qualified to vote in Elections and Tovm Affairs,.to meet in %he Engine
Eouse in voting precinct one, the merrimack Portable Schoolhouse in

Article 1. To elect a Moderator, Town Clerk: Term Treasurer:
~hree Selectmen, three members of.the Board of Public Welfare:for one
yearS one Assessor of Taxes: one member of School Committee: one member
of Board of Health, one member Board of' Public Works for ~three years;
one member of the ~oard of Health for one year to fill vacancy~ a Highway
Surveyor ~ a Collector of Taxes: an Auditor, aTree Warden and five
Constables for one year, andany and all Town Officers required by law

Article 2. To elect all otherofficers not required by law to be

Article 6. To see if the term will vote to authorize the Term
Treasurer,with {he approval of the Selectmen: to borrow money from time
· tQ time in anticipation of the revenue of the finnncirl year beginning
eanuary 1, 1936, and to issue a note or notes therefor, payable within
one year~ and to ~enew any note or notes as may be given for a period of
, lees than one yeer, in accordance wi{h ~ection 17: Chapter 4~,.General Laws..
Article 7. To consider reports of all special committees.
Article 8. To see if %he town will vote to use the unexpended
Oalance of two thousand(S2000) dollars of the 193~ Reserve Fundto apply
~o the Seserve Fund of 1936. Petition of %he Selectmen.

Article 10. To see what action the tovm will take in regard to

Article ll. To see if the to~,na will vote to appoint a co~maittee
of five members to serve without pay, said co~ait%ee shall consist of the
Board of Selectmen~ Chairmsm of the Board of Health, and the Chief of
Police~ for the purpose of looking into the advisability of adopting a
Zoning By-Law, that will prdmote the healthy safety~ convenience and
welfare of the inhabitants~ will tend to improve and beautify the town~
harmonize with its natural developments~ and will assist the carrying
out of any scheme for municipal improvement~ in accordance w~th General
Laws(Tercentenary Edition) C~pter 40~ecticn 2~, and any and all acts
in amendment thereof or in addition there.to. The said committee is to
report its recommendations and any proposed adaition to ~he Tova~ By-Laws

Article 12. To see if the tovrn.will raise ~-~nd appropriate the sum
of seventy-five($7~) dollars ,for the observance of Armistice ~ay~
Petition of Joseph Trickett and others.
Article l~. To see if the to~rn ~ill vote to~appropriate~ the
'amount e~ual to the insurance received~twelve h~ndred seventeen dollars
and niCety-four cents($1217.9~),for fire. which occured Oct. 28, 19~5,
at the Town Infirmary and which destroyed sheds and farm implements.This~
amount to be used to replace the buildings~ implements and equipment

Article 14. To see if the tovn~ will vote to raise and appropriate
the sum of six hundred dollars for painting the interior and 'exterior
of the American Legion Beach bath house; purchasing and erecting a steel
flag pole; improving ~the sanitary conditions and upkeep of the grounds.

of Accounts of the ~epartment of Corporations and 'Z'axation for the

balances of the 19~ E. R. A. appropriation ~o the 19~6, appropriation

Article 17. To see if the to~n~ will-vote to ac'cept Dufton Court
from Andover Street to Chickering Road. Petition of ~eorge F.Schruender
and others.
Article 18. To see if ~he tov~ will vote to raise and appropriate
the sum of one thous~nd($1000) dollars~ for repair of the heating and
ve,ntilating system o'f the Union School. Petition of ~he School Committee.
Article 19. To see if 'the town will vote to raise snd appropriate
the sum of seven hundred fiftY(S750), for replacing ~he floor of the
gymnasium in the J~hnscn High School. Petition of School committee.
Article 20. To see if the tovm will raise and appr¢,priate the sum
of three hundred ($~00) dollars~ for ~he purchase of a mechanical
r. efri~erator~ for the lunch room at the Johnson High School. Petition of

Committee's recommendation that the' River School property be disposed of
by ~the t.own as there seems to be little probability that it will again.

Article 23. To see if the to~rnwill authorize the Board of Public
Works to use the unexpended balance of three hundred fifty-three dollars
and seven cents($3~3.07) of the 1935 appropriation for a water main on
Prospect Street and the unextended balance cf four hundred eight dollars
and fifty-eight cents ($408.58) from the 19~ appropriation for a water
main on Dufton Court and such addition~l sum from the appr~priatio~ for
maintenance and construction of the water and sewer departments as will
purchase a one and one-half ton truck. Petition Board of Public Works.
Article 2~. To see if the town will raise and appropriate the
sum of seven thousand ($7000)dollars~ for materials and services ~o ~e
used in completing the additional water supply reservoir now being
constructed with Works Progress Administration funds from ~he

of Boxford Street under Chapter 90~ of ~he ~eneral Laws, said money to be
· used in cor~unction with any money ~hich may be allotted by the Stste or
County or both~ for this pur~ose~ or.take any other action in relation

Article 31 To see~ if ~he tov~nwill raise and appropriate the sum
of fsur thousand dollars($~O00)~ to'carry on the activities of ~he ~.P.A.

Article 32. To see if ~he town will raise and appropriate the sum
of five h~ndre~ seventy-nine dollars and six,y-six cents($~79.66), for the
unpaid bills of 193~ of the Board of Public Welfare. Petitibn of the

Article 3~. To see if the town will raise and appropriate the
sum of two hundred twenty-one ($221) dollars~ for ~he uhpaid bills of
19~,of the Bureau of 01d Age Assistance.

WARRANT.
Article 34 To see wheter the town will adopt the following By-Law
or some modification thereof for the purpose of regulating billboards or
other outdoor advertising devises~
By-Law-~e~ulation of Advertising Signs and Billboards.
SectioD 1. Authorization . In conformity with the General Laws and
lav~ful State regulations for the proper control and restriction of outdoor
adve~ising devices, and without relaxing any restrictions on said devices
imposed by such regulations~ said devices in the To~,a~ of ~orth Andover
are hereby further restricted as provided in the following sections.
Section 2. EEemptions.. This By-Law shall apply exclusively to
outdoor advertising within public view of any highway~ public park or
reservation. It shall not apply to signs or other devices controlled under
the provisions of Bections 1, 2 or 8~ of Chapter 8%~General Laws~ or to
signs or other devises on or in the rolling stock~ stations, subways or
structures of or used by common carriers, except advertising devices on
bridges or viaducts or abutments thereof; and~ except for lawful restrictions
as to size and location~ it shall not apply to signs or other devices which
advertise or indicate either ~he person.occupying the premises' in question
or the business transacted thereon or advertise the property itself or any
p~rt thereof as for sale or to let and which contains no other advertising
matter. It shall not apply to any advertising device legally permitted and
maintained on the date of the taking effect of this by-law, until one year
after the first day of July next following said date.
Section 3. Definitions: =Advertising Devices~ shall mean billboardss
painted bulletins, poster p~nels~ signs~ placards and other outdoor units
designed to call public a~tention to the matter displayed thereon.
~Advertising sign~" or ~'signs= Shall mean any outdoor advertising device.
~Sign-board" shall mean any structure designed for displaying an outdoor
advertisement. "Highway~' shall mean any public way. "Public ~a=k~ shall
mean a piece of public land of at least five thousand square feet set apart
for beauty and public enjoyment. ~Public reservation" shall mean a piece of
public l~nd set apa.~t for recreational use~ as a state or municipal forest~
as a protection to a public water supply~ as a memorial~ or cemetery~ or as
a place of unusual scenic cr historical interest. "~ermitted~ shall~mean
authorized by an official permit. ~Display~ shall mean to make or maintain
visible from any highway, public park or reservation. ~Area" of a sign or
signboard shall mean the area of the f~ce view of the entire d~vice~including
all a~tachments except supports and lattice at the base thereof.
',Residential District" shall include any district or block in which Lhe
greater part of the stree~ frontage is occupied by land of on~ or more of
the following classes: land devoted to residence or lodging purposes;
undeveloped or open land~ l~nd devoted to farming~ horticulture~
floriculture or plantations~ including the sale thereon of its products,
or to the raising ¢.f live stock~pasturage~ forestsswood lots~p~rks,
reservations or recreation areas. "Non-conforming business" shall mean a
Ousiness located in a residential or rural district~ other than such rural
~usiness as farming or the raising and sale on the same premises of farm~
garden or orchard products. "Lawful sign" shall mean any outdoor advertising
device not prohibited by any provision of law or by any lawful regulation.
"Accessory sign" shall mean any outdoor advertising device which carries
only advertisements strictly incidental and subordinate to a la~ul use of
the premises on which it is located~ including signs indicating business
transacted or goods sold or producted on the premises or an occupant
~hereof~but not including any sign sold or rentedto an outside party~
"Sign on a wall" shall mean a sign closely at~ached throughout to and
zacing with that wall, or on a window or door therein. "Lot" shall mean
a plot of ground containing and devoted to the purpose of a building~ or
~aid out to contain a building, with oll required open spaces~ or a larger
tract of unbuilt, undivided land under one o~ership.

Section 4. General Restrictions. ~o person~ firm, association, or
corporation shall be permitted or allowed ~o erect, display or maintain
any billboard or other outdoor advertising device, not exempted by ~ec. 2,
hereof, except those specified in parsgrsphs (a) (b) (c) (d) and (e) of
~his section. (a) Zn districts not of a residential or rural character,
any la~ful sign on o= attached to a wall of a building or any lawful ground
or roof sign or signboard no part of which extends over fifteen feet above
the part of the ground or roof on which it stands.
(b) Zn a residential or rural district~ any la~ful accessory sign or
signs not exceeding five square feet in aggregate area on any building
or lot~or any lawful sign or signs advertising only ~he sale or rental
of the premises not exceeding a total area of ten square feet; or,on
~he premises of any public building, or of any farm~ garden~ tre-nursery or
~orest, any lawful accessory signs not exceeding all together fifteen
square feet in area within ~he limits of said premises; or any la~ul
accessory signs on the front wall of any building occupied by a
non-conforming business. (c) Any lav~ul sign not exceeding thirty~two
squere feet in ares displayed by the town, or any sign displayed by the
United $~ates~ the Stste or ~he County~ relative ~o government business.
(d) At any boundry line of the town a la;~ful sign no~ exceeding five
square feet in area indicating ~he meetings of any civic organization
located therein. (e) On property owned or principally occupied by a
religious, civic or charitable organization,association o~ war veterans
or the like~ any lawful accessory~sign displayed by ~rit~en permission
of the ~electmen and approval of the ~nspector of Buildings,if auy~ for
a limited per~od not exceeding sixty days.
~ection ~. Set-~acks. No advertising sign or signboard s~w~ll be
permitte~ or allowed to be so located ~s to'obstruct a view between
any points on connecting streets within fifty feet of a cor~er of
the rights of way;or to obstruct any door, window orfire-escape on a
Ouilding; or, if on a roof,~o be set nearer th~n one-half its hei. ght
to the wall thereof on a street front; or, in a residential district~
to extend more than six inches nearer to any boundry of ~he'lot or
Dremises on which it is located than it would ~be lawful to maintain
a buflding~ except as provided in paragraph (d) of Oection 4.
Section 6. ~ro~ib%tions.Except signs exempted under Sec. 2, no
person~ firm, association or corporation shall be permitted or allowed
to erect, 'display. or maintain any billboard or o~her outdoor advertising
device in any district.(a) Except the owner or a tenan~occupant of the
premises where it is located~ or a pary holding written permission from
· either to display ~he device for a limited period which party's name
shall be conspicuously displayed thereon;
(b) Upon any rock~tree~ fence or pole.
(c) Within one hundred feet of any church~public building~
monument or memorial~ or within three hundred feet of any public park~
playground~ or public reservation~if within view from any portion
~hereof; except that this pmragraph sh~ll not apply to accessory signs
on the walls of b~ildings;
(d) If it contains any obscene~ indecent or immoral
matter.
(e) Unless all parts and attachments a~ud the ground
about the base thereof are kepZ in neat and safe condition.

WARRANT
Section 7. Administratio_~n. No advertising device for which a
permit '~om ~ny State authority is required shall be erected~ displayed or
maintained in the town until five days after a permit therefor, or a
true copy thereof~ has been filed with the Tov~ Clerk. Whenever notice
of an application for such a permit is received by the ~'ov~ Clerk~he
shall in~ediately transmit to the Inspector cf Buildings or other
officer,'if any~ charged with the administration of this By-~sw. Such
officer~ or in the lack of such officer~ the Town Clerk~shall thereupon
m~ke an examination of the case and~ as promptly as possible~ within
thirty days of the receipt of the application by the Town Clerk~ shall
send written notice ~o the State authority to whom the application is
addressed~ stating whether or not the proposed advertising device would
violate anyprovision of this By-Law~ and if so~ what provision. Like
notice shall be sent also to the applicant and toe.the owner or tenant
of the proposed location of the device.
At least twenty-five days before an outdoor advertising device
not ~equiring a permit from any ~tste authority and not exempted
under Section 2~. shall be erected or displayed in the town~ a description
thereof and of its proposed location shall be filed with the To~rn Clerk~
after which the procedure shall be the same as prescribed in the preceding
paragraph in the case of an application for a State permit~ except that
notice whether or not the device would violate any provision of the law
shall be sent~ within twenty days after receipt of description~ only
to the ~party filing thetsame and to the owner or tenant of the
proposed location.
~ection 8. ~lties and Enforcement. Whoever violates any
provisions of sections ~ ~ or 6 hereof~ shall be guilty of a
misdemeanor a~d shall Be punished by a fine'cf not more than one hundred
dollars~and whoever after final conviction for such violation unlawfully
displays such outdoor advertising device for twenty days shall be
punished by a fine of not more than five hundred dollars.
The Selectmen or any officer charged with the ~nforcement of
this by-law shall cause any such violator to be prssecuted; and shall
notify the ~tate regulatory authority of Outdoor Advertising of any
and all violations of lawTul S~ate regulations.
Any town officer or any interested party msy petition the
Superior Court in equity to enjoin ~he erection or maintenance of any
outdoor advertising device erected or maintained in violation of any
provision of.this by-law. Totem Officials shall have the same right
and power to cause the removal of any outdoor advertising device as of
any structure orbuilding maintained in violation of a by-law.
~ection 9. If any provision of this by-law is declared
unconstitutional or illegal by any court~ the validity of the remaining
provisions shall not be affected thereby.
Section lC. All regulations for outdoor advertising devices
heretofore adopted by ~he town and in force at the time of the
adoption cf the foregoing sections ~re hereby repealed~
Article ~5. To act upon any other business which may be
legally considered at this meeting.

attested copies thereof, at the To~nPIall and at five or mcre p~blic
places in each voting precinct. Oaid copies to be posted not more than
fifteen days nor le~s than ten da~s before ~he time of holding said
