'rhea status Inquivy applies to the Bond on Barker Utreet which has
expired and a renewal needs to take place. P. Tariof will be
working on this project, in the form of a letter to Travelers
Tndeminity. No vote wass3 taken. Carl bchoene to cheek this area.

Steve Stepinski of Merrimac Engineering representing Houston
Builder% appeared before the Commission and pre%ented plans. p
portion of they duplex on Lot 2 is within the 100 year flood od plain
of the Shawssheen fiver. The foundations for these buildings
would have to be of impervious building material. NACC received
a letter from the 'TownO w Building Kspectcr, Robert Nicetta
rotating his disapproval of any construction at this site.
However, if the Commission deems that construction is permissible
them new plans would have to be required showing special
foundation material to sustain flooding of the area, prior to the
issuance of a Building Permit. Abutters present at this meeting
were Joseph Palaci, John Rafffer, Lewis Napling, Mike Phelan anti
Peter Solemi. L. Bruinooge motioned we close the public hearing
with the request that a latter stating flagging and staking of
the wetlands ham taken place, we will then issue an Order of
Conditions within 21 days. P. Tariot seconded, motion carried.

John Willis Jr. , attended the meeting with an up--date: on how this
project was progressing. HSC was called in by Planning for a
drainage review, the outcome of the report was a modification on
this area. We will put this on our next agenda of Feb. 15, 1989.
No vote taken.

L. Bruinooge motioned that if we did not rec;eive an extension
request for the Urder of Conditions by February 7th under the
:Mate Act and Town Bylaw, they project would be denied. P. Trariot
seconded, motion carried.

Discussion took plaace by W. Vicenn and the Commissioners on the
pros and cons of the sites in question. Xf was finally decided
that a letter to William Brush of the School Building Committee
stating the pooit ion of the Commission. B. Sousa motioned ioned to
approve they letter to William Brush as amended. C. Schoene
seconded, motion carried. P. 'Tariot abstained.
