HomeMy WebLinkAboutUtility Easement - Town Common Area Town of North Andover Request to Include Article For May 10, 2004 Annual Town Meeting (Town Division/Department) Submitted by: Assistant Town Manager/ Human Resources (Name of Department/Division) Ray Santilli (Name of Division Director) (Name of Department Director, if applicable) Date: February 12, 2004 Requested Article: Authorization Massachusetts Electric and Comcast of Massachusetts Utility Easement—Town Common Area —and Authorization of a Petition to the Massachusetts Legislature for Special Legislation. To see if the Town of North Andover will vote to authorize the Board of Selectmen to grant a utility easement to Massachusetts Electric Company and to Comcast of Massachusetts on a parcel of land situated on the northeasterly side of Osgood Street, the southwesterly side of Massachusetts Avenue, and the northerly side of Andover Street, being shown on Assessor's Map 59 as Lot 19 with the easement being shown on a plan described as "North Andover OH to UG Commons Project" which is on file with the Town Clerk's office on such terms as the Selectmen deem to be in the best interest of the Town of North Andover and authorize a petition to the Massachusetts Legislature for special legislation to accomplish the foregoing; or to take any other action relative thereto. Draft Motion: Move to adopt the article as printed in the Warrant. Reason(s) for Article: A previous Annual Town Meeting vote authorized an underground utility project in the Town Common Area. Town Counsel advises that the utility easement proposed on the Town Common requires approval by the Board of Selectmen, Town Meeting approval, and special legislation approved by the Massachusetts Legislature because the property was acquired by the Town for park and playground purposes.
