BACKGROUND
On September 6, 2018 the Planning Board approved a Watershed Protection District Special
Permit so as to allow for the addition of a 14'X16 , four season finished sunroom and 10'X10' deck with
portions of work in the Non-Disturbance Zone and the Non-Discharge Zone of the Watershed Protection
District. The project is located within the Residential 3 (R-3)Zoning District.
On March 27, 2019 the Petitioner requested an Insubstantial Change determination so as to allow
for Special Permit Modification for Condition number 28 to be stricken.
FACTS
Condition 28 of the Watershed Protection District Special Permit dated September 6,2018 requires
the applicant to provide a copy of the final as-built plan showing the final location of all on-site
structures and infiltration systems must be submitted to the Planning Department. The as-built
must be provided in paper form as well as in SDF(Standard Digital File)format prior to the release
of the performance bond.
DECISION
After discussion at the April 2, 2019 Planning Board meeting, and upon a motion by J. Simons,
seconded by P. Boynton, the Planning Board voted to approve the Insubstantial Change request
with the following conditions. The vote was unanimous, 5-0 in favor.

CONDITIONS
The applicant shall provide a written letter from a Professional Engineer stating that the
construction substantially conforms with the approved plan and Watershed decision. Any
deviations would be noted in the letter as well.
The Petitioner shall comply with all existing conditions rendered in the Watershed Protection
District Special Permit issued September 6,2018,except for specific conditions superseded by this
Notice of Decision—Insubstantial Change.
This Notice of Decision shall be recorded with the Essex north Registry of Deeds and evidence of
recording shall be provided to the Planning Department.
