11 MOTION: A. Preston motioned to go into Executive Session for consultation with Town Counsel to discuss
12 confidential litigation strategy regarding Varsity Wireless v.North Andover. The Chair declared an open meeting �
13 would be detrimental to the Town's litigation strategy. Open Session will reconvene at the conclusion of the
14 Executive Session. P. Boynton seconded the motion.

32 which took longer than we thought. We completed site improvements yet haven't broken ground yet and won't
33 until spring,thus the extension request.
34 MOTION: J. Simons made a motion to grant the request for a one year permit extension of Site Plan Review
35 Special Permit, Planned.Development District Special Permit and Parking Special Permit. P. Boynton seconded.

45 247 Chickering Road Enterprise Bank: Request for an Insubstantial Change to allow for demolition and
N 46 possible foundation installation prior to otice of Decision Condition 437 being satisfied.
47 Luke Bouchard Enterprriisc Batik: The process with MADOT is taking awhile and would like to proceed with
48 removing the existing building and place foundations prior to winter. The decision states we cannot proceed with
49 building or demolition permits until we have received all approvals from the state. We are optimistic that we will
50 receive the approvals requested. We prefer not to delay the process.
51 David Jordan Greenman Pedcl•sen Inc.-PE: 'file traffic consultant is preparing the final permit applications for the
52 driveway and utility connections. Our meetings with DOT have been positive and we are addressing their
53 concerns;the DOT process usually runs 90 days.

60 J.Enright: Presented draft bylaw. The Board expressed concern the public has raised regarding the increased
61 developments of multi-family buildings. Both Accessory Dwelling Units and.Inclusionary Zoning are specified as
62 goals in the Master Plan and Housing Production Plan; however,the Board requested more information and
63 examples of bylaws in other Towns similar to North Andover.

147 tonight.Town appropriated tip to 7 million dollars for the sewer line running from 1600 Osgood Street to the
148 intersection at Sutton Street. Town has applied for a MassWorks grant application to fund a portion of tile sewer
149 and roadway improvements.That program will announce improvements in next few weeks. The public sewer
150 option is our primary option. As back up, anticipating our opening date of Q3 2022 we will use the existing sewer
151 that extends currently to the GLSD.
152 N. Kirschner, Langali_Enngitneerirng: Conceptually described the utilities at 1600 Osgood site as part of the
1.53 redevelopment program noting that existing sewer will be utilized if the MassWorks project is not completed. The
1.54 connections will have limited crossings and no codependence. Plans to maintain connection to GL.,SD and remove
155 pump station. There are no impediments to the utilities.
156 JJSmolak: We are utilizing separate peer review consultants for Plumbing,Fire and Building code issues.

1.73 regard to pleasing and relocating 80% of the solar panels(20% retained by Ozzie Properties), is to minimize down
174 time and environmental impact. A 7 ft. chain link fence and max. ten ft. tall plantings will secure and screen
175 ground mounted solar panels on Lot C; Phase 1 to occur summer of 2020. We would like to use as much asphalt as
176 possible for placement to avoid green land. Layout driven by wetlands and safety access requirements. Showed
177 images of and described post driven rack system which will be approx.ten ft. tall on driven piles with vegetation
178 underneath. Solar field is approx. 4 ft. below entrance elevation. Temporary power lines(connected to the existing
179 substation)to the rear of the property will be utilized to provide power to Lot C: for approx. 9-12 months. These
180 will require a waiver for the interim period. We will work with National Grid to decommission a 50 rx7egawatt
181 substation which eventually becomes a retainage drainage basin for the property in Lot C. Showed images of
182 panels and rack system. Vegetation underneath solar panel array field will be maintained and mowed. Five
183 subpanels will be located to the rear of site oil asphalt. Showed images of interim overhead temporary power lilies
184 needed to carry power to temporary substation, (9-12 month duration)to rear of property. This will result in a
185 waiver request.
186 J. Smolak: We will require additional tune to meet.with MA DOT. We will review stormwater design at the next
187 meeting October 15, 201.9 and will be filing for the Definitive Subdivision approval. Peer review is going
188 smoothly thus far; we have had two hearings with Conservation.
