Minutes of Meeting of July 20, 1988 NACC

Paul Tariot motioned to accept the Minutes of June 22,. 1988 meeting of NACC.
A. Resca seconded, motion carried.
Hawkins Lane - (Enforcement Order)
Jack Lindon read comments by W. Vicens on BSC's review of the hydrologic calculations.
Willie suggested that the Engineer respond in writing to the BSC Review and provide
more detailed analysis. Coleman McDonough attended the meeting, Ray Fraser and Peter
DeGraff couldn't attend. Discussion also took place on alterations from the approved
construction schedule. J. Lindon recommended that the project be shut--down until
further information is received anti the issues cleared up. P. Tariot motioned to
issue a Cease and Desist (Enforcement Order) to be in effect immediately, 7/20/88

and not be lifted until another meeting takes place. C. Schoene seconded, motion carried.
Butcher Boy - Discussion
Revised plans were presented - same pump station, different sewer line (farther from the
wetlands) . Erosion controls addressed, in vicinity of catch basins. There will be
de-watering involved that has to be approved by the NACC. P. Tariot motioned to
approve the revised plans as acceptable as requested for the pumping station and
storage tank, but specifically exclude proposed sewer line as required in Condition #13
of the Order of Conditions. A. Resca seconded, . motion carried.
224 (Lot 13) Chestnut Street - Determination
Homeowner, James D. Doherty Jr. , appeared before the commission with a request for
Determination involving enlarging his backyard which has a stream running through the
property. Quite a few abuttors, from upstream and downstream of the property attended
the meeting. Namely: Mike Polluck of Sutton Place with his concerns, Scott Duncan
of 53 Chestnut St. , Nancy McMann, next door neighbor (#250 Chestnut St) , her Land
is lower than 224 Chestnut Street, and Bill Capioni, all expressed concerns for. this

very wet area in the back. C. Schoene requested that we will need to know where the
100-year-flood storage line is. It was requested that Mr. Doherty give us one--weeks
extension in order to visit the site and make a determination. As of July 27th,
the Desi.cion made a Positive Determination.
Building # 31-37 Flagship Drive - Continued Public Ilearing
P. Tariot motioned we close ,the public hearing and issue a Negative Determination
with stipulation that erosion controls be installed and inspected before work begins.

Lot 10 Dale Street - Public Hearin
This is a four bedroom dwelling with garage. (Form A-Subdivision) . Thomas Neve of
Neve Associates representing the owner, Ellen Sweeney explained the plans. [louse is on a
knoll 58' from wetland. Wetland to, lot line estimated at 25' . L. Bruinooge motioned
we close the public hearing and issue the Order of Conditions within 21 days after
receipt of letter of the wetlands having been reflagged. P. Tariot seconded,motion carried.
Material Installations - Discussion
This project is located in the North Andover Business Park, Jim Bourgeois submitted a
" progress report on NABP, as well as revisions to site plan indicating that the addition,
to Material Installations building will be at a lower elevation. No effect on grading
or drainage system around present building. They also plan to move the parking lot to
the north end of the site which will fill less wetlands. Prior approved plans was IB,
new plans is 1A. L. Bruinooge motioned we accept the plan dated 6/24/88, the revised
final plans also known as 1B in prior approved plans. P. Tariot seconded, motion carried.
Willow Street & Flagship Drive - Discussion
Thomas Neve presented connection information. Two wetland crossings proposed.
Extension adjacent to Ogdan Foods subdivided a piece of land which previously was
four driveways. (Tom noted that there would be 9,000 sq. ft. of bordering vegetated
wetland filling.) No vote was taken
Jared Place - Discussion
Revised wetland replacement plans presented by Thomas Neve. Irene was authorized to
accept the final plan after discussion took place with Tom Neve.

Safe & Sound Mini-Storage Discussion
John Todd the owner came before the commission with a proposed water main that needs to go
across Route 114. To cut through road would require State's approval. To go under the
road would require a jacking pit be constructed and dewatered into Boston Brook.
Jack suggested that proper filtering of water from jacking pit would not impact the brook.
Jack requested a delay untill Willie is present. To be on our next Agenda of Aug. 3, 1988.
A.T.& T. - Discussion
Pete Bajor in charge of these projects came before the Commission. Plans for the first
phase of these projects has been approved. Jack Lindon suggested that the second-half
of Nancy Sullivan's report on the project be approved. L. Bruinooge motioned that we
accept details and plans submitted (modifications suggested by Nancy Sullivan) .
P. tariot seconded, motion carried. Copy of Nancy Sullivan's report, the second-half,
will be sent to Pete Bajor.
Lot 48 Johnnycake Street - Certificate of Compliance
L. Bruinooge Motioned we issue a partial Cert. of Compliance on Lot 48 Jonnycake upon
receipt of a letter from a registered professional engineer, stating that the lot is in
compliance with the Order of Conditions and receipt of an as-built site plan. Irene
3 to inspect the lot and is empowered to issue a Gert. of Compliance (Partial) if all is well.
Lot 14 Coventry Lane - discussion
L. Bruinooge motioned we accept the modification (House moved 5' closer to wetland)
as an insignificant change for Lot 14 Coventry Lane. Plans dated 7/20/88 as the official
plan of record. seconded, motion carried.
Lot 15 Wintergreen
Certificate of Compliance is denied at this time due to lack of ground cover. Site Visit
to be made.
Lot 5A - Laconia Circle -- Partial Certificate of Compliance
A. Resca motioned to approve the Certificate of Compliance upon the recommendation of
Irene Mackun's approval. P. tariot seconded, motion carried.
Lot 14 Wintergreen Estates
L. Bruinooge motioned to issue an Enforcement Order to stop all work as there is filling
violation in back of lot. There -is also more than a taro-to-one slope. They should
immediately install erosion controls. A. Resca seconded, motion carried. Certified mail
to owner a copy as well as to Dave Rand of the N.A. police.

P. Tariot motioned we issue a Partial Cert. of Compliance on Lot 7 Crossbow Lane.
L. Bruinooge seconded, motion carried.
Lot 8 Candlestick -- Reg. for Cert. of Compliance
At this time the request was denied due to the fact that the grass in not well established.
Lot 2 & 3 Johnnycake
Request Tom Neve to reopen public hearing on Lot 2 and examine Lot 3 (possible wetland
filling) and how this affects Lot 2. was there wetlands filled? (Flood storage)
Jared Place - Phase 11 - Discussion
P. Tariot motioned to issue an amended Order of Conditions for Jared Place Phase 11 -
citing plan revised on 6/22/88. Revised 3 foot widening of Bridge crossing. A. Resca
seconded, motion carried.
Lot 3 Dale Street - Order of Conditions
Carl Schoene motioned to accept the Order of Conditions as amended on Lot 3 Dale Street.
A. Resca seconded, motion carried.
Salem and Berry Streets - Discussion
Typographical errors in determination of Applicability corrected. An amended,
Determination will be issued.
Jeffrey Place - Discussion
Work has begun at this site, but no erosion controls have been installed, and other
Conditions in the Order of Conditions have been ignored. An Enforcement Order will
be issued to Cease and Desist all work.
