of the property located at 33 Martin Avenue, North Andover and authorize the Treasurer to
accept payment, issue a certificate of redemption and file the appropriate documents with the
Land Court. Motion approved 5-0.
