Dear Ms. Enright,
I have reviewed the above referenced plan with respect to the proposed water and sewer service lines to
2302 Turnpike Street. I have the following comments.
1. The existing 4-inch sewer force main stub is privately owned and therefore a connection to it
cannot be made. An alternative sewer connection must be designed including the connection
to the town's public main line sewer. If the applicant secures the rights to use the 4"pipe,a
manhole should be installed where the connection is made with the ability to launch a sewer pig
for maintenance.
2. The sewer connection fee for a residential unit in this area is$1,557. The connection fee for a
commercial unit is$3,114.
3. The water main in Sharpners Pond Road is not shown correctly. A 12"-inch main exists in
Sharpners Pond Road that the applicant may connect to. Another option may be to connect to
the 12-inch water main in Turnpike Street.
4. The connection fee for a 4-inch domestic water lines is$10,000.

This memo is in response to the application before the planning board regarding a proposed
commercial operation at 2302 Turnpike Street.The Health Department has the following
comments.
1) The proposal shall comply with the North Andover Board of Health regulation regarding
the dumpsters proposed on the site.At minimum dumpsters must be placed over 20 feet
from any structure;placed on a pad and enclosed by a fence.
2) The proposal shall not create a new nuisance noise or nuisance odors that could affect the
enjoyment of neighborhood properties.Addressing the potential issue before it occurs is
critical to the health and welfare of the public.Note that nuisance is a difficult issue
where residential property is close to commercial properties.
3) The property is currently serviced by an onsite subsurface disposal system.The applicant
proposes that the new building will be connected to municipal sewer.The onsite septic
system must be abandoned properly in accordance with MA DEP regulation,310 CMR
15.354.
4) The property is currently serviced by a private well.Abandonment of this well shall meet
the requirements of section 6 of the North Andover Board of Health regulations regarding
wells. Consideration of continued use of the well must be approved by the Health
Department.

application for review under the WPA and MESA regulations
Dear Commissioners and Mr.Gill:
On 11/23/2015 the Natural Heritage and Endangered Species Program (NHESP) in Division of Fisheries
and Wildlife (Division) received a Notice of Intent,site plans, and other information from the Applicant
pursuant to the rare wildlife species provision of the Massachusetts Wetlands Protection Act (WPA) and
its implementing regulations 310 CMR 10.59, and the Massachusetts Endangered Species Act (MESA)
(M.G.L. c. 131A) and its implementing regulations (321 CMR 10.18).
The Division has determined that the proposed project is located within the mapped Priority and
Estimated Habitat of Blandilg's Turtle (E)ttydoidea blandingii), a species state-listed as Threatened. This
species and its habitats are protected pursuant to the WPA and the MESA. Fact sheets for state-listed
species can be found at Nvww,nnass.,Zov/nhesp.
The purpose of the Divisions review of the proposed project under the WPA regulations is to determine
whether the project will have any adverse effects on the Resource Areas Habitats of state-listed species.
The purpose of the Division's review under the MESA regulations is to determine whether a Take of
state-listed species will result from the proposed project.
This letter is to inform you that the Division has reviewed the materials submitted with your combined
application under the WPA and MESA regulations and has determined that additional information is
required in order for the Division to complete its review pursuant thereto,as specified below:

® As discussed with Williams and Sparages on 12/17/2015,please submit the revised project plans
and MESA and WPA impact calculations. Specifically, the revisions discussed include moving
the limit of work further from the wetland area.
After receiving the above requested information, the Division will continue its review of the proposed
project for compliance with the state-listed species provisions of the WPA and MESA regulations. The
Division reserves the right to request additional information to understand the potential impacts of the
proposed project on state-listed species and their habitats.
No work or other activities related to your filing may be conducted anywhere on the project site until the
Division completes its review.

Dear Commissioners&Applicant:
The Natural Heritage & Endangered Species Program of the Massachusetts Division of Fisheries &
Wildlife (the "Division") received a Notice of hntent with site plans (dated 11/4/2015, revised
12/29/2015) in compliance with the rare wildlife species section of the Massachusetts Wetlands
Protection Act Regulations (310 CMR 10.58(4)(b), 10.59). The Division also received the MESA Review
Checklist and supporting documentation for review pursuant to the MA Endangered Species Act
Regulations (321 CMR 10.18).
WETLANDS PROTECTION ACT(WPAJ
Based on a review of the information that was provided and the information that is currently contained in
our database, the Division has determined that this project, as currently proposed, will not adversely
affect the actual Resource Area Habitat of state-protected rare wildlife species. Therefore, it is our
opinion that tlus project meets the state-listed species performance standard for the issuance of an Order
of Conditions.
Please note that this determination addresses only the matter of rare wildlife habitat and does not pertain
to other wildlife habitat issues that may be pertinent to the proposed project.
MASSACHUSETTS ENDANGERED SPECIES ACT(MESA)
Based on a review of the information that was provided and the information that is currently contained in
our database, the Division has determined that this project, as currently proposed, will not result in a
prohibited "take" of state-listed rare species. This determination is a final decision of the Division of
Fisheries and Wildlife pursuant to 321 CMR 10.18. Any changes to the proposed project or any additional
work beyond that shown on the site plains may require an additional filing with the Division pursuant to

I am in receipt of an Earthworks Site Development Plan by Williams and Sprague revised
February 10, 2016 for the above referenced address. I offer the following comments:
1) Tim Willett from Water and Sewer Dept. has rejected both the water and sewer services as shown.
The applicant needs to redesign and submit to him for approval.
2) The Southern driveway entrance is approx' a y 70' from the intersection with Turnpike St. It
should be moved north to approximately t e 48' ontour(flat area)to maximize distance from
intersection.

Hi Jean,
I have met with Chris Sparages regarding proposed water and sewer lines for the above location. They have
submitted revised plans that are acceptable, including a separate force main for sewer connection and water line
connection from Turnpike Street.

Re: Earth Works Landscaping
The Fire Department has reviewed the request by Earthworks Landscaping to develop the
land at 2302 Turnpike. We will require a Fire Hydrant to be within 500 feet from the proposed
development. We will require the mulch storage be permitted through the fire department yearly
and all mulch storage will be in accordance with NFPA-1. We will also require permits for any
and all flammable and combustible fluids that are stored on the site to be in accordance with the
Mass general law permit schedule. We will want 360 degree access around the building for all
fire apparatus to include the ladder truck.

Hi Jean, 1 discussed the gate specifications with Danny Gill and here is a breakdown.
The property will have two gates that provide access to the back of the building. The gates will be electronic
and will either have a key pad entry or card entry. The code or card will be provided to the Fire department to
ensure access.
The Fire Department will also be provided with keys to the front rear common entrances of the building.
If you require additional information, please let me know.
