Contract#MCI 3-G28 07/01/2014 tbrougli 06/30/2018 Page 1 of'23 Contract M;IC13-G28 Addendum 3 CONTRACT RENIEWAL: This contract is being renewed for a period, of one (1) year, from 6/30/2018 to 6/30/2019. All suppliers have agreed to remain on contract and all terms and conditions will remain the same. Any questions, concerns or suggestions please contact Joan Miller at: April 2018 1 MC13=G28' Elevator Equipment, Maintenance, Repair, Inspection & Testing Contract Duration from 07/01/2014 through 06/30/2018 Instructions and Information pertaining to the use of this contract 1 All Terms& Conditions contained in the IFB for MC13-G28 and the bidder's response to the IFB are incorporated herein. Any modification or amendment of any provision of this Contract must be in writing and bear the signature of each party's duly authorized representative. In the event of a conflict between the terms of the IFB, bidder's response and/or the terms set forth in this Contract, the following order of precedence shall control: a) Terms in this Contract, b) Any correspondence between MHEC and the Bidder clarifying the bidders response c) Bidder's response to IFB c) IFB 2 Contractors are required to market products and services to the MHEC membership directly and continue to promote sales volume through quality and superior service. 3 Discount pricing may be offered to a member above and beyond this contract discount structure in the form of: Special Deals, Sales Catalogs or Bulletins, Promotional Sales, and Additional Volume Discounts through special quotes for committed dollar purchases, so long as the same pricing will be offered to all current and future member customers who meet the same criteria for the special pricing. 4 Use of the contract is left to the discretion of each respective member. No guarantee of volume has been made to the supplier. 5 Any purchase order issued to a vendor by an MHEC member is an agreement between the individual member and the vendor, not the MHEC organization, or other MHEC Members in part or total. 6 Suppliers will make every effort to identify purchasers contacting them to determine MHEC membership and extend the MHEC pricing and any benefits.Any customer who meets the MHEC criteria for membership within the 6 state region such as; 1. Non-profit, public and private colleges 1 universities, 2. Not for profit technical, charter, and vocational schools, 3. Municipalities including K-12, and Libraries. 4. Non-profit education organizations, 7 Either party may terminate this contract for convenience,without penalty, upon Sixty(60)days written notice to the other party 8 This contract contains installation and services which may fall under a State's prevailing wage laws and guidelines of the MHEC PUBLIC members. In addition depending on the situation or circumstances, state laws or state procurement guidelines, the MHEC PUBLIC members may be required to obtain separate quotes or publicly bid installation services. 9 Wage Rates: Please visit each States' Department of Labor and Development referencing details or Prevailing Wage Rates and how they are to be paid on State Jobs and how payroll records are to be maintained. Per the AG, Division of Occupational Safety, prevailing wage rates are subject to change annually. Each job performance must include an updated prevailing wage rate chart. It is the responsibility of the contracted supply partner to request this from the member requesting service. Note that several of our schools are public and it is the vendor's responsibility to follow the wage rate guidelines if necessary. This list is included but not limited to New England. It is the responsibility of the supplier to request prevailing wages from members when performing services where prevailing wages apply. Inc. SPECIAL INSTRUCTIONS REPORTING Immediately furnish, upon completion, a written report(findings/deficiency report)to the MHEC member and/or approved designee. Services indicating results and note any repairs or changes that the contractor considers necessary. Said report shall include a quote for repairs. The contractor shall prepare a work completion slip for EACH elevator(unit) immediately after completion. Said slip must, at a minimum, have the following and may be revised by the MHEC member depending on their needs: - Contractor's name, address and telephone number - Technicians name - Date of inspection - Date of service - Arrival time to and departure time from the facility - Elevator type, location and ID# - Detailed scope of work performed - Notations as to if the work is completed or if a return call is needed - Purchase Order Number and the MHEC contract number - Findings and deficiency notes - Signature from the MHEC Member or approved designee INSPECTION/SAFETY-TEST Supplier will be responsible to perform one annual state inspection/safety test and permits and must be filed at a minimum of 90 days before the expiration of the current inspection certificate and will be responsible to pay the $400 (currently) State Application Fee and will be responsible for any increase in fees. Proof of filing and payment(cancelled check or other receipt of payment made) must be submitted to the MHEC member and/or approved designee proving that the department of public safety has received payment. The supplier is required to notify the MHEC member and/or their designee at least 30 days before the scheduled test. The supplier will schedule the inspection with the State Inspector and provide the required team of elevator mechanic(s)during the normal working hours of the elevator trade. Member will provide any required fire alarm service personnel and/or electricians at its own expense for the Annual Safety Test if required. All services must conform to all legal statutes and Code requirements, manufacturer's specifications, building owner's rules and requirements for working at the property. 1. Fines that result from the'failure of suppliers to file for state inspections according to the state Department of Public Safety guidelines shall be the responsibility of the supplier. Supplier shall conduct full load weight tests, as mandated, at no additional charge. 2. The cost for any testing which must be repeated due to the malfunction of equipment covered by this contract will be the responsibility of the Supplier. Supplier will be reimbursed for expenses associated with other trade related malfunctions (items beyond supplier's control)and delays causing such tests. 3.
