It was-voted that" the' Selectmen-.be, and- they hereby are, autho~lzed--and-'dlrected~o~execute; in the name.and in behalf of' the To~n, a qultc'laim deed 'and'such other legal doct%m~nts as maybe necessa~j or advisable, 'to effect, on or before May l, 1948, the following transactions: a. ~he sale and conveyance to the ~ustees of the First~ Methodist Episcopal Church of North Andover, or to their nominees, for an agreed consideration of twelve cents per square foot, of a parcel of land now owned by the Town, and containing 9083 Square feet, more or less, being a strip 'of land fifty feet wide, running between-Mains Street on the west and Water Street on the East, and bounded~on the north by land of said T~ustees and on .the s0uth."~by'-'other'land of the Town to be sold and conveyed to the Roman.' 'Catholic-Archbishop of' Boston~ a corporation sole: said' 'deed-to contain-express restrictions'prohibiting-the construction or maintenance by the grantee of any building or part thereof nearer~ than ten feet- to the :'southerly boundary of said'premises. b.. The. express and binding affirmance, of said grantee, notwith- standing the execution and delivery of said quitclaimdeed and the'payment of said considerations, of the continued.-and exclusive right of the Town to use, without charge, and subjectI t~ the .'con- trol and .Jurisdiction of its School Committee, all portions of said premises for school purposes~ said right to-continue until such time as a new public school building to serve the area of the Town now served by the Merrimack School, be. erected, fur- nished, and ready for occupancy and use for school purposes. 2.. ~at the Selectmen be, and they hereby are, authorized ahd directed to execute, in the name and in behalf of the Town, a quitclaim. deed, bill of sale and such other legal documents as may be necessary or advisable toeffect, on o~ before May 1, 1948 the following transactions: a. The sale and conveyance to. the Rozm~ Catholic A~chbishop of Boston, a corporation sole, of the. Merrimack School buiIding, and all of its equipment and fixtures, excep.ting only all fixtures and equipment now contained in said building and~.used for the instruction of pupils in domestic science and manual ' training, together with all of the Merrimack School lot, except the most northerly fifty foot strip thereof, fo~ an agreed con- sideratfon of $~2,500. for said building and 'fixtures, and. an agreed consideration of twelve ~cents per square foot for' iaid land~' which contains ~7217 square feet, moxe~o~ less. b~ ' The express an~ binding affirmance 0f-Sai'd grantee,, d6twith- standing the execution and delivery of,said deed and bill of. sale and the payment of said :consideration, of the, con..tinued and' exclusive right of the Town,to use, 'with6ut'gh~rge subject to the control and Jurisdiction of its ~School Com~ittee, all .~portions of said land and~buildin'g, and,all 0f~ said. equipment and' fixtures for school purposes, said.right,to, continue-until such time as a new public school building, to serve, the area of the Town now served by said .Merrimack School, be erected, furnished, and ready for occupancy and use for school purposes: provided,. however, that during such continued use by the ~own, all ~insurance against fire or other loss now carried'by the Town' upon said building, equip~e~nt 'and fixtu.~es, ~h_-ll be kept in force at the expense cf.:the own, in amoun=s not less than the amounts of such insurance now in force. 3. ~-t the amount received"f~om.,the sale'and conveyance of. the Merrimack School building, equipment and land be made available without fu'rther appropriation, to the use of the School Building ' Committee in carrying out the vote of the Town Meeting ~under Article S8 of the ..warrant for the Annual Town Meeting of March 13,~ 1948, and thereby reducing the amount of the bond issue authorized under that article by a like amount. The speakers were: Mr. Arthur' E. Sunderland, Advisory'Board, Arty Charles W. ~ombly~ School C~mm~ttee. Mr. Francis B. Elttredge, School Building Committee. Mr. 'John R. Hosking, School Committee. Mr. Carl D. Miller, Center District. Rose McEvoy,~Rita Enaire, Lillian Dearden, Angelina Eell~y, Alfred Gar~eau, and John Hagarty were checkers at various doors. William'Glennie, William Duffy, John Ward, 0yril Enowles, Milton Howard, Bert Wilde, Dewey Dyer, Jr, and Alvah Hayes, were assigned as assistants'to the Moderator to count votes should the occasion ~warranted-such.
