Conservation Conditions of Approval, NACC #243
Pursuant to section 4.4.2 (B) of the North Andover Wetlands Protection Regulations,Alice Piddle
Dolben, applicant/homeowner, filed for a small project for work proposed at 41 Saile Way, North
Andover. The proposed work includes removal of an existing 232 s.f. deck and construction of a i
new 282 s.f. deck in the same general location at the rear of the house. The new deck will be
supported by new concrete footings that will disturb no snore than 20 s.f. of ground surface. The
new deck will be 94 feet from the edge of delineated bordering vegetated wetland.
During the September 25,2019 public meeting, the North Andover Conservation Commission
voted unanit-nously to approve this project. The project is approved only as it relates to the
Conservation Commission and any and all other approvals should be obtained by the

applicant/home owner. The applicant is responsible for determining property boundaries. All work
shall conform to the following:

1. This approval is for the plan referenced above. Should the Planning Board review process
change this plan,the applicant must return to the Conservation Commission for review and
approval of any changes.

2. Prior to the start of construction the applicant shall ensure that the site contractor has reviewed
the small project permit and is aware of the wetland resource area and the limits of the proposed
work.
3. Prior to start of construction a pre-construction meeting shall be held with Conseivation
Department staff and project principle and contractor to review approved work and conditions
of this approval.
4. Upon completion of the approved project,please contact the Conservation Department for a
final inspection.
5. This permit shall expire one year from the date of issuance.

Proposed Deck expansion —Sniall Project Filing
Proiect Narrative;
The owner/applicant,Alice Biddle Dolben, is seeking to remove an existing 232 s.f. deck and construct a new,
slightly larger deck(282 sf.) in the same general location. Since this site is within the watershed to the Lake,
a Watershed Special Permit has been filed with the Planning Board for this project. Norse Environmental
Services, Inc delineated the wetland boundary. The closest point from the wetland line to the proposed deck is
94 feet. A 12 diameter staked mulch soxx is proposed as erosion control.
A Plot Plan is provided as part of this application prepared by this office showing the site, wetland line,
wetland buffers zone, and the proposed deck construction.
Howell Custom Building Group has provided a deck schematic plan showing the existing deck (which is
presently removed) being 232 s.f and the proposed deck expansion being 50 s.f ..therefore the total proposed
deck expansion is 282 s.f. (under the 300 s.f. threshold for a small project filing).
The total soil disruption during construction is limited to new concrete footings for the deck construction. The
new footings will not disturb more than 20 s.f. (under the 50 s.f. threshold for a small project filing).
Additonally, there are no permanent soil alterations planned Linder the deck. In fact, as part of the Watershed
Special Permit crushed stone is proposed beneath the deck to promote groundwater recharge.

A written narrative description/scope of work of the proposed project and potential impacts to all wetland
resource areas has been included.
The applicant has identified and clearly marked all wetland resource area boundaries in the field.
Two (2) copies(and an electronic copy when possible) of a 1"=20'scale(or other as deemed appropriate
by the Conservation Commission or agent thereof)drawing showing existing and proposed conditions and
the delineated wetland resource areas (see plan requirements below for additional detail). 1

A pre-construction/pre-approval meeting was held on site between the applicant and a representative of
the Conservation Commission. Date of Meeting:
The delineated resource area boundaries have been confirmed by the Conservation Department as

Plan.Requirements(Section 4.4.3 B):
Certified and/or professionally prepared plans are not required. However, the North Andover Conservation
Commission or its designated agent shall have the final authority to determine whether the subn-dtted
plans/drawings are adequate and include all pertinent information for review.
At a minimum,all plans submitted shall clearly and accurately show the present conditions and proposed
work and depict the location of all wetland resource areas within 100'of the proposed work. All plans must
be signed and dated by the person who prepared them.
The Commission ryay also require the following information on the proposed plans in addition to the
aforementioned criteria where applicable:
Location of any subsurface sewage disposal systems.
Locations of any drainage structures.
Locations of any casements,including but not limited to,drainage and utility easements.
Locations of any open space boundaries if(e.g.if the lot is affected by the 50'open space boundary as
required in a Planned Residential Development(PIED)).
Location and nature of all proposed alterations to the Buffp-Zone Re urce Area.

40 COMPLETE APPLICATION-The application meets the submittal requirements. Therefore, the
Conservation Department has prepared a written list of conditions necessary to protect any adjacent
wetlands for approval by the Conservation Commission.
This condition list shall be filed with the North Andover Conservation Department as NACC#
INCOMPLETE APPLICATION-The following sections of the Wetland Protection Bylaw&/or
Regulations have not been complied with and as a result this Department is rejecting this incomplete
application w/in two(2)business days from the date of receipt (Section 178.4 North Andover Wetland
Protection Bylaw). You may pick up this application and supporting plans at the Conservation Office and
re-file with the required supporting documents and information.
El NOT A SMALL PROJECT-The North Andover Conservation Commission has determined that the
proposed project as submitted does not meet the small project criteria and hereby denies the application.
As such,a Request for Determination of Applicability(RDA)or,a Notice of Intent(NOI)must be filed.
