This is to certify that the following vote on Article 18 was taken at the
Dissolved Annual Town Meeting for the Town of North Andover held May 10, 11
and 17, 2004:
Article 18. Acquisition of Land — The Land, Open Fields and Woodland on the
Shore of Lake Cochichewick Known as the Kettenbach Property and also "Half
Mile Hill Summit". VOTED BY TWO-THIRD VOTE DECLARED BY THE
MODERATOR that the Town appropriate $2,650,000 for the acquisition by purchase or
eminent domain of a parcel of land of approximately 30 acres of land owned by Michael
L. Kettenbach, as described on Assessor's Map 35, Parcels 24, 25, 33, and 34, and Map
36, Parcel 21, to be managed and controlled by the Conservation Commission of the
Town of North Andover in accordance with Chapter 40, Section 8C for conservation and
passive recreation purposes, and to meet said appropriation the Treasurer with the
approval of the Board of Selectmen is authorized to borrow $2,650,000 in accordance
with Massachusetts General Laws Chapters 44 and/or 44B, the Community Preservation
Act, or any other enabling authority, and to issue any bonds or notes that may be
necessary for that purpose, and that the Town Manager be authorized to file on behalf of
the Town of North Andover any and all applications deemed necessary under the Self-
Help Act (Chapter 132A, Section 11) or any other applications for funds in any way
connected with the scope of this acquisition, and that the Town Manager and the Board of
Selectmen and the Conservation Commission be authorized to enter into all agreements
and execute any and all instruments, including a permanent deed restriction in accordance
with General Laws Chapter 184 and take any other action as may be necessary on behalf
of the Town of North Andover to effect said purchase.
