ENFORCEMENT ORDER
Nancy Sullivan, gave a brief discussion of the work completed on
the crossing area and indicated that work was allowed on the,
interior of Lot, 60A. She also ind"I" cated that the wetland
delineation had been verified in the field. The, app.L icant,
presented the Commiss ion with new plans showing the delineation
and a proposal for a wetlandS 4-,,n, replication for the, This

reel cat was neciessary because of field modifications
associated with the crossing.,
Comments were accepted from, the public concerning the status of
the pond as it relates to, the fi' lligig required for the crossing
and placement of erosilon control devices on the site. An
abutter, Bob Davidson,, spoke to the Commiss, n regarding this
matter,, Re felt that hay bales, were blocking 'water flow from the
pond. The Commission stated that h,aybia.les would not stop, water
flow from the pond. The applicant discussed with the Commission
that status of' the remaining, lots specifically lots, 62A and A.
They requested that work be allowed, on 62A, since, the, common
driveway permit had been applied for and the Commission
determined that no other work could take, place on the site until
a site "inspection, had been conducted,

PUBLIC HEARING
'W.. Vices read the legal notice advertising the Request fog
'Determination for Lot 3 Berry Street., He commented on the recent
exposure that the proposal had received, specifically the
articles in the Boston Herald, Eagle Tribune and the telephone
conversations, with the Governor's, office. He suggested and
hoped for better information and a better pro3ec,t accompanying
this submittal,
Mr. Stack began his, presentation with a discussion relating to
his land being damaged while he was overseas. He was requested

by the, Conservation Administrator and the, Chairman to direct his

discussion to Conservation issues. Mr., Stack indicated that the
wetlands appeared on his, land as a result of' work previously done
on abutting lots. He felt that the development on Route 114 and
location of a culvert on Berry Street had directed the water
towards his property, He specifically mentioned Elm Square
Builders,, Nancy Sullivan indicated that a valid Order of

Conditions was i ssued for this, pro3ect.

Willie Vicens indicated that the pro]ect proposed a wetland
crossing into an 'island of land. Both W. Vice ns and A. Resca
remembered the site visit and indicated, that uplands did. exist on
the site. Mr. Stack, discussed the fact that no wetlands existed
on the site when he purchased it and that, again, water has been
forced onto his, property,. Jack Linn asked why a, Request to
Determine was, filed, and not, a Notice of' Intent?

N. Sullivan indicated that the Request to Determine was filed so
that a wetland, delineation could be done by herse prior to the
fi 1,ing of a Notice of Intent, She also indicated that Mr. Stack
agreed that whatever delineation was done, by her would be the one
used for the site plan as submitted with the Notice of Intent.
She indicated that once this was done then, the other, issues
relating to this file could be, addressed at the Notice of Intent
stage.
Mri. Stack indicated that the driveway could be moved,, Mr.,
'sheen e reiterated his concerns as they related to the septic,
requirements and necessary mitigating measures, Mr. Stack
discussed the proposal to allow his neighbor to pipes their water
from, his well. Mr, Stack requested the Commission to allow him
to move the wetlands off his property. Mr. Re,sca indicated that
the regulations regarding wetlands had changed and that filling
of wetlands was, much more, restrictive M . Resew also suggested
that M'ri. Stack employ the services lelf an engineer and have it
present at the meeting. Mr. Stack began discussing the 'issue of
wetlands being created on his property. Mr. Sichoene reiterated

his concerns that Mr. Stack, try to address leis regarding
his proposal as outlined 'in the, denial "issued by the NACC.

Mr. Stack began a d iscussion of the re-zoning that took place
*lie he was gone, to serve the country He felt that he should,i 0,
have been notified, and that his, family should have, been notified
of the change. Willie Vicens asked Mr. Stack the status of the
septic approval Mr. Stack indicated that -the septic system
originally submitted to, the Board of Health had been refused. He
stated that hie still, did not have Board of Health, approval on his
septic system.
C. Sichoene asked, that Mr. Stack also address the 'issue, of the 100
year flood plaice elevations on the site, indicating that this had
not been previously done, He also asked that when Mr. Stack
submits his Notice, of Intent that he address, the specific issues
that had been, identified in the denial, and further explained, at
this meeting,
Mr. Lindon, asked if the wetland cut, across, the back of the lot.?
He was concerned as to whether there, existed any dry land where a
replication, if needed, may be placed,. NO Sullivan incticated
that the wetland did cut across the, rear portion o�f the lot and

that replication would not be possible if the plan submitted was
similar to the original plan,,

Further discussion ensued regarding Mr., Stack' s right to pursue
this matter 'in the court, system,, N. Sullivan indicated to, Mr.

Stack that hi' s en, ineler should get, in, touch, with her so that the

specific concerns of the NACC would be addressed prior to the

Willie Vicens motioned for a positive Determination on the
Request to, Determine,, Jack, Lindon seconded, it was a unanimous
vote.,
