city a~d ~own shall be ~en and a special en~eration sh~l also
specify, the n~ber of legal voters residing in each precinct of
each ~own containing twelve thousand or more i~abitants according
to said census ~d in ea~ w~d of each city. Each special
en~eration s~ll be the basis for deter~ng the representative districts
for %he ten .year period beginning with the first Wednesd~ in the
fourth J~u~ following said speci~ en~eration; provided,
such ais%ricts as estmblished In ~he ye~ ~neteen hundred and
~wen~y-s~ sh~l continue in effec~til the firs~ Wednesday

Janus~y in the year nineteen hundred and thirty-nine.
The House of Representatives shall .consist of two hundred'
and forty members, which shall be apportioned by the ~eneral Court, at
its first regular session after the return of each special enume~ation,
to the several Counties of the Commonwealth, equally, as nearly as may
according to their relative n~bers of legal voters,as ascertained
by said special enumeration; and the town of Cohasset, in the County
of Norfolk, shall,for this purpose,as well as in the formation of
Districts as hereinafter provided, be considered a part of the
County of Plymouth; and it shall be the duty of the Secretary of"
the do~m~onwealth to certify, as soon as m~y be after it is
det~m~ine~ by the General Court, the number of representatives to
which each c~unty shall be entitled, to the board authorized to
divide such county into representative districts; The County
Commissioners or other body acting as such or, in lieu thereof,such
~oard of special conm~issionersin each county as may for that .purpose.
be provided by law, shall,within th~ity days after such certification
by the secretary of the commonwealth or within such other period
as the general court ~y by law provide, assemble at a shire town . .
of their respective counties and proceed, as soon as may be, to
diyide the same' into representative districts of 'contiguous territory
and assign representatives thereto, so that each representative in
such c~unty will represent an equal number of legal vomers, as nearly
as may be; in such districts shall be so formed that no town containing
less than twelve thousand inhabitants according to..said census, no
precinct of any other to~'m and~nodward of a city shall be divided
therefor, nor shall any district be made which shall be entitled to
~lec~ mone thmn three representatives, The general court may by law
limit the time within wtzich judicial proceedings m~y be instituted
calling in question any such apportiorm~ent, division or assignment,
Every representative, for one year at least im~ediately preceeding his ,..~
election, shall have been an inhabitant of %~ distr~t~0~ which he is
chosen, and shall cease to represent such district when he shall cease
to be an inhabitant of the comm~onwealth. The district's in each county
shall be numbered by the board creating the same, and a description of
each, with the'mm~ers thereof and the number of legal voters therein,
shall be retu~'ned by the board, to the secretaaY, of the commonwealth,

the county treasurer of such county, and the clerk of of every city
. and t'own in such county, to be filed and kep~t in the.ir respective
offices~ The manner of~calling and conducting t.he elctiens for the
choice of representatives,, and of ascertaining their elction,, shall
be preec_~ibed by law.
Article XXll of the a~ticle of ame.dment is hereby
annulled and the following is adopted in place thereof:
Article XXll. Each special enumeration of legal vc~ers
requir~e~ in the preseding article of amendment shall likewise be the
basis~, f.~o.r determing the senatorial districts and also the councillor
districts for the ten yea~period beginning wi.th th~ first Wednesday
~n th, e.. fourth ~anuary following such entu~eration; provided, t~at such
districts as established in the. year nineteen hundred twenty-six sba!l
~c~ntinue in effect untiI the first Wednesday in '~anuary in the .year
nineteeh·~.hundred thirty-nine. The senate shall consist of forty
members. The general court shall, at its first regGlar session after
the re~urn of each specia~ enumeration, divide the commonwealth into
forty' districts of contiguous .territory, each distric~ to contain,
as nearly a~ may be~ an equal number of legal vo~ers, according to
said s.aid' special enumeration; provided, however, that no town or ward of
a city shall be divided therefor; and such district shall be.formed,
as nearly aa may be without uniting two counties, er~parZs ~£~two~..or
m~re counties, into one district~ The general court may by law 1Lmit
the time within which judicial proceedings may be instituted calling in
