HISTORY AND BACKGROUND i On January 15, 2019 the applicant requested a waiver of a Watershed Protection District Special { Permit, in accordance with the North Andover Zoning Bylaw section 4.24, also known as section 4.24, as to allow for the replacing the existing 2nd floor deck with a 6' X 16' Trex deck with 2 small helical piles within the within the 100-foot Non-Disturbance buffer zone of the Watershed Protection District. 1 FINDINGS OF FACT The Planning Board has made its decision based on the following findings: • A Mortgage Inspection plan, dated July,25, 1999 was submitted entitled which details the structure's location. • The North Andover Conservation Commission approved a Small Project Filing on January 9, 2019. • The project includes removal of a 6'X 20' cantilevered deck. • The structure will not disturb existing topography. • The proposed changes will not create a more detrimental impact on the wetlands than exist on the property and there will not be any significant degradation of the quality or quantity of water in or entering Lake Cochichewick. DECISION After discussion at the January 22,2018 Planning Board meeting,and upon a motion by J. Simons and seconded by A.Preston,the Planning Board Approves the Watershed Special Permit—Waiver with conditions. A vote of 4-0 was made in Favor of the waiver request. 722 Great Pond Road 1 Map 63 Parcel 24 j Watershed Protection District Special Permit-Waiver i Page 2 of 2 CONDITIONS 1. Proper erosion control will be constructed and will remain throughout the project, according to the conditions approved by the Planning Department staff. 2. The Planning Office will perform a minimum of two inspections during the construction process to ensure proper erosion control is established before and during the construction.
