BOARD OF SELECTMEN MINUTES January 27, 2020
CALL TO ORDER: Chairman Richard Vaillancourt called the meeting to order at 7:00PM in Meeting
Room at Town Hall.
ATTENDANCE: The following were present: Chairman Richard Vaillancourt, Clerk Rosemary Smedile,
Licensing Chairman, Regina Kean, Chris Nobile, Phil DeCologero, Town Manager, Melissa Murphy
Rodrigues, Deputy Town Manager, Denise Casey and Director of Administrative Services, Laurie Burzlaff.
PLEDGE OF ALLEGIANCE
PUBLIC COMMENT
Karen Lauro, 591 Massachusetts Avenue, encouraged the Board to adopt the code of conduct and
implement as outlined in the documents.
GOVERNMENTAL REPORTS
Introduction of Historical Society Executive Director, Brian Howard
Stan Limpert introduced to the Board the new Historical Society Executive Director, Brian Howard.
PUBLIC HEARING
National Grid/Verizon New England joint pole petition-Massachusetts Avenue/Chickering Road
The hearing was continued from the last meeting. The purpose of the hearing was to receive comments
regarding the joint pole petition from National Grid and Verizon New England to install one new pole and
relocate 10 others on Mass Ave/Chickering Road. The board asked for National Grid to provide a more
accurate plan, reposition pole at 591 Mass Ave, and address the questions regarding the guide wire at
615 Chickering Road and wire connections to the house.
Regina Kean made a MOTION, seconded by Chris Nobile to continue with the public hearing in
accordance with General Laws Ch. 166, Section 22, to receive comments regarding a joint pole
petition from National Grid and Verizon New England to install one new pole and relocate 10
others on Massachusetts Avenue and Chickering Road. Motion approved 5-0.
David Boucher from National Grid provided an updated plan where they are only requesting to move 6
poles. The other poles are under jurisdiction of MassDOT. Mr. Boucher explained that they are trying to
keep everything in the public right of way and the revised plan does that with the least impact on private
property. He explained the pole in front of 591 Mass Ave is being moved four feet.
Ms. Smedile asked if the pole could be placed on the corner lot that was taken. Mr. Boucher stated that
they did not like to run lines across private property because if a line went down, it would mean getting
equipment back there and it would not be easy. He also noted that the pole locations need to meet all
engineering requirements. Scott Kelloway from MassDOT stated that they have exhausted all options and
the current location is the most viable location for the pole.
Karen Lauro of 591 Massachusetts Avenue stated the project is significantly decreasing the value of her
house. Ms. Lauro suggested moving the pole to the lot line between her home and 12 Autran Avenue.
Mr. Boucher indicated it would require an anchor on private property and there would be no way to
service cable.
Regina Kean asked for all the options to be put in writing with an explanation as to why each is not
possible.
Regina Kean made a MOTION, seconded by Rosemary Smedile to continue the public hearing on
the joint pole petition of National Grid and Verizon New England to install one new pole and
relocate 10 others on Massachusetts Avenue and Chickering Road until February 10, 2020. Motion
approved 5-0.
APPROVAL OF MINUTES
Chris Nobile made a MOTION, seconded by Rosemary Smedile to approve the Open Session
Minutes of January 13, 2020. Motion approved 5-0.
CONSENT ITEMS
Accept donation from David Stroh to the fire department in the amount of $75.00
Accept grant in the amount of $7,117.00 from the Commonwealth of Massachusetts Department of Fire
Services to the Fire Department for student and senior fire education

Sign Warrant for primary on March 3, 2020
Rosemary Smedile made a MOTION, seconded by Phil DeCologero that the Board of Selectmen
approve all items listed under consent items. Motion approved 5-0.
NEW BUSINESS (continued)
Vote on National Grid/Verizon New England pole petition
The Board took no action on this matter.
Vote to adopt COSO Internal Control Framework and Code of Conduct for Town Employees
Town Manager Rodrigues asked the Board to table this matter until the next meeting when the auditors
will be present.
Accept and sign Conservation Restriction for Glennie Woodlot
The Conservation Commission signed the restriction and recommended the Board sign. This was a
property that was approved for purchase with CPC funding at Town Meeting.
Phil DeCologero made a MOTION, seconded by Regina Kean that the Board of Selectmen approve
and sign the Conservation Restriction with Essex County Greenbelt for the property at 0 Dale
Street (Glennie Woodlot), as presented and as authorized by the 2019 vote of Town Meeting, move
that the Board accept Essex County Greenbelt Assoctiation's $50,000.00 donation as a
contribution to the purchase price of the Glennie Woodlot and direct Greenbelt to pay the funds
to the escrow account as instructed by the closing instructions. Motion approved 5-0.
LICENSING COMMISSIONERS
Chris Nobile made a MOTION, seconded by Phil DeCologero to open a meeting of the North
Andover Licensing Commission. Motion approved 5-0.
Renewal of Entertainment License for Stevens Coolidge Place
As indicated at the last meeting, the Stevens Coolidge Place was not properly notified that their license
was only renewed for 30 days. Chairwoman Kean requested the Board extend the license for another 30
days to give representatives from the Stevens Coolidge Place time to meet with the neighbors and
address their concerns. Town Manager Rodrigues indicated that she has met with Katherine MacDonald
from the Stevens Coolidge Place, Katherine has reached out to the neighbors and they will be
brainstorming about ways to address the concerns.
Richard Vaillancourt made a MOTION, seconded by Chris Nobile that the Board of Selectmen,
acting as Licensing Commissioners, renew the Entertainment License for the Stevens Coolidge
place through March 2, 2020. Motion approved 5-0.
Request of Bertucci’s Restaurants, LLC d/b/a Bertucci’s at 435 Andover Street for a change of manager
Chris Nobile made a MOTION, seconded by Rosemary Smedile that the Board of Selectmen,
acting as Licensing Commissioners, approve the request of Bertucci’s Restaurant, LLC d/b/a
Bertucci’s at 435 Andover Street for a change of manager, as presented. Motion approved 5-0.
Richard Vaillancourt made a MOTION, seconded by Rosemary Smedile to close the meeting of the
North Andover Licensing Commission. Motion approved 5-0.
OLD BUSINESS
None
TOWN MANAGERS REPORT
The Board was provided with the job posting/vacancy log.

Town Manager Rodrigues stated she will be having office hours on February 4. Trudy Reid, the new
Town Clerk will be joining her.
Ms. Rodrigues indicated that she has worked with the schools and was able to meet their needs for this
year and will continue to work with the Superintendent to address future years.
SELECTMEN’S UPDATES/COMMENTS
Phil DeCologero asked about the sidewalks on Route 125 and who is responsible for plowing them.
Rosemary Smedile stated that the City of Salem has adopted a tree program and suggested the Town
look at how they are doing it.

Town Manager Rodrigues indicated she would look into both matters and report back to the Board.

Chris Nobile made a MOTION, seconded by Rosemary Smedile to adjourn the meeting at 8:00PM.
Motion approved 5-0.
