HomeMy WebLinkAbout2019-10-07 Board of Selectmen Minutes BOARD OF SELECTMEN MINUTES October 7, 2019 CALL TO ORDER: Chairman Richard Vaillancourt called the meeting to order at 7:00PM in Meeting Room at Town Hall. ATTENDANCE: The following were present: Chairman Richard Vaillancourt, Clerk Rosemary Smedile, Licensing Chairman, Regina Kean, Chris Nobile, Phil DeCologero, Town Manager, Melissa Murphy- Rodrigues, Deputy Town Manager, Denise Casey and Executive Assistant, Laurie Burzlaff. EXECUTIVE SESSION Chairman Vaillancourt requested a motion to enter into a Joint Executive Session with the Middle School Athletic/Recreation Complex Committee. Phil DeCologero made a MOTION, seconded by Rosemary Smedile that the Board of Selectmen enter into a joint Executive Session with the Middle School Athletic/Recreation Complex Committee, pursuant to Massachusetts General Laws, Chapter 30A, Section 21(a)(2) to discuss strategy with respect to litigation (Recreation Complex) and to return to Open Session at the conclusion of Executive Session. Chairman Vaillancourt declared an open meeting may have a detrimental effect on the Board’s litigating position. Roll call vote: DeCologero-yes; Smedile-yes; Kean-yes; Nobile-yes, Vaillancourt-yes. Motion approved. The Board returned from Executive Session at 7:50PM. PLEDGE OF ALLEGIANCE PUBLIC COMMENT Ellen Mosier of 137 Kara Drive, asked the Board to post the meetings for the Trustees of Osgood Hill. th Rosemary Smedile announced the Women’s Club fashion show at the Stevens Estate is October 25. APPROVAL OF MINUTES Chris Nobile made a MOTION, seconded by Rosemary Smedile to approve the Open Session Minutes of September 16, 2019, as amended. Motion approved 5-0. GOVERNMENTAL REPORTS Electrical Aggregation Program Mark Cappadona presented information about the Electrical Aggregation Program. The Town’s new supply rate is locked at .10790 for 36 months. Mr. Cappadona indicated that there was some misinformation given out by National Grid telling customers they were being double billed if they were in the program which is not the case. He has spoken with National Grid and they will provide their employees with proper training and information to provide when handling residents’ calls. Opioid report This report will be given at the next meeting. Board of Health updated on vaping Brian LaGrasse, Health Director, updated the Board regarding the Governor’s ban on vaping and actions the Health Department is taking. If a business does not comply with the Governor’s order, they will be send a cease and desist letter and then fined $1000 if they continue not to comply. Update on Senior Center Town Manager, Melissa Rodrigues, updated the Board regarding the new Senior Center. It is expected the bid opening for the general contractor will be in February. The contract will be contingent upon Town Meeting appropriation in case the costs increase. There will also need to be a Town Meeting article for the parking lot. Because the site plan has already been approved, if it does not pass at Town Meeting, the process will have to start over. The next steps are to enter into a written agreement with the developer for the donated land and have a 21E test done. Board of Selectmen Minutes October 7, 2019 2 Update on Columbia Gas Town Manager, Melissa Rodrigues, provided a memo to the Board regarding the latest issues with Columbia Gas. The memo was also posted on the Town website. Board of Selectmen Schedule of Meetings January-June 2020 Included in the packet was the schedule for the Board’s meetings from January through June 2020. CONSENT ITEMS (taken out of order) Request of James Doucett of Cambridge Sports Union to use Milk, Johnson, Rea and Chestnut Streets for the 30th annual Cambridge Sports Union rollerski race on November 3, 2019 starting at 9:30AM Included in the packet was the annual request by Cambridge Sports Union to use streets in North Andover for their rollerski race on November 3, 2019. All relevant departments reviewed the request and had no issues. Regina Kean made a MOTION, seconded by Chris Nobile that the Board of Selectmen approve the request of James Doucett of Cambridge Sports Union to use Milk, Johnson, Rea and Chestnut Streets for the 30th annual Cambridge Sports Union rollerski race on November 3, 2019 starting at 9:30AM. Motion approved 5-0. Request of Chris Daniels to use the Common from 1:00PM to 11:30PM and Reynolds playground from 8:00AM to 12:00PM on Saturday, November 23, 2019 and Stevens Estate grounds on November 24, 2019 to film scenes for a senior film thesis project Chris Daniels presented the information regarding his request to film his senior thesis at the Town Common, Reynolds Playground and the grounds of the Stevens Estate on November 23rd and 24th. All relevant departments reviewed the request and had no issues. Phil DeCologero made a MOTION, seconded by Regina Kean that the Board of Selectmen approve the request of Chris Daniels to use the Common from 1:00PM to 11:30PM and Reynolds playground from 8:00AM to 12:00PM on Saturday, November 23, 2019 and Stevens Estate grounds on November 24, 2019 to film scenes for a senior film thesis project. Motion approved 5-0. Accept Green Community grant in the amount of $116,254.00 from the Department of Energy Resources The Town has once again received a Green Community Grant from the Department of Energy Resources. The grant will be used to upgrade to LED lighting at the Water Treatment Plant and the Middle School. Regina Kean made a MOTION, seconded by Phil DeCologero that the Board of Selectmen accept the Green Community grant in the amount of $116,254.00 from the Department of Energy Resources. Motion approved 5-0. Accept donation from the North Andover Women’s Club of solar lights for the driveway at the Stevens Estate Ms. Smedile, on behalf of the Women’s Club, withdrew this item. LICENSING COMMISSIONERS Regina Kean made a MOTION, seconded by Phil DeCologero to open a meeting of the North Andover Licensing Commission. Motion approved 5-0. Request from Tricia Dunphy for six one day wine and malt licenses for fall festivals at Smolak Farms from 10:00AM to 5:00PM on October 13, 14, 19, 20, 26 and 27, 2019 The Board reviewed the information contained in the application. All relevant departments reviewed and had no issues. Phil DeCologero made a MOTION, seconded by Chris Nobile that the Board of Selectmen, acting as Licensing Commissioners, approve the request of Tricia Dunphy of Smolak Farms for six one day wine and malt licenses for fall festivals at Smolak Farms from 10:00AM to 5:00PM on October 13, 14, 19, 20, 26 and 27, 2019, as presented. Motion approved 5-0. Board of Selectmen Minutes October 7, 2019 3 Request from Katharine Bibeau for twenty-three one day all alcohol licenses for Winterlights at Stevens Coolidge Place from 5:00PM to 8:00PM on November 21-24, November 29-December 1, December 5-8, December 12-15 and December 19-22, December 26-29, 2019 Katherine McDonald presented the information on behalf of the Stevens Coolidge Place. Chairman Kean invited the public to make comments on the application. Kelly Cormier of 169 Andover Street was concerned about the number events during the holiday season and that they are basically creating an outdoor bar at the Stevens Coolidge Place. Mr. Vaillancourt noted that the events did not have alcohol last year and they were still successful. Ms. McDonald stated they would limit the request to just Friday and Saturday if that’s what the Board would like. Mr. DeCologero indicated that there needs to be a balance between the neighbors and the business. Chris Nobile made a MOTION, seconded by Phil DeCologero to continue the matter until the next meeting. Motion approved 5-0. Rosemary Smedile made a MOTION, seconded by Phil DeCologero to close the meeting of the North Andover Licensing Commission. Motion approved 5-0. OLD BUSINESS Advisory Committee for Recreation Complex Included in the packet was a draft prepared by Town Manager Rodrigues of the mission, membership and duties of the Advisory Committee for the Recreation Complex along with information regarding the abutters. Mr. DeCologero indicated that the Senior Center representative and the Athletic Director were not included as discussed at the last meeting. Ms. Rodrigues stated that the findings of fact by the Planning Board specifically outlined the number of members but the Board could expand that. Ms. Rodrigues also suggested the Board choose abutters that are within 300-600 feet. Chris Nobile made a MOTION, seconded by Regina Kean that the Board of Selectmen, approve the mission, membership and duties of the Advisory Committee for the Recreation Complex as amended. Motion approved 5-0. NEW BUSINESS Discuss potential for liaison assignments Town Manager Rodrigues suggested the Board assign liaisons to certain Boards and Committees. This is a good way to keep lines of communication open with other committees. The liaison would report back to the full Board during Selectmen Updates. TOWN MANAGERS REPORT The Board was provided with the job posting/vacancy log. st Town Manager Rodrigues reminded everyone that the flu clinics were starting on October 21. She also announced the Jennie Wright received the 2019 Clerk of the Year award from the Massachusetts Association of Assessors and Veterans Director, Joe LeBlanc received the Reverend Gomes Public Service Award. SELECTMEN’S UPDATES/COMMENTS Regina Kean reminded everyone that the ad for the Stevens Estate Advisory Board Committee was posted and encouraged people to apply.
