NOTICE OF DECISION - SITE PLAN REVIEW WAIVER
Date of Decision: May 17, 2016
Application of: Michael Helman, Ruff`n Tumble Playcare
Premises Affected: 1636 Osgood Street,Building 48
North Andover,MA 01845
On May 3, 2016 the Applicant filed a request for a Waiver of Site Plan Review requirement with
respect to the applicant's proposed Kennel/Dog Daycare to be located at 1636 Osgood Street.
The proposed Kennel/Dog Daycare represents a change of use and as a result, Site Plan Review
is triggered under Section 8.3.2. a). iii. In order to re-use the former office space, the proposal
includes the renovation of the main building, approximately 10,000 sq. ft., into an indoor dog
area with fitted spaces for specified dog sizes and maturity. Indoor activities will include, agility
training, obedience training and puppy training. The Applicant also proposed to create a fenced
outdoor dog area with fitted spaces for specified dog sizes and maturity for area of dog waste
management. This space will utilize the 15,000 sq. ft. of the grass area to the left of the building.
HISTORY AND BACKGROUND
® The Applicant is in discussion with Osgood Properties to lease 1636 Osgood Street.
The property consists of approximately 10,000 sq. ft. interior and 15,000 sq. ft.
exterior space, and is located at Osgood Landing in Building 48.
FINDINGS OF FACT
® The property is within the I2 Zoning District and the Zoning Enforcement Office,
Gerald Brown, has deemed the use to be allowed by right.
® The Table of Off-Street Parking Regulations requires 3 parking spaces per the use
granted.
® The Applicant has provided seven(7) additional parking spaces for a total of ten (10)
spaces with one (1) designated handicap space. The Handicap Parking space will be
stripped in accordance with ADA Regulations.
® The Fire Department has provided review and approved fire truck access to the site.

• The Board finds that the new use will not have a significant impact within the site and
in relation to adjacent properties and streets; on pedestrian and vehicular traffic;
public services and infrastructure.
DECISION
After discussion at the May 17, 2016 Planning Board meeting, and upon a motion by David
Kellogg, seconded by Peter Boynton, the Planning Board Approves the Site Plan Review-
Waiver. A vote of 5-0 was made in Favor of the waiver request.
CONDITIONS
Prior to a Certificate of Occupancy
• Adequate lighting during evening hours shall be provided. The Town Planner will
conduct a site visit to confirm the lighting is suitable for the environment.
• The parking spaces will be clearly delineated and meet the zoning dimensional
requirements.
• Directional signage will be placed to guide traffic to and from the site.
• Appropriate animal waste removal procedures will be established and reviewed by
the Health Department.
• The outdoor dog area will be fenced in and will be constructed of material that will
conceal the area from the road and neighboring abutters. The erected fence will avoid
encroachment upon the existing stormwater drainage structure located with the grass
area.
• The existing chain link fence separating the area from the parking and outdoor dog
area will be repaired and the existing barbed wire will be repaired or removed.
