Date of Decision: July, 15,2016 Petition of: Thomas and Nicole Friel Premises Affected: 254 Great Pond Road,North Andover,Ma 01845 Assessor's Map 37A,Parcel 6 and located in the Residential 1 Zoning District HISTORY AND BACKGROUND On January 5, 2016 the Planning Board approved a Site Plan Review Special Permit to allow the construction of a 22' x 23' single story addition to the side of the dwelling, demolition of an existing deck, and addition of a new deck within the 250' Non-Disturbance Zone of the Watershed Protection District. On April 19, 2016,the Planning Board approved a Site Plan Review Special Permit Modification to allow for an addition off of the existing garage, reconstruct the existing driveway and to extend the existing front porch to provide handicap access within the 250' Non-Disturbance Zone of the Watershed Protection District and within the Residential 1 Zoning District. On July 8, 2016 Ms. Friel informed the Planning Department that her General Contractor has communicated that the existing garage front wall foundation does not have a frost wall and that leaving this part of the foundation would lead to structural issues in the future. The remaining foundation walls can be demolished to grade and will not be excavated. Ms. Friel requested approval to replace the front wall foundation of the existing garage. In consideration of the requested approval the Petitioner has agreed to modify the approved plan to show the entire garage roof stormwater runoff(including the expansion)to be hardpiped via roof drains to Drywell#2. A total of 870 square feet of roof area will now be collected and recharged via Drywell#2. HydroCAD calculations supporting the sizing of Drywell#2 for the 2, 10, and 100 year storm event have been submitted to the Planning Department. 254 Great Pond Road Map 37A,Parcel 6-2 Watershed Special Permit—Insubstantial Change July 15,2016 FINDINGS OF FACT The proposed changes reflected on the plan entitled"254 Great Pond Road Plot Plan of Land located in North Andover, Massachusetts (Essex County)" revised to July 14, 2016 (attached) are deemed to be insubstantial changes that do not alter either the intent or the conditions of the original Special Permit. The changes do not require a vote of the Planning Board. CONDITIONS The Petitioner shall comply with all existing conditions rendered in the original Watershed Special Permit issued January 5, 2016, except for specific conditions superseded by the Watershed Special Permit Modification issued April 19, 2016 and with this Notice of Decision- Insubstantial Change. All plan revisions will be reflected on the final as-built drawings.
