A 25' No-Disturbance ,Zane and a 50' No-Build Zone shall be established from the edge of the Bordering Vegetated Wetland associated with an intermittent stream and a 50' No Disturbance Zone and a 7 ' No-Build Zane shall be established from the edge of the Ephemeral Pool habitat. Future work within the 100 feet of existing wetland resource areas on site will require a separate filing with the NACC (see Section 3.1 &3.4 of the North Andover Wetland Regulations for performance standards within these zones). The Conservation Administrator and/or agents of the NACC do not have the authority to waive these setbacks as established under the local Bylaw. . The existing wetland markers that indicate "No-Disturb Areas,' as required by Condition#49 shall retrain posted and replaced as necessary in perpetuity. These markers will designate the wetland resource areas' sensitivity and assure no further inadvertent encroachment into the wetland or no disturb/no build zones. The applicant/owner shall instruct all agents to explain these markers to buyers/lessees/landscapers and all persons taking over the property from the j applicant. j 3. The applicants, owners, and their successors and assignees, shall maintain all culverts, catch basins, outlet structures, subsurface infiltration/storage areas, and other elements of the drainage system, unless put into an easement to the Town of North Andover, in order to avoid blockages and siltation which might cause failure of the system and/or detrimental impacts to on-site or off-site resource areas, and shall maintain the integrity of vegetative cover on the site. 4. There shall be no discharge or spillage of fuel, or other pollutants into any wetland resource area or no disturb/no build zones. If there is spillage or discharge of any kind,the responsible party shall remediate said spill in compliance with applicable regulations and shall notify the NACC within one (1) business day. 5. No underground storage of fuel oils shall be allowed within 100 feet of wetland resources on site. 6. Fertilizers utilized for landscaping and lawn care shall be slow release, low nitrogen type (<5%),phosphorous free and shall not be used within 25 feet of a resource area. Pesticides and herbicides shall not be used within 100 feet of a wetland resource area. 7. There shall be no dumping of leaves, grass clippings, brush or other debris into a wetland resource area or inside the No Disturbance Zones on site.
