Conservation Conditions of Approval,NACC #242
Pursuant to section 4,4,2 (C) of the North.Andover Wetlands Protection Regulations,Jack DeCoste, i
applicant/homeowner,filed for a small project for work proposed at 537 Boxford St,North.
Andover, The p,roVosed work includes relocating an existing shed outside of the 50'No-Build zone
of Bordering Vegetated Wetlands (BYM, and relocating a play structure outside of the 25'No-
Disturbance zone as re uired by the 8 27 19 Conservation De artment's Violation Enforcement
Letter. The approximate wetland line (and associated buffer zones) was determined by the
Conservation Department during a site visit on September 11, 2019.
During the October 9,2019 public meeting, the North Andover Conservation Commission voted
unanimously to approve this project as Small Project Category"C". The project is approved only as
it relates to the Conservation Commission and any and all other approvals should be obtained by the
applicant/homeowner. All work shall conform to the following:

The following conditions are hereby mandated: j
CONDITIONS:
1. Prior to the start of construction the applicant shall ensure that the site contractor has reviewed
the small project permit and is aware of the wetland resource area and the limits of the proposed
work.

2. Prior to the start of construction,the site contractor/applicant shall install entrenched silt fence
between the existing shed location and the wetland.
3. After the shed is relocated,the site contractor/applicant shall reseed the original shed location
with a native seed mix (New England Wetmix available at New England Wetland Plans,Inc. or
equivalent), and cover the area with straw (not hay) to incubate the seed and prevent erosion.
4. Invoice for said seed mix shall be provided to,the Conservation Department,
5. Upon completion of the approved project and site stabilization,please contact the Conservation
Department for a final inspection,
6. This permit Shall expire one year ftorn the date of issuatice.

❑ A. Open slotted decks,without roofs,equal to or less than 300 square feet surface area,inclusive
of stairs and ramps,which are to be attached to an existing home,where soil disruption during
construction is limited to less than 50 square feet,and where no perrnnanent soil alterations are
planned under the footprint of the deck.
El B. In kind replacement of existing decks,regardless of size.
K(C.Sheds or other outbuildings of less than 100 square feet,which are to be placed on footings,.
not permanent foundations.
D. Sewer system cormections as required by the Town of North Andover.
El P.Unpaved pedestrian walkways (less than four(4)feet wide) for private use or for public
access on conservation property.
El F.Patios less than 300 square feet,not requiring excavation or grading.
❑ G. Pruning of existing vegetation,planting of new native vegetation and gardening.
❑ H. Fences and stone walls which do not alter the flow of surface waters nor alter wildlife habitat
or movement(does not include retaining walls).
❑ I.Conversion of non-permeable surfaces to permeable vegetated surfaces.
❑ J. In-kind replacement of existing basement bulkheads.
❑ IC.Installation of a ramp for compliance with accessibility requirements.

Commission.
The local Wetland Bylaw filing fee of$25 has been included with this application.
Er A written narrative description/scope of work of the proposed project and potential impacts to all wetland
resource areas has been included.

Two (2) copies(and an electronic copy when possible) of a 7" =20'scale (or other as deemed appropriate
by the Conservation Commission or agent thereof) drawing showing existing and proposed conditions and
the delineated wetland resource areas(see plan requirements below for additional detail).

Plait Requirements (Sectioy 4.4.3 B):
Certified and/or professionally prepared plans are not required. However,the North Andover Conservation
Commission or its designated agent shall have the final authority to determine whether the submitted
plans/drawings are adequate and include all pertinent information for review.
At a minimum,all plans submitted shall clearly and accurately show the present conditions and proposed
work and depict the location of all wetland resource areas within lOO' of the proposed work. All plans musk
be signed and dated by the person who prepared them,
The Commission may also require the following information on the proposed plans in addition to the
aforementioned criteria where applicable:
F1 Location of any subsurface sewage disposal systems.
❑ Locations of any drainage structures.
❑ Locations of any easements,including but not limited to,drainage and utility easements.
❑ Locations of any open space boundaries if(e.g.if the lot is affected by the 50' open space boundary as
required in a Planned Residential Development(PRD)).
El Location and nature of all proposed alterations to the Buffer Zone Resource Area.

COMPLETE APPLICATION-The application meets the submittal requirements. Therefore,the
Conservation Department has prepared a written list of conditions necessary to protect any adjacent
wetlands for approval by the Conservation Commission.
This condition list shall be filed with the North Andover Conservation Department as NACC#
El INCOMPLETE APPLICATION-The following sections of the Wetland Protection Bylaw &/or
Regulations have not been complied with and as a result this Department is rejecting this incomplete
application w/in two(2)business days from the date of receipt (Section 178.4 North Andover Wetland
Protection Bylaw). You may pick tip this application and supporting plans at the Conservation Office and
re-file with the required supporting documents and information.
❑ NOT SMALL PROJECT-The North Andover Conservation Commission has determined that the
proposed project as submitted does not meet the small project criteria and hereby denies the application.
As such,a Request for Determination of Applicability (RDA)or a Notice of Intent(NOI) must be filed.

VVe are requesting a small project permmitforashed |naurbackvard. VVe mistakenly put up the shed in
the wetland no build zone and are requesting to re-locate it to a position recommended by the
Conservation Commission. Please see attached pictures. Picture I is where it is located now. Picture 2
