BOARD OF SELECTMEN MINUTES October 21, 2019
CALL TO ORDER: Chairman Richard Vaillancourt called the meeting to order at 6:30PM in Meeting
Room at Town Hall.
ATTENDANCE: The following were present: Chairman Richard Vaillancourt, Clerk Rosemary Smedile,
Licensing Chairman, Regina Kean, Chris Nobile, Phil DeCologero, Town Manager, Melissa Murphy
Rodrigues, Town Counsel, Suzanne Egan and Executive Assistant, Laurie Burzlaff.
EXECUTIVE SESSION
Chairman Vaillancourt requested a motion to enter into Executive Session.
Phil DeCologero made a MOTION, seconded by Regina Kean that the Board of Selectmen enter
into Executive Session pursuant to Massachusetts General Laws, Chapter 30A, Section 21(a)(2) to
discuss strategy with respect to litigation (Opioid lawsuit and Varsity Wireless) and to return to
Open Session at the conclusion of Executive Session.
Chairman Vaillancourt declared an open meeting may have a detrimental effect on the Board’s litigating
position.
Roll call vote: DeCologero-yes; Smedile-yes; Kean-yes; Nobile-yes, Vaillancourt-yes. Motion
approved.
The Board returned from Executive Session at 7:00PM.
PLEDGE OF ALLEGIANCE
PUBLIC COMMENT

Stan Limpert, 43 Stonecleave Road, asked if the Board has discussed any plans for a 375 celebration in
2021.
Ellen Mosier of 137 Kara Drive, asked the Board to move forward with appointments to Stevens Estate
board.
SWEARING IN
Interim Town Clerk, Laurie Burzlaff, administered the oath to Firefighter Dan Nicolosi. Fire Chief, William
McCarthy read the history of the badge and gave an overview of Mr. Nicolosi’s accomplishments while in
the academy.
APPROVAL OF MINUTES
Chris Nobile made a MOTION, seconded by Rosemary Smedile to approve the Open Session
Minutes of October 7, 2019. Motion approved 5-0.
GOVERNMENTAL REPORTS
Halloween Hours
The Board set Halloween hours from 5:30PM-7:30PM, as recommended by the Chief of Police.
Update on Senior Center
Town Manager, Melissa Rodrigues, stated general contractor bids will be due in February.
Update on Columbia Gas
Town Manager, Melissa Rodrigues, provided the Board with a memorandum regarding the latest issues
with Columbia Gas. Residents will see more Columbia Gas trucks around because they are trying to
complete the work by mid-November as required by the Department of Public Utilities.
FY21 Budget Calendar
Included in your packet is the FY21 budget calendar.
The Board was given a copy of the FY21 Budget calendar.

CONSENT ITEMS
Accept Budget Policy Statement
According to the Town Charter, on or before the first day of November of each year, the Board of
Selectmen, after consulting with the Town Manager, shall issue a policy statement relating to the budget
for the ensuing fiscal year. The statement shall establish the outer limits of possible budget growth for the
Town. Included in the packet was the Budget Policy Statement prepared by the Town Manager for
approval. Town Manager Rodrigues also provided the Board with a list of the goals established by the
Board at the Strategic Planning Meeting. Chairman Vaillancourt asked the members of the Board to
review the goals and pick which ones they would like to take the lead on.
Phil DeCologero made a MOTION, seconded by Rosemary Smedile that the Board of Selectmen
approve the Budget Policy Statement as presented. Motion approved 5-0.
Request of Patriotic Observance Committee to hold the annual Veterans Day Parade on Monday,
November 11, 2019 beginning at 10:00AM
Included in the packet was the annual request by the Patriotic Observance Committee to hold the
Veterans Day Parade on Monday, November 11, 2019. All relevant departments reviewed and have no
issues.
Rosemary Smedile made a MOTION, seconded by Phil DeCologero that the Board of Selectmen
approve the request of the Patriotic Observance Committee to hold the annual Veterans Day
Parade on Monday, November 11, 2019 starting at 10:00AM. Motion approved 5-0.
Confirm Town Manager appointment of Andrew Shapiro as Community and Economic Development
Director
Town Manager, Melissa Rodrigues, hired Andrew Shapiro as the new Community and Economic
Development Director subject to the Board’s approval. Mr. Shapiro was present and thanked the Board.
Regina Kean made a MOTION, seconded by Rosemary Smedile that the Board of Selectmen
confirm the Town Manager’s appointment of Andrew Shapiro as the Community and Economic
Development Director. Motion approved 5-0.
Appointments:
Kimberley Pass to the Sustainability Committee
Phil DeCologero made a MOTION, seconded by Rosemary Smedile that the Board of Selectmen
appoint Kimberley Pass to the Sustainability Committee. Motion approved 5-0.
Board of Registrars
Phil DeCologero made a MOTION, seconded by Chris Nobile that the Board of Selectmen appoint
Colleen Martin to the Board of Registrars through June 30, 2022. Motion approved 5-0.
LICENSING COMMISSIONERS
Rosemary Smedile made a MOTION, seconded by Chris Nobile to open a meeting of the North
Andover Licensing Commission. Motion approved 5-0.
Request from Katharine Bibeau for twelve one day all alcohol licenses for Winterlights at Stevens
Coolidge Place from 5:00PM to 8:00PM on November 22, 23, 29, 30, December 6, 7, 13, 14, 20, 21, 27
and 28, 2019
This matter was continued from the last meeting. Chairman Kean invited the public to make comments.
Kelly Cormier of 169 Andover Street stated that all the neighbors on Wood Lane have concerns regarding
the growth and drastic change at Stevens Coolidge Place which is located in a residential neighborhood.
Ms. Cormier asked the Board to deny the liquor license requests.
Michael Fina of 124 Olde Village Way, stated that the frequency of events and future planning is
concerning, given the noise and safety issues. Mr. Fina also stated they have found empty nip bottles on
the property line.
Jacqueline Fleury of 114 Olde Village Lane read an email her husband sent to the Board.
Katherine McDonald on behalf of the Stevens Coolidge Place stated they heard the concerns and
reduced their request to just Fridays and Saturdays and that there is a very limited amount of alcohol
served at these events. She stated she had spoken with some neighbors.
Chairwoman Kean asked the Town Manager to look into the approval process for the expansion.
Ms. Kean indicated that the regulations allow thirty licenses but it’s up to the Board to decide how many
they want to give.

Chris Nobile stated there has been a dramatic shift in the business and there needs to be a discussion
about the relationship with the Town and neighbors.
Ms. McDonald stated that it is the mission of the Trustees for people to come use the property and
through activities and events you introduce people to the property.
Rosemary Smedile asked that they put a sign up stating people cannot bring their own alcohol.
Phil DeCologero stated he is concerned with the use of Franklin School as a satellite parking lot when
kids stop is still in session. He suggested the Board approve only for Saturday.
Richard Vaillancourt stated that he would be more sympathetic if he were convinced they were working
more with the neighbors. It does not appear that is happening and it’s important for Stevens Coolidge to
understand what the concerns of the neighbors are and help address them.
Ms. McDonald stated the issue is not the alcohol but the number of events.
Mr. Fina stated Ms. McDonald has been receptive to meeting with him.
Richard Vaillancourt made a MOTION, seconded by Rosemary Smedile to approve the licenses.
After discussion about amending the motion, Mr. Vaillancourt withdrew the motion.
Phil DeCologero made a MOTION, seconded by Chris Nobile that the Board of Selectmen, acting
as Licensing Commissioners, approve six one day all alcohol licenses for Winterlights at Stevens
Coolidge Place from 5:00PM to 8:00PM on November 23 and 30, December 7, 14, 21 and 28, 2019
with the condition that the applicant must place appropriate signs indicating no alcohol to be
brought on the premises and to provide feedback after the event comparing it with last year.
Motion approved 5-0.
Request of Jacob Crandell for two wine and malt licenses for pumpkin/Halloween walks at Stevens
Coolidge Place on October 24, 2019 and October 25, 2019 from 6:30PM to 9:00PM (taken out of order)
Kelly Cormier of 169 Andover Street asked the Board to deny the license. The Board asked for the
anticipated turnout for the event. Ms. McDonald did not have the information with her.
Mr. DeCologero asked the Town Manger to explain what residents can do with regard to the noise. Ms.
Rodrigues explained that the nuisance bylaw is enforced by the police department.
Chairwomen Kean stated that the event should not have been advertised and tickets should not have
been sold prior to obtaining approval for the Licensing Commission.
Mr. DeCologero asked for a discussion to be put on the next agenda about how neighbors’ concerns can
be addressed. Mr. Vaillancourt stated that is under the purview of the Planning Board.
Phil DeCologero made a MOTION, seconded by Rosemary Smedile that the Board of Selectmen,
acting as Licensing Commissioners, approve the request of Jacob Crandell for two wine and malt
licenses for pumpkin/Halloween walks at Stevens Coolidge Place on October 24, 2019 and
October 25, 2019 from 6:30PM to 9:00PM. Motion approved 5-0.
Request of Deborah Ingalls for a one day wine and malt license for a baby shower in the barn at Smolak
Farms on October 27, 2019 from 2:00PM to 7:00PM and waiver of police detail.
Chris Nobile made a MOTION, seconded by Phil DeCologero that the Board of Selectmen, acting
as Licensing Commissioners, approve the request of Deborah Ingalls of Smolak Farms for a baby
shower in the Barn on October 27, 2019 from 2:00PM-7:00PM and waive the police detail. Motion
approved 5-0.
Chris Nobile made a MOTION, seconded by Phil DeCologero to close the meeting of the North
Andover Licensing Commission. Motion approved 5-0.

TOWN MANAGERS REPORT
The Board was provided with the job posting/vacancy log. Town Manager Rodrigues thanked everyone
that helped with the cleanup day at the lake. Ms. Rodrigues also thanked Jean Enright for all the work she
has done over the last year serving as Interim Economic and Community Development Director.
SELECTMEN’S UPDATES/COMMENTS
Phil DeCologero urged residents to apply for the Stevens Estate long term advisory committee.

Rosemary Smedile announced the women’s club fashion show is Friday. Also if anyone is interested in
sponsoring a wreath the cost is $70.00.
ADJOURNMENT
Phil DeCologero made a MOTION, seconded by Rosemary Smedile to adjourn the meeting at
9:15PM. Motion approved 5-0.
