Posting of the bond is at issue. Al, Irene and Town Treasurere will work on this issue. Submitted revised plan for crossing, with 630 s.f, less fill, also a construction sequence and schedule. W. Vicens motioned we accept the revised plans of SeptFI1988, the wetland replacement plan concept, and steps 1-4 count the construction schedule. L. Bruinooge seconded, r motion carried. ABC BUS -- Discussion Charlie Carrell came before the Commission to discuss his response to the letter sent by the Commission. Our letter itemized some work to be done in order to complete this file. It was decided that the Commission would make a site visit to see what is and isn't done. No vote taken. Lot 2 - Boxford Street - Public Hearin - Notice of intent Les Godin of Merrimack Engineering attended the meeting representing the owners Frank and Diane Buco. Proposal is to add a garage to the existing house, which involves relocation of the driveway. All work is in the buffer zone, and the closest work to the wetland is 35 feet. Proposed stone retaining wall to contain fill along relocated driveway. W. Vicens motioned we close the public hearing and issue an Order of Conditions on Lot 2 Boxford Street within 21 days. L. Bruinooge seconded, motion carried. q -- Public Hearing Lot 4A Coventry Lane -- Request for Determination.._ - Al Shaboo of Desing Engineering came before the Commission, representing the potential owner, Samuel J. Ameen. Lot 4 will become 4A (Form A Change) , The Order of Conditions for 242-324 indicates that no dwelling will be built within 100 feet of a wetland. The proposed . house is 82' from the wetland, which is unacceptable. W. Vicens motioned to continue the public hearing on Lot 4A Coventry Lane. L. Bruinooge seconded, motion carried. R .ti Page -2- Minutes of Meeting of October 12, 1988 Lot 1 Berry Street- PUhlic Hearing - Notice of Intent Dennis Cronin, Attorney, and Hayes Engineering came before the Commission. 'Phis project is to build Industrial Condominiums (Offices and storage space) . An Appeal on the site isstill pending. 8800 sq. ft of building is proposed near a large field on Berry Street. Access off Berry Street and from Lot 2 'Turnpike Street. Proposed filling of bordering vegetated wetland, also some land under water and bank. 1370 sq. ft. replacement, to be also used as a detention basin for runoff. Site was previously disturbed for agricultural use. Discussion of extent of bordering land subject to flooding on site. Buildings will be on septic systems. No dry sewer involved. Discussed drainage analysis. Willie requested a bottom profile of the ditch, as far as 125.8 contour location. Also, a SCS report on spreaders that were referred to during hearing as well as hydrologic calculations indicating that runoff would be contained on this. lot. Abutters expressed concern over downstream flooding. They used to skate on the field, before drainage ditch was dug. Nancy Hogan and John Hagerty were two abutters that came to the meeting. No vote was taken as the next item on the Agenda is also involved with this area. Lot 2 Turnpike - Public Hearin - Notice of Intent More office buildings proposed at this site by same applicant. Proposed bordering vegetated wetland filling, in several places, especially at driveway crossing. Propose connecting isolated land subject to flooding hydraulically to another wetland, letting it become bordering land subject to flooding, which would create approximately 2000 sq . ft. of bordering vegetated wetland. Engineer said lie would supply exact size of watershed. Proposed bordering vegetated wetland replacement in at least eight (8) places. Willie questioned the intensive use of land on this site and lack of buffering from wetlands. Lois mentioned the number of parking spaces seemed excessive. Jack inquired as to relocating the entrance to both projects, and requested alternative hydrologic information, such as whether runoff could be controlled with detention pond and not by a driveway dike (between two buildings) . Soil logs will be submitted. W. Vicens motioned to continue the public hearinv to two weeks from tonight on Lot 1 Berry% Street and Lot 2 Turnpike .contingent upon recelving the information requested by the 21st of October. B. Sousa seconded, moticnearried . ($45.00 will come in for the advertisement) . Lot 2AA Tucker Farms - Reg. for Determination - Public Hearin (Cont. fro€n 9/28/88) Lois Bruinooge motioned to issue a positive determination on Lot 2AA 'fucker farm. C. Schoene seconded, motion carried. Lot 28 Forest Street - Cert. of Compliance Fred Saraceno, the owner, attended the meeting. W. Vicens motioned that we issue a Partial Certificate of Compliance on Lot 28 Forest Street (#242-349) . Bill Sousa seconded, motion carried. If the bond posted on this file is no longer valid, Saraceno will have to post another bond before starting additional work on the site. Kenic.s - Certificate of Com liance There is a hold on the Certificate at this ti€ne, pending resolution of the wetland edge. The applicant will be asked to pull fill back, replace original hay bales, and erect construction fence. yJ Page -3- Minutes of Meeting of October 12, 1988 Lot 20 Forest Street -- Certificate of Compliance W. Vicens motioned to issue a Certificate of Compliance on Lot 20 Forest Street Lois Bruinooge seconded, motion carried. Lot 15 - Wintergreen Estates - Cert. of Compliance W. Vicens motioned to issue a Certificate of Compliance on Lot 15 Wintergreen (liouse li105) (Owner Wyn and Melody Palmer) L. Bruinooge seconded, motion carried. D.E.Q.F. #242-409 Lot 6B Patton Lane (House #80) - Certificate of Compliance W. Vicens motioned to issue a Certificate of Compliance on Lot 6B Patton Lane. L. Bruinooge seconded, motion carried. Lot 3 Libert Street - Cert. of Compliance The Commission stated they would reconsider this request after they receive an "As-Built" showing grades between house and wetland. Lot 7B Mill Road -- Certificate of Compliance W. Vicens motioned to deny a Certificate of Compliance at this time. There is a need to build an additional drainage structure at the base of drive, as shown on the plans. L. Bruinooge seconded, motion carried. Campbell Forest -- Discussion There has been an appeal pending since the issuance of a denial back in 1980. Joe Cushing of Kaminski Associates dropped off two volumes of a Final EIR. The project will be in the Monitor soon. Willie to review these. Becks Pond - Discu ssion ussion - DPW Buddy Cyr to receive a letter on this proposal to enlarge town drainage facilities. i A Notice of Intent will be required by NACC. R. r DPW/Sale Shed -- Discussion A letter to be sent to Buddy Cyr describing the distance of existing salt shed to i wetland and the fact the open design does not preclude contamination of wetland. New ! improved shed would benefit if its design would provide better containment. Buddy would have to submit either a Notice of Intent or Request for Determination on this as it is in the buffer zone. Also, after a site visit -- a better definition of the wetland edge is required as woodchips are now accumulating in that area. At the next meeting we will approve a Bank Book form and a Policy Statmient will be prepared. Put on next agenda (10/26/88) Election of Officers - Discussion ,Tack Lindon, our Chairman, will he leaving for a position in Chicago sometime before December 1st, as he stated to us this evening. Officers will be elected at a future meeting. Boston B rook - Issuance of Order of Conditions L.Bruinooge motioned to accept the Order of Conditions as amended on Boston Brook (D.E.Q.E. #242--455) Bill Sousa seconded, motion carired.
