HISTORY AND BACKGROUND

On January 3, 2019 the applicant requested a waiver of a Watershed Protection District Special
Permit, in accordance with the North Andover Zoning Bylaw section 4.24, also known as section
195-4.24, as to allow for the excavation and filling in an in-ground swimming pool within the
within the 100-foot Non-Disturbance buffer zone of the Watershed Protection District.
FINDINGS OF FACT
The Planning Board has made its decision based on the following findings:

• A plan was submitted entitled, "As-Built Plan of Land"in North Andover,MA, dated
December 2, 1999 which details the structure's location, the distances from the wetland 3
resource areas, and erosion control.
• The project includes removal of the liner and walls of the pool, hauling of materials to an '
off-site location, filling the hole with new soil,re-establishment of the existing grade and
loaming and seeding of the area. I
• The structure will not disturb existing topography.
• The proposed changes will not create a more detrimental impact on the wetlands than
exist on the property and there will not be any significant degradation of the quality or
quantity of water in or entering Lake Coehichewick.
DECISION
After discussion at the January 22,2018 Planning Board meeting,and upon a motion by J. Simons
and seconded by A.Preston,the Planning Board Approves the Watershed Special Permit—Waiver
with conditions. A vote of 4-0 was made in Favor of the waiver request.

CONDITIONS
1. Proper erosion control will be constructed and will remain throughout the project,
according to the conditions approved by the Planning Department staff.
2. The Planning Office will perform a minimum of two inspections during the construction
process to ensure proper erosion control is established before and during the construction. j
The Staff Planner will have the authority to stop construction if it is determined that
proper erosion control is not in place.
