HISTORY AND BACKGROUND
On August 15,2019 the applicant requested a waiver of a Watershed Protection District Special Permit, in
accordance with the North Andover Zoning Bylaw section 195-4.24 as to allow for the installation of a new
foundation within the same footprint of the existing Herse House structure as part of a historic renovation
project within the within the 100-foot Non-Disturbance buffer zone of the Watershed Protection District.
Work is less than 25 feet from the Bank of the stream.
FINDINGS OF FACT
The Planning Board has made its decision based on the following findings:
• A Plan, dated July 25, 1999,was submitted entitled"Ridgewood Cemetery Locus Plan"which
details the structure's location.
• The Applicant received a Negative Determination of Applicability from the Conservation
Commission on April 11,2018.
• The project involves the lifting of the existing historic structure to enable the installation of a new
foundation.
• The structure will not disturb existing topography.
• The proposed changes will not create a'more detrimental impact on the wetlands than exists on
the property and there will not be any significant degradation of the quality or quantity of water in
or entering Lake Cochichewick.
• Erosion controls have been installed between the work area and the wetland resource area.
DECISION
After discussion at the August 20, 2019, Planning Board meeting, and upon a motion by J. Simons and
seconded by K. Bargnesi, the Planning Board Approves the Watershed Special Permit — Waiver with

conditions. A vote of 4-0 was made in Favor of the waiver request.
CONDITIONS
® The Town Planner must perform a minimum of two inspections during the construction process '....
to ensure proper erosion control is established during construction.
® The Town Planner can stop construction if the proper control is not in place.
