(ENPRO) is sending you this notification on behalf of our client, Merrimack Valley Oil, pursuant to the Massachusetts Contingency Plan (MCP) Section 310 CMR 40.1400 (Public Involvement). A Class A-2 Response Action Outcome (RAO) Statement has been submitted to the Massachusetts Department of Environmental Protection (MADEP) to address a release of approximately 110 gallons of waste oil and 55 gallons of tank sludge noted at the Site on May 17, 2006. The waste oil and tank sludge were released when several drums were overturned due to severe flooding. Merrimack Valley Oil contracted with ENPRO to perform an Immediate Response Action (IRA) to address the release of waste oil and tank sludge. In accordance with the MCI), a copy of the Release Notification Form submitted to the MADEP has been provided to you in this letter. The response actions associated with the IRA to address the release of waste oil and tank sludge included: the deployment, recovery and proper disposal of sorbent materials, collection and proper off-site disposal of oily water, hand excavation and proper disposal of oil-impacted soil, and collection and laboratory analysis of soil samples to confirm that current site conditions do not pose a risk to human health, safety, public welfare and the environment. Upon completion of the IRA, site conditions met the requirements of a Class A-2 RAO, indicating that a condition of no significant risk is present, contaminant concentrations have not been reduced to background conditions, and no further response actions are required pursuant to the MCI) with respect to the release of waste oil and tank sludge noted at the Site on May 17, 2006. A Class A-1 Response Action Outcome (RAC)) Statement has been submitted to the Massachusetts Department of Environmental Protection (MADEP) to address an oil sheen on surface water and a threat of release from underground storage tanks (USTs) at the above-referenced Site. The oil sheen and threat of release were identified at the Site on May 15, 2006, when flooding submerged the entire Site and the USTs under approximately 3 to 4 feet of water, Merrimack Valley Oil contracted with ENPRO to perform an Immediate Response Action (IRA) to address the oil sheen and threat of release. The response actions associated with the IRA to address the oil sheen and threat of release included the deployment of harbor boom, the deployment, recovery and proper disposal of petroleum absorbent materials, and the collection and proper off-site disposal of`water exhibiting an oil sheen. Upon completion of the IRA, site conditions net the requirements of a Class A-1 RAC), indicating that conditions had been restored to background, a condition of No Significant Risk is present at the Site and that no further response actions are required pursuant to the requirements of the MCP. The tim-eat of release was resolved by the receding floodwater; no release from the USTS occurred.
