BOARD OF SELECTMEN MINUTES September 9, 2019
CALL TO ORDER: Chairman Richard Vaillancourt called the meeting to order at 6:30PM in Meeting
Room at Town Hall.
ATTENDANCE: The following were present: Chairman Richard Vaillancourt, Clerk Rosemary Smedile,
Licensing Chairman, Regina Kean, Chris Nobile, Phil DeCologero, Interim Town Manager, Denise Casey
and Town Counsel, Suzanne Egan.
EXECUTIVE SESSION
Chairman Vaillancourt requested a motion to enter into Executive Session.
Phil DeCologero made a MOTION, seconded by Regina Kean, that the Board of Selectmen enter
into Executive Session pursuant to Massachusetts General Laws, Chapter 30A, Section 21(a)(2) to
discuss strategy with respect to litigation (Recreation Complex) and to return to Open Session at
the conclusion of Executive Session.
Chairman Vaillancourt declared an open meeting may have a detrimental effect on the Board’s litigating
position.
Roll call vote: Kean-yes; Nobile-yes, DeCologero-yes; Smedile-yes, Vaillancourt-yes.
The Board returned to Open Session at 7:00PM
PLEDGE OF ALLEGIANCE
PUBLIC COMMENT
Jim Lafond of 320 Osgood Street asked about appointments to the Stevens Estate Advisory Board.
Chairman Vaillancourt stated that at the last meeting it was agreed that Regina Kean and Rosemary
Smedile would make a recommendation regarding the Stevens Estate Board and its charge at the next
meeting.
APPROVAL OF MINUTES
Chris Nobile made a MOTION, seconded by Rosemary Smedile to approve the Open Session
Minutes of August 26, 2019. Motion approved 5-0.
GOVERNMENTAL REPORTS
Main Street underground lighting project
John Borgesi updated the Board regarding the Main Street Underground Lighting project. Funding is a
concern as the surcharges being collected will take longer than expected to get to needed funding level.
The area of the project is also in the gas restoration area so it is recommended delaying the restoration
on Main Street until this project is ready to go. They will be meeting next week to try to project the funding
and when they can begin.
Senior Center Parking lot
Town Counsel, Suzanne Egan, presented the options for use of the proposed parking lot for the new
senior center. The Town can acquire the land which would need a Town Meeting Vote. The Town can
obtain an easement which would also require Town Meeting approval. The Town can lease the property
for up to 30 years which only needs Board of Selectmen approval. The Town can enter into a licensing
agreement which gives no rights to the property but only permission to occupy at will.
LICENSING COMMISSIONERS
Rosemary Smedile made a MOTION, seconded by Regina Kean to open a meeting of the North
Andover Licensing Commission. Motion approved 5-0.
Request of Smolak Farms for three one day wine and malt licenses in the tent for Fall Festivals from
10:00AM to 5:00PM on September 22, 2019, September 28, 2019 and September 29, 2019
Tricia Dunphy and Deborah Ingalls were present on behalf of Smolaks.
Chris Nobile made a MOTION, seconded by Rosemary Smedile that the Board of Selectmen,
acting as Licensing Commissioners, approve the request of Smolak Farms for three one day wine

and malt licenses for fall festivals from 10:00AM to 5:00PM on September 22, September 28 and
September 29, 2019, as presented. Motion approved 5-0.
Request of Butlers and Bars for a one day all alcohol license for a staff appreciation dinner in the
Seasonal Event Tent on October 4, 2019 from 4:00PM to 8:30PM and a waiver of the police detail
Phil DeCologero made a MOTION, seconded by Rosemary Smedile that the Board of Selectmen,
acting as Licensing Commissioners, approve the request of Butlers and Bars for a one day all
alcohol license for a staff appreciation dinner in the Seasonal Event Tent on October 4, 2019 from
4:00PM to 8:30PM and a waiver of the police detail. Motion approved 5-0.
Request of Merrimack College for a one day entertainment license for an event at the Sakowich Center
Parking Lot on September 13, 2019 from 5:00PM to 10:00PM
Richard Vaillancourt made a MOTION, seconded by Chris Nobile that the Board of Selectmen,
acting as Licensing Commissioners, approve the request of Merrimack College for a one day
entertainment license for a block party at Sakowich parking lot on September 13, 2019 from
5:00PM to 10:00PM. Motion approved 5-0.
Richard Vaillancourt made a MOTION, seconded by Chris Nobile to close the meeting of the North
Andover Licensing Commission. Motion approved 5-0.
CONSENT ITEMS
Waive permit fees for Town projects
The Board is being asked to waive the permit fees for municipal projects for FY20. The Board asked why
water and sewer fees are not being paid by the revolving account. Ms. Casey said she would look into it
and report back to the Board.
Rosemary Smedile made a MOTION, seconded by Phil DeCologero to take no action. Motion
approved 5-0.
Accept donation from Wheelabrator in the amount of $10,000 for the Trauma Intervention Program of
Merrimack Valley, Inc.
Phil DeCologero made a MOTION, seconded by Regina Kean that the Board of Selectmen accept
the donation from Wheelabrator in the amount of $10,000.00 to fund the services of Trauma
Intervention Program of the Merrimack Valley. Motion approved 5-0.
Accept donation from North Andover Hockey League to the Youth and Recreation Services in the amount
of $500
Regina Kean made a MOTION, seconded by Rosemary Smedile that the Board of Selectmen
accept the donation from the North Andover Youth Hockey League in the amount of $500.00 to
Youth and Recreation Services to be used for scholarships. Motion approved 5-0.
Request to surplus vehicles-DPW
Regina Kean made a MOTION, seconded by Chris Nobile that the Board of Selectmen approve the
request of DPW Director, Jim Stanford, to surplus a 2008 Chevy Equinox, a 2007 Chevy Silverado
and a 2009 Chevy K2500. Motion approved 5-0. Motion approved 5-0.
Appointments:
Larry Smith from associate member to full member on the Council on Aging
Julia Ross to the Sustainability Committee
Phil DeCologero made a MOTION, seconded by Chris Nobile that the Board of Selectmen appoint
Larry Smith as a full member on the Council on Aging for a term ending June 30, 2022 and Julia
Ross to the Sustainability Committee for a term ending June 30, 2022. Motion approved 5-0.
NEW BUSINESS
Discussion on the formation of an advisory committee for the Recreational Complex
Chairman Vaillancourt suggested the Board think about the formation of the Advisory Board for the
Recreation Complex with the charge that they would make recommendations for guidelines for the use of
the complex.

TOWN MANAGERS REPORT
The Board was provided with the job posting/vacancy log. Interim Town Manager, Denise Casey, thanked
the Board for their support during her tenure in the role as Interim Town Manager.
SELECTMENS REPORT
Rosemary Smedile stated that they were disappointed that Rock the Block was cancelled but under the
circumstances, it was the right thing to do, given the risk of EEE.
Phil DeCologero reminded people about the Farmers Market, Artisan Market and Fall Festival.
Interim Town Manager, Denise Casey, stated that the town spent a lot of time exploring other options for
Rock the Block.

Richard Vaillancourt stated the new Town Manager starts on September 16 and reminder people about
the 9-11 ceremony in front of Town Hall.
ADJOURNMENT
Phil DeCologero made a MOTION, seconded by Chris Nobile to adjourn the meeting at 8:45 p.m.
Motion approved 5-0.
