Pledge of Allegiance Acceptance of Minutes  The Minutes for September 25, 2019 are not ready for approval.  A motion to accept the minutes of the September 11, 2019 as reviewed and amended is made by Mr. Manzi, seconded by Mrs. Feltovic.  Vote 6-0, Unanimous. Certificate of Compliance (COC) 242-1428, Turnpike Street, Lot 4N-A (One Hundred Fourteen Trust)  The applicant requested a continuance via email.  A motion to continue until October 23, 2019 is made by Mrs. Feltovic, seconded by Mr. McDonough.  Vote 6-0, Unanimous. The homeowners are away on vacation and unable to attend the meeting. She presents the construction access proposal to the Commission. The compost and yard waste will be removed from the 25-foot NDZ. They propose to burn the compost/yard waste or put it in the pool that is to be filled. 10 09 19 NACC Meeting Minutes Page 2 of 10  Mr. Lynch stresses the compost and yard waste is not allowed to be used as fill material for the pool.  The Administrator explains the pool removal process.  Mr. Manzi expresses concerns with burying the concrete from the pool.  The Commission discusses the proposal.  Mr. Napoli expresses concerns with the pool being close to the property line.  A motion to continue to October 23, 2019 is made by Mr. Manzi, seconded by Mr. Lynch.  Vote 6-0, Unanimous. An After-The-Fact Small Project application was filed for the relocation of the shed and small wooden play structure. The new shed location is outside the 50-foot NBZ. The Administrator presents the new location for the shed to the Commission. The wooden play structure will be moved outside the 25-foot NDZ.  John DeCoste III, the homeowner is present for questions.  A motion to accept this as a Small Project C is made by Mr. Manzi, seconded by Mrs. Feltovic.  Vote 6-0, Unanimous.  A motion to approve the Small Project for the shed as proposed (pre and post construction inspection) is made by Mr. Manzi, seconded by Mrs. Feltovic.  Vote 6-0, Unanimous.  The Commission gives guidance to the applicant regarding placement of a fence. The NACC stresses that a fence is not allowed to be placed inside the 25-foot NDZ. They direct the applicant to file an RDA for permitting of the fence. They recommend having the wetlands delineated by a wetland scientist. This will ensure the location of the 25-foot NDZ and 50-foot NBZ prior to filing an RDA.  Mr. DeCoste would like to know if there are any guidelines as to what type of fence he can install.  Mr. McDonough explains there needs to be some freeboard at the bottom of the fence that will allow for wildlife movement and flow of surface water.  Mr. Lynch explains to the applicant that a wetland delineation is good for 3-years. A majority of the trees are dead or dying. They propose to replant 3 trees and extend the existing stonewall along the Sutton Hill Road side of the property. The work to take place is within the 100-foot Buffer Zone to BVW. One tree is within the 25-foot NDZ. The Administrator states the base of the tree is rotted and the tree is spindly. The tree is located in the lawn area.  Mr. Lynch states the tree will be allowed to be removed and the stump can be ground down flush.  Mr. Foulds states they are proposing to cut the tree flush to the ground, the stump will remain.  A motion to accept this as a Small Project G & H is made by Mr. Manzi, seconded by Mr. Lynch.  Vote 6-0, Unanimous.  A motion to approve the Small Project for the deck as proposed (post construction inspection) is made by Mr. Manzi, seconded by Mrs. Feltovic.  Vote 6-0, Unanimous. Documents  Full NOI Application with Supporting Materials, date September 18, 2019, prepared by Merrill Engineers & Land Surveyors Notice of Intent NACC #240, 505 Sutton Street (Sutton Street Redevelopment, LLC)  The Administrator states the Planning Board closed on the project and final revised plans were received. A site visit with the wetland consultant, project consultant and abutters was conducted.  Scott Cameron, The Morin Cameron Group presents the pre and post watershed for the project using visual aids. Stormwater was reviewed and concerns addressed during the Third Party Review. A note was added to the final plan stating “existing berm to remain”. The overflow structure for areas ES3 & ES4 were designed for the water to flow towards Sutton Street towards the Merrimack River Watershed. Areas ES1 & ES2 were designed to flow towards Lake Cochichewick Watershed. The design reduces the peak rate of runoff and in most cases, it will reduce the volume. A direct connection will be made to the drain system going to Lake Cochichewick. The drain system was inspected and no evidence of erosion or issues was found.  Mr. Lynch would like to know what mitigation is proposed during an overflow or high demand rain event to the Lake Cochichewick Watershed.  Mr. Cameron states they are controlling on-site up to the 100-year storm event. One hundred percent of the runoff will be held on-site allowing a chance to get into the ground.  Mr. Lynch confirms that soil borings have been done in the area proposed for recharge.  Mr. Cameron states extensive testing was performed in these areas. The finish grade of the project was driven by the sewer not the drainage so that it will be a gravity sewer. Mr. Napoli confirms the abutters will not receive more water due to the project. He expresses concern that they are proposing a 10-foot fill on the restaurant side of the property. 10 09 19 NACC Meeting Minutes Page 4 of 10  Mr. Cameron states the slope will be secure and stabilized. The burden will be taken off the stormwater currently eroding the slope.  Mr. Napoli confirms the water running through the properties will no longer happen.  Mr. Cameron states they will be removing most of the burden. The only water that will flow onto the abutting properties are drops of water that fall between the building and the lot line.  Mr. Napoli would like to know if the development Senior Center would affect the stormwater aspect of the project. No elevations were shown on the plan.  Mr. Cameron states they worked closely with the Senior Center design engineer through the process. The projects are separate and they have addressed their stormwater concerns. There is a distinct boundary between the drainage systems. The Senior Center project is not within the NACC jurisdiction.  Mr. McDonough would like to know if there is an existing subsurface system.  Mr. Cameron states the site does not have an existing subsurface system.  Mr. Lynch requests to see a written narrative describing how they intend to handle stormwater management during construction.  Mr. Cameron states this falls under the EPA, National Pollutant Discharge Elimination System. The Stormwater Pollution Prevention Plan will be in place with the standard conditions set forth by North Andover. They will provide the final SWPP they register with the EPA during the construction document period. They propose to keep all paved surfaces they can during the construction phase.  No public comment.  A motion to close and issue in 21 days is made by Mr. McDonough, seconded by Mr. Manzi.  Vote 6-0, Unanimous. Documents  Proposed Subsurface Sewage Disposal System, dated September 9, 2019  Site Photographs, dated September 25, 2019 10 09 19 NACC Meeting Minutes Page 5 of 10 242-1770, 456 Summer Street (Carlstrom)  The Administrator states the filing was triggered by an Enforcement Order for unauthorized tree removal.  Maureen Herald, Norse Environmental presents the proposal for the construction of a garage, associated grading, driveway extension and resurfacing of a portion of the driveway. An in-ground pool that is outside the Buffer Zone is shown on the plan. The pool is not proposed at this time. An additional fee requested by the Administrator has been paid. A revised plan was submitted today addressing the construction access and erosion controls for the pool. The trees stumps from the EO are outside the 25- foot NDZ and will need to be pulled. The area will be graded, loamed and seeded to stabilize the area. The garage is proposed 51-feet from the edge of BVW. The garage will be staked by a professional land surveyor.  Mr. Lynch would like to know if any trees were removed from inside the 25-foot NDZ.  Ms. Herald states no trees were removed from the 25-foot NDZ.  The Administrator states she has reviewed the wetland line and feels that it is reasonable.  Mr. Napoli would like to know where the construction access would be for the pool.  Ms. Herald states the construction access for the pool is proposed on the southerly side side of the dwelling. The homeowner is aware if they use Summer Street as an access point they are required to come back to the Commission and environmental monitoring will be required.  Mr. Napoli expresses concern with the location of the garage to the proximity to the 50-foot NBZ.  The Administrator states the foundation will be surveyed prior to being poured and a Foundation As-Built will be required.  Mr. McDonough would like to know what the existing condition is in the area of the wetland.  The Administrator states there is some scrubby ground cover.  Mr. McDonough proposes a permanent stonewall barrier at the 25-foot NDZ with wetland markers. The NACC typically requires a barrier when there is new development near a wetland.  Ms. Herald states she does not object to a permanent barrier. She requests the Commission consider another alternative. The boundary line to the wetland is approximately 100-feet.  The Commission discusses the requirements of the physical barrier wall to mark the 25-foot NDZ and whether it should be required or not. The Bylaw requires a permanent physical barrier. Typically, a loose dry laid stone 2x2-foot farmer’s wall would be required by the NACC. No tree line is depicted on the plan at the 25-foot NDZ.  Ms. Herald would like to know if the Commission would consider a post and rail fence. The entire 25- foot NDZ is wooded/vegetated, the area has not been cut.  The Commission objects to the idea of a post and rail fence. A 2’x2’ loose famer’s wall is required and should be placed no closer than the 25-foot NDZ. The physical barrier is required to be shown on the plan.  The Commission discusses the construction entrance for the pool, which will be installed in the future.  Mr. Lynch would like to know if the home is on septic  Ms. Herald states the home is on septic which is in front of the house between the driveway and Summer Street.  The Administrator recommends using the south and west side of the house for the pool construction access. She would like to know how they will manage the new roof surface for the garage, as gutters will not be allowed.  Ms. Herald states they can place an infiltration trench around the garage.  Mr. Lynch would like to know how they proposed to marry the new pavement of the driveway together. He would like to know if they propose an overlay of pavement or if they intend to rip the pavement up.  The Administrator states the entire driveway is proposed to be repaved and a new lip added to meet the newly constructed garage.  Ms. Herald states she believes they will need to rip out the existing pavement and repave.  The Commission discusses the grading associated with the garage.  Mr. Lynch states the topo grades indicate the roof runoff from the garage drains to the wetland. Terenzoni, P.L.S. 242-1769 Dogwood Circle Condominium (Property Management of Andover)  The Administrator states she walked the wetland line and found it to be reasonable. Initial comments have been satisfactorily answered.  Richard Williams, Williams & Sparages, LLC present the proposal for the construction of a new block retaining wall landward of the existing boulder wall, which is failing. They are not proposing to increase to size of the lawn area. The area is currently eroding making the space unusable. The current fence will be reused in the same general location once the repairs have been completed. He describes the materials to be used to create the wall and the reason behind this choice of material. Geogrid will not be required in the construction of the wall. Access for the project will be between the two buildings using small equipment. The project is expected to take approximately three weeks to complete. He describes the construction process. Sedimentation controls have been proposed at the base of the wall.  Mr. Lynch would like to know if the wall daylights anywhere.  Mr. Williams states there is daylight at the end of the wall. There will be two weeps on each wall, six weeps in total. He does not expect much flow from the weeps since the watershed is so small. The average height of the wall is 2 ½-feet. The wall will not be near the bottom foundation elevation of the buildings.  Mr. Napoli would like to know if there is a break in the wall.  Mr. Williams states there are several breaks in the wall and explains the reason for this.  The Administrator confirms the width and depth of the trench for the construction of the wall.  Mr. Williams states the trench will be approximately 3 ½-feet wide. The depth of the trench will vary depending on the height of the wall. The base of the wall will consist of crushed stone.  Eddy Tabit, 1804 Dogwood Circle expresses concerns with the material they are using to construct the base of the wall.  Mr. Williams states the manufacturer has provided two separate options (crushed stone or poured concrete) for a base material. They chose to use crushed stone as a base since it is easier to bring in vs. pouring concrete.  Maureen Sloya, 2003 Dogwood Circle would like to know if the wall will extend beyond building 20.  Mr. Williams states repairs extend to that corner of the wall because an issue was identified at that section.  A motion to close and issue in 21 days is made by Mr. Manzi, seconded by Mrs. Feltovic.  Vote 6-0, Unanimous. Documents  Violation Letter, dated August 27, 2019  Site Photographs, dated September 11, 2019 44 Autran Avenue (Smith)  The Administrator states an EO was issued for the construction of a deck without Conservation approval or a final building permit. The location of the deck requires permitting with the Conservation Commission.  Lauren & Jason Smith the homeowners are present. Mrs. Smith states they hired a contractor through a local home improvement store. The signed contract states the contractor is responsible for obtaining the proper permits. They were unaware the proper permits were not obtained for the construction of the deck.  Mr. Lynch states he understands the predicament the homeowners are in. The deck will need to comply with the NACC rules and regulations.  Mrs. Smith states the project was for the construction of a new smaller rear deck to replace an existing deck in the same location.  Mr. McDonough would like to know if new sonotubes were installed and if the location of the stairs changed.  Mrs. Smith states the contractor used diamond piers and the stairs were moved slightly.  The Commission discusses the violation and requires the homeowner to file an after-the-fact RDA for the placement of the deck. Based on the circumstances the after-the-fact fees will be waived.  Mr. Manzi expresses concern that the building code was violated.  The Administrator states the Inspector of Buildings is aware of the violation and was cc’d on the Violation Letter.  Mr. Manzi instructs the Administrator to follow up with the Inspector of Buildings and inform him of the action taken by the NACC and to ask him to enforce the builder.  Mr. Lynch requests copies of the signed contract and photos of the previous deck for the record.  The Commission directs the homeowners to follow up with the Inspector of Buildings as well as the home improvement store.  The Administrator offers her assistance in helping the homeowners fill out an RDA application.  A motion to modify the Enforcement Order as proposed is made by Mr. McDonough, seconded by Mr. Lynch.  Vote 6-0, Unanimous. Documents  Violation Letter, dated September 24, 2019 242-1692, 1210 Osgood Street  Mr. Napoli recuses from the discussion due to a conflict of interest, Mr. Manzi steps in as Chair. 10 09 19 NACC Meeting Minutes Page 8 of 10  William Seuch, Goulston & Storrs introduces the team that will be presenting on behalf of the applicant. He states that pavement has been installed across approximately 65% of the project areas. All the rain stores have been completed. Most of the currently paved areas are introducing water into the rain store system. The underground drainage system is approximately 90% complete. The interceptor trench is complete and the sump wells associated with the trench drainage are effectively capturing water associated with the site. Seeding associated with the installation of the interceptor trench has not been completed. The wetland plantings and down gradient areas have been completed. The invasive species removal activities have been completed. The wetland monitoring work continues to report good results and healthy growth in down gradient areas from the site.  Mr. Manzi would like to know where the site is regarding pH levels and what is expected moving forward.  Vern Kokosa, Sanborn Head & Associates, Inc. states the combination of storm events and earthwork factored in to the spike in pH levels.  Mr. Manzi confirms the water coming out of the wellpoints is still being analyzed.  Mr. Kokosa states after the elevated pH readings in July and August the levels returned to where they were prior (9.5-10.5) to the spike. They have continued to take hourly pH readings with an exception of a few days at the end of September when the interceptor trench was installed.  Michael Sabulis, GEI Consultants states the applicant has submitted a plan to decommission the well point system. The pH numbers have trended back down to conditions prior to the spike.  Mr. Manzi confirms the interceptor trench and the wellpoint system are both operating at the same time.  Paul Lockwood, LRT states they are capturing a 95% volume. This number is based on an eight-hour test done on September 25, 2019. They have continued to monitor for volume and are now getting 98% capture with the interceptor trench.  Mr. Seuch states 98% of the water is being collected by the interceptor trench and 2% is being collected by the wellpoint system.  Mr. Manzi would like to know if the interceptor trench has the capacity to collect this volume.  Mr. Sabulis confirms based on the design of the trench it does have the capacity.  Mr. McDonough would like to know how turning off the wellpoint system would benefit the applicant.  Mr. Kokosa states the applicant will benefit financially but decommissioning the wellpoint system will also allow the grading to be completed. They propose to keep the underground infrastructure of the wellpoint system in case it is required to be reactivated.  Mr. Lockwood states they propose to remove the wellpoint header pipe. They will then cap and leave the wellpoints in place.  Mr. Kokosa explains the proposed testing that will lead to the modification of the plan.  Mr. Sabulis states they flip-flopped which system will be the supplemental back up since they found the supplement system, which is the interceptor trench, is functioning better than the primary system, which is the wellpoint system.  Mr. McDonough would like to know if they have been able to isolate and measure the pH levels coming out of the wellpoint system.  Mr. Lockwood states the pH levels is indistinguishable between what is coming out of both systems.  Mr. Sabulis feels the testing method is appropriate based on the pH concentrations. He does not expect there to be much change in the RCA from point to point.  Mr. Manzi would like to know why there is a 48-hour wait time to recommission the wellpoint system if there is a system failure or an impact.  Mr. Kokosa states it will take time to return all the equipment to the site and have it reinstalled.  Mr. Seuch states once the infiltration trench is completed, it will be on grid power with a backup generator. Each well sump will contain two pumps in case of a pump failure. Per the monitoring plan, they must report any noticeable problem to the wetland within two hours.  Mr. Lynch would like to know if they are physically measuring the flow or if they have flow meters.  Mr. Lockwood states readings are being done automatically with a flow meter that has a volume totalizer on it. 10 09 19 NACC Meeting Minutes Page 9 of 10  Mr. Lynch states they have not reached the point where he is comfortable having the wellpoint system decommissioned.  Mr. Sabulis states he has reviewed the plan to test the wellpoint shutdown and is in favor of the plan. He feels shutting down the wellpoint system during one of the rain events will provide good data.  Mr. Kokosa describes the proposed testing and well point system modification. At this time, they require two more days of testing with both systems operating prior to taking the wellpoint system off line.  Mr. Manzi would like to know if the water collected from the trench is still being pumped to a frac tank.  Mr. Lockwood states the system is being run eight hours of the day unless there is a capacity issue requiring it to be run longer. Stevens Estate Long Term Advisory Committee Discussion  The Administrator states the Board of Selectmen is assembling an advisory committee for the long term Stevens Estate planning.
