Conservation Commission Meeting Minutes
July 22, 2009
Member Present: John J. Mabon, Chairman, Louis A. Napoli, Vice Chairman, Joseph W.

Meeting came to Order at: 7:07 PM. Quorum Present.
Approve Minutes of 2/25/09 (Boston Hill)
A motion to approve the minutes of 2/25/09 was made by Mr. Manzi, seconded by Ms. Feltovic.
4 to 1 Vote.
General Business
242-1349, Extension Request, 245 Bridle Path (Grasso)(New England Engineering Services,
Inc.)
The applicant John Grasso was present. A motion to issue the 1-year extension was made by Mr.
Lynch, seconded by Ms. Feltovic. Unanimous.
242-1374, COC Request, 60 Willow Street (The Dow Chemical Company)(BSC Group,
Inc.)
The applicant Phil Miller of The Dow Chemical Company and David P. Biancavilla, P.E. of
BSC Group, Inc. was present. Ms. Hughes discussed the file for just cleaning up older Order of
Conditions on the site no work ever done thru this DEP number. There was an Enforcement
Order for cleaning up the stormwater structures on the site the drainage system was not working
at all the drainage systems seems to be working better than before. There also were some
unstable areas on the site but the site is very level so the soil is ok and would be seeded. A
motion to issue the COC was made by Mr. Manzi, seconded by Mr. Lynch. Unanimous.
242-1442, COC Request, 350 Winthrop Avenue (Exxon/Mobil Environmental
Services)(GES Services, Inc.)
No one was present. A motion to issue the COC and release the bond hold till submit stormwater
management plan was made by Mr. Manzi, seconded by Mr. Lynch. Unanimous.
242-1399, Modification Request, 245 Berry Street (Lot 2)(Stack)(Christiansen & Sergi,
Inc.)(Request to cont. to 8/12/09)
No one was present. A motion to continue to August 12, 2009 meeting was made by Ms.
Feltovic, Mr. Manzi. Unanimous.

Small Project
NACC#52, 66 Colonial Drive (Segal)
No one was present. Ms. Hughes discussed the applicant had constructed a play area no roof
which is outside the 50-No-Build zone. A motion to accept as small project with added 4.4.2 J
with 4.4.2.A to cover that play area they have built was made by Mr. Manzi, seconded by Ms.
Feltovic. Unanimous.
NACC#56, 534 Boston Street (Gutman)
The applicant Daniel Gutman was present. Ms. Hughes discussed this small project is for
landscaping, walkways, a patio all the work is outside of the 50-foot No-Build zone. A motion to
accept as 4.4.2J and 4.4.5 with restrictions on the plantings and install 3 to 4 wetland markers,
and white pine tree can come down was made by Mr. Manzi, seconded by Mr. Lynch.
Unanimous. A motion to accept this as a small project was made by Mr. Manzi, seconded by Ms.
Feltovic. Unanimous.
NACC#57, 45 Woodberry Lane (Faulkner)
The applicant Eric Faulkner was present. Ms. Hughes discussed this is for construction of
discussed there in outlet pipe on the property which goes under the driveway thru stonewall into
the wetlands by Thistle Road. The applicant is also before the Planning Board for a waiver to
watershed special permit. A motion to accept as 4.4.2A, 4.4.2F, 4.4.2J and 4.4.5 was made by
Mr. Manzi, seconded by Mr. Lynch. Unanimous. A motion to accept this as a small project was
made by Mr. Manzi, seconded by Mr. Lynch. Unanimous.

Request for Determination of Applicability
240 Charles Street (Greater Lawrence Sanitary District)
The Richard E. Weare of Wastewater Engineer of the Greater Lawrence Sanitary District was
present. Ms. Hughes discussed the filing is for installation wires attach central communication
station when the digital TV changed the old wires due not work so this project is for installing
new wires for communication center. The wire there is very little ground disturbance. Mr. Weare
discussed this filing for an easement we have Riverview Street, which goes under the railroad
tracks this pipe, is 36 years old, then 18-inch deep manholes 36 x18x 36 manholes drainage pipes
are tested also cutting some invasive plants that are growing within the fence these also would
have to be taken care of because of build up plantings has to be 20 years since the areas have
been cleaned out of invasive plants. The work would take only 3 to 4 days for the wiring
installation. A motion to issue a negative determination within pre-construction and post-
construction meeting was made by Ms. Feltovic, seconded by Mr. Manzi. Unanimous.

of Public Works)(Weston & Sampson Engineers, Inc.)(cont. from 7/8/09)
Tara E. McManus, P. E. of Weston & Sampson Engineers, Inc. was present. Mr. Napoli left the
room abutter to project. Ms. McManus discussed the fire hydrants are within 200-feet buffer
zone to the Shawsheen River. The hydrant installation should only take only 5 days trenching
dead end streets water main to be tied in to the hydrants. The Brook street filing we would
probably due test pits with all the Beaver Activity in this area see when the area is dry time of the
year there is culvert crossing this would a 8-inch water pipe. The Natural Heritage results no
adversely effect to Blanding Turtles and no comments form DEP also. Mr. Lynch discussed
watch the dewatering activities needs to monitored 24-7 very important monitor the dewatering
truck there would to be ex-steamily careful in this area. A motion to close and issue a decision
within 21 days was made by Mr. Manzi, seconded by Ms. Feltovic. Unanimous. Mr. Napoli
returned to the meeting.

Thomas Keeffe of Tutela Engineering Associates, Inc. was present. Mr. Keeffe discussed the
manholes would be razed 4-feet because they do not want water within the sewer mains because
could cause major backup of sewer plus the Town of North Andover received grant money to do
this project for 15 to 18 years since anything was done in this area. Ms. Hughes discussed
portions of the easement 50-feet wide on Wood Road the easement is only 12-feet wide there is
beaver deceiver installed in this area. Mr. Keeffe discussed the contractor would use swamp mats
to protection of the ground there are 3 manholes within the wetlands by Flag 2A this is the wetter
section on the whole project areas. Mr. Lynch discussed on Bridle Path you need to use caution
tape. Ms. Hughes discussed the Conservation Commission wanted escrow account to wetland
flag review. Ms. Hughes discussed that Mr. Keeffe and myself went out on the site to flag the
bridle path area and this myself moved some flags closer but everything came out fine. Ms.
Hughes discussed the contractor would have to use salt marsh hay in these areas to prevent these
areas getting invasive plants from regular hay bales. A motion to close and issue a decision
within 21 days was made by Mr. Manzi, seconded by Ms. Feltovic. Unanimous.

No one was present. A motion to continue to August 12, 2009 meeting was made by Ms.
Feltovic, seconded by Mr. Lynch. Unanimous.
242-1458, Waverly Road (North Andover Division of Public Works)(Woodard & Curran)
Justin DeMello of Woodard & Curran and David T. Daltorio of Woodard & Curran Abutters
Suzette C. Broderick of 669 Waverly Road and Lisa Neukuckatz of 667 Waverly Road were
present. Ms. Feltovic read the legal notice. Ms. Hughes discussed the project is for upgrade of
the sewer lines from Greene Street to Turnpike Street Route 114 and improvement of side walks,
and some drainage improvement by cleaning out the catch basins they may be clogged. Mr.
Lynch discussed the catch basins are corrugated pipe do not jet clean you could blow a hole the
sheet metal pipes. Mr. Daltorio discussed there would be installation 30-inch 4,700-feet of new

sewer pipe installed along the roadway between Greene Street to Route 114 there are gas line in
the middle of the road so the new sewer line would have to installed under the gas lines also
installation of some sidewalk and cleaning drainage systems. Mr. Mabon discussed the stream
stats on Cotuit Brook, sidewalk detail, upgrade and clean catch basins, stormwater management
plan, North Andover Division of Public Works would having Public meeting for abutter
concerns on July 29, 2009 at the Senior Center at 6:30 PM. A motion to continue to August 12,
2009 meeting for revisions was made by Ms. Feltovic, seconded by Mr. Lynch. Unanimous.

The applicant Phil Miller of The Dow Chemical Company and David P. Biancavilla, P. E of the
BSC Group, Inc. was present. Ms. Feltovic read the legal notice. Mr. Biancavilla discussed the
back of the property there would be parallel parking and 6-foot fence would be replaced and here
the applicant would use a wetland seed mix and calculation 985 s. f. Impervious area planting
trees Speckled Alder Berries. Mr. Lynch discussed the pavement should be moved up 5-feet pad
when work starts there should be a dewatering truck on site. Mr. Napoli discussed the tanks
being installed would only be 38-feet from the parallel parking. A motion to continue to August
12, 2009 meeting was made Ms. Feltovic, seconded by Mr. Lynch. Unanimous.
