W. Vicens motioned to extend the Order of Condit ions for one

Rober^t Nicetta, Buildinrn Inspector, re3ported to the NAGG in
February that a piece of heavy equipment was working in a stream
close to Lake Cochichewick. An Enforcement Order was issued by
Karen Nelson and Robert Nicetta to iramediately stop work and
attend the Corrsroission' s next meeting. W. Sousa has written to
them explaining what to do to stabilize the area.

No decision on compliance. NACC awaiting information previously
requested from Osgood Assoc. , regarding past filing of adjacent �

was taken.
W. V i cans motioned we issue a Certificate of Compliance on
Kenics. W. Sousa seconded, motion ion varried.
' The Enforcement Order was issued due to a lack of required
erosion controls, issued July 22, 1988. Conditions no. 13, 16
and 19. (On June r2l sst 1989 NACC rrseet i ng the Modification was
read. Mr. E yal, the owner, plans to building a retaininr.I wall
along a portion of his lot, plans dated June 21, 1989.

John Barrows of R. A. M. Engineering came before the Commission and
presented plans. Veron i ca Maridry, an abutter presented her
problems Tess the grading on slopes near her, homes. Plaris dated
/8/89. Fay and .Joey Averka spoke about controlling the flow of
water. Hell Shalla also spoke. W. Viceris motioned we close the
public hearing on South Cross and issue an Order of Conditions
within 21 days. H. Sousa seconded, notion carried.

Mr. Tarkulich the owner, attended this meet trig, as didJohn
Harrows. Debbie Moors did the preliminary work on this file. An
addition to an already existing porch. No grading to take place.
There is a 15 to 20 foot drop. W. V i cens motioned we issue a
Negative Determination on Lot s Winter Street with Conditions
that rio grading work be performed and that all digging be done by
hand. No hay bales needed. D. Moore seconded, motion carried.

Vincent Turano and ,Joe C:ristaldi attended the meeting and
presented their plans. The NACaC requested a final grading plan
be submitted for their approval. W. Viceri s motioned we continued
the public; hearing to April 19, 1989. P. Tariot seconded, motion
Carried.

Owners, Walter and Gail E''nsdorf presented two Req .test for^
Determinat ion. One RFD was for a filling of about 2, 000 square
feet of slope, which will provide additional lawn. The other Is
to add an additional deck to the house,. 'There'~ is an iritermittent
stream on site. W. Viaens motioned to issue a Negative
Determination on both fi 1 inga, with Condit ions i that a double row
of staked hay bales be placed between^, the activity and wetlands,
to be inspected and approved by the Administrator prior to start
of construction. D. Moore seconded, motion carried.

This area is located ac.rossas from Elm Square Industrial
Deve l tz-opment around the North Atlantic Recycling Company. It is
approximately 71 acres with plans for housing unitta. The
Coi-iimission wanted to make sure that the hydrologic connections
wiere mentioned. (Water connection on land which goes through a
rocky area) . and that this become part of the plan or j
determinat ion. W. Viceans mot ioneyd that we Issues a Positive

Determination with a latter specifying the wetlands resource
areas by the 19th of April. D. Moore seconded, motion carried.
Revised plans were ,approved. phase 1 of construction has been
completed. Condition # 46 of the Order of Conditions which states
the Applicant may propose the bond release schedule with specific
completion of portions of the project. A site visit will be
mace. A letter will be coming from Al Shaboo. Itemizing work
completed and work remaining.

Tay Willis, Esq. as well as Al Shaboo attended the meeting to up-
date the Commission A public hearing on this project will be on
the 19th of April.
