Minutes for Meeting of August 31, 1998

W. Vicens motioned that we approve the Minutes of August 10th as
amended. P. Tariot seconded, motion carried.
Frances & Florence Estates - Two Separate Re uests for Extension
of Order of Conditions
William Shack Esq. , an attorney for the owners of the above
Estates, namely Allen E. Cuscia and Joseph G. Levis attended the
meeting. The status of these two projects was discussed.
Wetlands on Florence Estates have been reflagged, Engineer - is
preparing alternative roadway design. Francis Estates - septic
systems are proposed, and the locations need to be approved.
Jack to review septic designs and comment to Planning Board. Sa.
Vicens motioned we issue an extension for one year for Frances
Estates (#242-273) immediately after the posting of a $10, OQo
bond (same amount for both Frances & Florence) P. Tariot
seconded, motion carried. The extension for Florence Estates
will be reconsidered after the Engineer discusses the new roadway
design at an NACC meeting.
. Teoma Estates - Extension of Order of Conditions old Cart Way)
W. Vicens motioned we issue an extension for one ( 1) year on the
Order of Conditions for Teoma Estates ( fl242-269) to May 11, 1989 .
P. Tariot seconded, motion carried.
Lot 14 Wintergreen Estates - Discussion
Jeremy Eyal came before the Commission proposing to extend and
flatten the slope behind his house . It was explained to him that
no work could extend beyond the haybales . Irene Mackun to visit
the site and verify location of haybales ; if they are located per
plan, he may proceed. if not, a site visit must be made and a
vote taken on the change.

Proposed Sewer Line - Coventry Lane to North Cross Road
Bill Hmurciak, town engineer, presented a schematic of a proposed
sewer line from Coventry Lane lift station to North Cross Road,
to obtain input from the Commission. Proposed route is along
Mosquito Brook, through Kozdras property with two brook
crossings. A site visit was suggested. Willie and Carl
requested that other alternatives minimizing wetland impact be
considered and presented to the Commission. No vote was taken.
Lot 43 Bear Hill - Request -for Certificate of Com liance
W. Vicens motioned that based on Irene Mackun ' s recommendation we
issue a partial Certificate of Compliance an Lot 43 Bear Hill .
P. Tariot seconded, . motion carried.
Lot 1 -- Liberty Street - Request for Certificate of Compliance
W. Vicens motioned to issue a Violation Notice on Lot 1, Liberty '
Street (#120) . Work not done according to plan. No Certificate
of Compliance can be issued until the violation is addressed. P.
Tariot seconded, motion carried.

Hickory Hill - Public Hearin - Notice of Intent
Due to one of the abutters not being notified (it was overlooked)
it was decided that the public hearing would be continued to i
September 14 , 1988 . Al Shaboo of Design Engineers attended the
meeting, representing George Barker, the owner. This project
involves construction of nineteen duplexes and six triplexes
condominiums including related private drives, landscaping,
parking, sewer, water and drain mains, and detention basins .
There are two proposed wetland crossings. One is a proposed road
crossing off Barker Street, and another is a sewer crossing at
the rear of the property. Propose 3870 square feet of filling of
bordering vegetated wetland, and propose to replace 4220 square
feet of wetland upstream. Sewer will connect to French Farm.
Project to be done in phases to minimize erosion. There was
discussion of sewer and water easements, and where they will tie
into. A wetland replication plan has been submitted, but needs
more detail. A question was raised about parking lots and roadway
draining directly into wetland area. Al Shaboo stated the
planning Board had requested this to prevent these areas from
drying up. A site visit will be made by NACC on September 10th.
Road will be staked and replication area will be flagged prior to
this visit. W. Vicens motioned that we continue the public
hearing for two weeks (September 14) on Hickory Hill . P. Tariot
seconded, motion carried.

Samuel PhiIli s Common - Public Hearing Request for
Determination
Sam Thomas of Linday Development Corporation, represented the
owner, W.G. Brooks Thomas of Jamestown Rhode Island. This
project involves 16, 681 acres of upland field bounded on the east
by Osgood Street, north by Phillips Brooks Road, northwest by
Chickering Road (Route 125/133) , southwest by Massachusetts Ave. ,
and south by various abutters. They plan to construct six
buildings, housing 5.4 dwelling units, one village house, gazebo,
tennis court, and seven garages, for retirement housing. W.
Vicens motioned that we issue a Negative Determination on Samuel
Phillips Common since the area described in the request is not
subject to the Act. All surface drainage is proposed to flow
toward Route 125. P. Tariot seconded, motion carried.
Melvin Weiner Pro ert - Public Hearing - Re uest for
Determination
Phil Christiansen of Christiansen & Sergi Engineering repressed
the owner Melvin Weiner. A drainage problem exists. A temporary
ditch has been dug, and wetlands were flagged by Curt Young. Hay
bales will be checked by Irene and a site visit will take place
on September loth, to confirm the wetland flagging. A 7-day
extension was requested and granted. The site visit team has
been empowered to make the decision in the field by a motion from
W. Vicens. C. Schoene seconded, motion carried.
Brooks School Sewer - Public Hearin - Request for Determination
Peter Richardson, engineer from Kaminski Associates represented
the owner, Brooks School Inc. . Also, Mr. Marino of Brooks School
attended the meeting. The School is presently on septic system/
with leaching fields. A sewer line pumping station are proposed,
with a portion of the sewer crossing a wet area. It was decided
that a site walk would take place in order to make the
Determination on this project. W. Vicens motioned that we
empower the site visit team to make a decision on the Brooks
School sewer. P. Tariot seconded, motion carried.
Woodchuck Grove - Public Hearin - Notice of Intent
Al Shaboo of Design Engineers represented the owners, Walter &
Isabelle Grady. The project consists of Lot 12 Salem Street and
Lots 1, 3 , 4 , 5 and 6 on Partridge Hill Lane. (22 acres)
Construction of 1, 000 feet of roadway, 17 dwellings, and on an
off-site detention and utilities. Site is a PRD (cluster) and
will have town sewer and town water. Lot 12 has a proposed
detention basin. Two other detention basins are also proposed,
one within an existing wetland area. Portions of lots covenanted
(restricted form further use) . Some land deeded to State.

Woodchuck Grove - Public Hearing -- Notice of Intent Continued
Proposed filling of 4890 square feet of wetland for roadway
crossing with replacement wetlands of 5210 square feet. Revised
plans were submitted today, not five days prior to the hearing as
required by law. The Commission was seeking a 4-week extension
to allow adequate time for further input; J. Willis did not want
to grant this extension. The problem of submitting plan
revisions on the day of the meeting and expecting action on them
was again stressed. W. Vicens motioned to continue the public
hearing on Woodchuck Grove until two weeks from tonight
(September 14) . P. Tariot seconded, motion carried. Public
access will exist through a portion of this property to State
Forest Land by a deed. There was concern over the hydrologic
calculations submitted. W. Vicens motioned that we retain BSC to
do a hydrological review of Woodchuck Grove. The price allotted
would be $1, 000. P. Tariot seconded, motion carried.
Vest Wa Brid es Lane - Public Hearin - Notice of Intent
Lots 25 -- 30, 31A, 32A are the eight lots involved . Al Shaboo of
Design Engineers represented the owner (Please see Appendix A in
the Notice of Intent) . These lots are form A lots and were part
of the original Bridges Subdivision. There appears to be
potential problems because some of the septic systems are 100-102
feet from wetlands and there is a question on the accuracy of the
wetland flaggings. There is also a question/problem of having "
one filing for several individually owned pieces of property. W.
Vicens motioned to close the public hearing and issue an Order of
Conditions after receipt of the following information. 1)
Signatures from lot owners, 2) Updated flagging, and 3) Staking
of two corners in the back of each house. P. Tariot seconded,
motion carried.

W. Vicens motioned that we ratify the Enforcement Order issued on
this lot by Irene. C. Schoene seconded, motion carried.
Hitching Post Road - Patnaude Estates) . -- Amended Order of j
Conditions
P. Tariot motioned we accept the amended Order of Conditions on
Hitching Post Road. C. Schoene seconded, motion carried.
Lot 3A Ba field Drive -- Order of Conditions !
W. Vicens motioned we issue the Order of Conditions for Lot 3A K'
Bayfield Drive (Toscano and Addition Office Building) DEQE $#242-
472 contingent on re-flagging of the wetlands. P. Tariot
seconded, motion carried.

Great Pond Estates - Litigation
Irene to send memo to Paul Sharon requesting approval from the
Board of Selectmen for Special Legal Funds to be used for the
continuing legal work by Ray Miyares on the Great Pond. Estates
litigation.
