Minutes of NACC meeting of March 29, 1989

Gen Usgood Jr. , attended the meeting and spoke about the bortid
issue on the pines. P. Tariot motioned to approve on behalf of
the NACC, if it meets the authorization and the criteria of the
Town Counsel.. B. Sousa seconded, motion carried.

There are sixty-one acres involved in this project. Jim Wick
representing Amoskeag Development Corporation attended the
meeting, p'. Tariot, with several others made an on-site visit,
explained to Mr. Wick their findings. Many wet areas are on this
site. It. was muggeated that a topographic map of this area be
presented facer study. P. Tariot motioned to vote to rescind the-
Positive Determination dated March 19 19891 and re-open the
public hearing as the applicant wishes. W. Sousa %or- ended,
motion carried. (Letter of Guidance to be attached. )
Debbie Moore made a site visit and informed the Commission that
the hay bales, leach field and septic system were further away
from the buffer zone than previously thought. D. Moores motioned
that we issue a Negative Determination with conditions that; the
hay bale% be put in as per plans and that refuse be disposed of
far away from the wetlands. P. 'Tariot seconded, motion carried.
P. Tar^i of motioned we i swum a Certificate of Compliance on Lot 19
Lacy Street. D. Moore abstained. W. Sousa seconded, motion
carried.

W. Sousa motioned we ratify the Enforcement Order on Lot :1
Covontry Lane. C. 9choone seconded, motion carried.

C. Gchoene motioned we issue a Partial Certificate of Compliance
on Lot 19 Granville Lane. P. Tar i of seconded, motion carried.

on Lot 30 Granville Lane. P. Tariot secondad, motion carried.

A letter was received from the Middleton Conservation commission
as a great deal of this project is located in Middleton.
Discussion took place and it was agreed that a Modification on
this area would be issued. A letter would be written, stating we
would not accept the septic system as presently shown on plan.

Chris Nelsoon of Nelson Engineering of Concorc17 Mass came before
the Commission and explained the plans. The septic system is
outwide the buffer zone on all three lots.

Chris stated that they would try to minimize the impact on
wat lands. P. Tariot motioned to issue a Negative Determination
with Conditions on Lot a, with the stipulation that a row of hay
bales be placed and inspected by our Administrator. P. Tariot
motioned to issue a Positive Determination on lots 4 and 3 to be
mailed if revised plan is not submitted prior to April 12th, and
to continue the public hearing if the plan is submitted. B.

Maureen Sakakeeney of Edwards & Kelcey attended the meeting. The
main request was for more information to supplement the Notice of
Intent. We have a series of plans from Edwards & Kelcey,
engineers for the Lawrence Municipal Airport Commission which
show us as bit of the area that was disturbed. (Culvert that
flowed into a swale and then into the wetland. ) Much discussion
took place from the plans. P. Tariot motioned we close the
public hearing and issue A decision within twenty-one (21 ) days.

Richard and Debbie will take a look at this project. The
Commission requested an extension of ten days. We Sousa motioned
to reopen the public hearing in two weeks and issue an Order of
Conditions in four weeks. D. Moore seconded, motion carried.
A Violation Notice will be sent to the new owners at Lot 5
Sharpners Pond Road.
Public access to as flowage easement in Harold Parker State
Forest. DCPU request as public hearing on whether or not a public
access to a flowage easement in the vicinity of the Harold Parker

State Forest. The Town of Danvers is looking to build a
reservoir and this easement access is involved. In 1987 the
State;' gave eminent domain power to the Town of Danvers to Lake
private property from Middleton, .and possibly North Andover.
Cutting ing of trees in Sudden Pond area. W. Sousa motioned that we
held a public hearing. D. Moore faeconded, motion carried.

W. Sousa motioned that we approve the draft Order of Conditions
0242/490 for Great Pond Road and Stevens Street. P. Tar i of
seconded, motion carried.
Lot 8 (which was inadvertently left out of the Order of
Conditions 0242/488) will now go as a Modification. W. Sousa �
seconded, motion carried.

A. Rosca motioned that Paul Tarigat he the new Chairman and
relieve Guillermo J. Vicens of the responsibility of this
position. William Sousa was nominated as Vice-Chairman. C.
S hoene seconded, motion carried.

A meeting took place with Debbie Moore, Richard Doucette, Phil
DiPieatro representing D. [;_. U. E. , Davey Minicucei, Phil Christiansen
of Christiansen Engineering, and Curt Young of Wetlands
Preservation all in attendance. The meeting was held at the
site, and duet to inclement weather continued in the Town Hall. A
letter will be coming in in about two months with the DEUEm �
decision.
