Minutes of May 24 , 1989 Conservation Commission Meeting

MINUTES
W. Vicens motion to accept the amended minutes of January 18,
1989. B. Sousa seconded, motion carried.
REGULATIONS
Discussion of the Regulations and Fees, policies and guidelines
The decision was that Willie would draft a new fee schedule for
our next meeting, July 5th, and until then we would keep our
existing fees.
LOT 2 NORTH CROSS ROAD - CARLTON FARMS EAST
RDA -- PUBLIC HEARING
The owner, Mr. LaPrete came before the Commission and presented
his request for an extension until June 2nd. It was requested by
the Commission that he stake the house. W. Vicens motioned to
empower the site visit team to make a decision on Lot 2 North
Cross Road (Frances Estates) by June 2 , 1989. B. Sousa seconded,
motion carried.
LOT 35 STAGECOACH ROAD
RDA - PUBLIC HEARING
(The Pines) W. Vicens motioned to empower the site visit team to
make a decision on Lot 35 Stagecoach Road. B. Sousa seconded.
Motion carried. Marty Hanley an abutter attended the meeting.
LOT 2 LIBERTY STREET
RDA - PUBLIC HEARING
A proposed house and driveway are within the buffer zone. W.
Vicens motioned to have the site visit team to make a decision on
Lot 2 Liberty Street. B. Sousa seconded, motion carried. It was
suggested by the Commission to have the center line of the
driveway staked.
42-49 WESLEY STREET
CERTIFICATE OF COMPLIANCE
The Buco's are the owner of a house at 42-49 Wesley Street. W.
Vicens motioned that we issue a Certificate of Compliance on 242-
275. B. Mansour seconded, motion carried.
RIPARIAN REALTY TRUST - BERRY STREET & TURNPIKE STREET
DISCUSSION
The re-filing of a Notice of Intent was discussed. The following
three issues were discussed: 1. Bordering Vegetated Wetland.
2 . The no-cut zone. 3 . Land subject to flooding. No vote taken.
LOTS 31. 32 & 33 ABBOTT STREET
REQUEST TO REMOVE LOT 33 FROM NOI
It was explained by Ben Osgood Jr. , that Lot 33 was far from any
wetlands. It was decided that a site visit for Lot 33 would take
place in order to make this decision. A Decision would be
drafted by June 7th. No vote taken.
BUTCHER BOY MALL
DISCUSSION
This was a discussion regarding a filing of a new Notice of
Intent. The previous filing had been denied by the Commission.
Mr. Caffrey, the attorney for Mr. Yameen came before the
Commission to discuss some of the suggestions in the denial. Mr.
Bartholmes presented revised plans. After some discussion it was
decided that a new Notice of Intent would be filed. No vote was
taken. NOTE: We will be notifying the State DPW of this public
hearing on Butcher Boy.
COVENTRY II - NEW CASTLE
DISCUSSION
Vincent Turano came before the Commission and presented the plans
for Lots 56, 581 62 , 64 . W.Vicens motioned we accept the plans
on these lots. B. Sousa seconded, motion carried. Work on Lot 1 i
was also discussed. Wille motioned to ammend condition #5 of OOC
#242-385. Bob Mansour seconded. Motion carried. Discussion took
place regarding the 100 foot jurisdiction around land subject to
flooding.
LOT B GREAT POND ROAD
EXTENSION
The Orders of Conditions had expired in April of 1988, but has
been in litigation since 1985. W. Vicens motioned we issue an
extension of Order of Conditions #242-260 from April 1988 to June
1, 1990. B. Sousa seconded, motion carried.
OLD CART WAY
EXTENSION
W. Vicens motioned that we extend the Order of Conditions on 242-
269 for one year with the proper bond in place. B. Sousa
seconded, motion carried.
DAVIS & FURBER
Discussion of drainage problems took place. A new Notice of
Intent will be presented. No vote taken. It was requested by
the Commission that a letter be sent to us withdrawing the
previous filing #242-397 .
DEERFIELD LANE
EXTENSION
W. Vicens motioned we extend the Order of Conditions on 242-348
from June 18, 1989 to June 181 1990. Carl Schoene seconded, A.
Resca opposed, motion carried.
HICKORY HILL
i DISCUSSION
Discussion of a letter received from Hayes Engineering by Carl
Balson took place. A new site plan was shown. No vote was
taken.
LOT 3 SALEM STREET
BOND REDUCTION
The homeowner seeks release of some funds to fund the completion
of the project. Work has not progressed far enough to release
any funds at this time. R. Doucette has visited the site and
work has not been done in accordance with the OOC. B. Mansour
motioned to deny the request for bond reduction. B. Sousa
seconded, motion carried.
ORDERS OF CONDITIONS ISSUED 5 24 89
W. Vicens motioned to accept the Order of Conditions (Denial) on
#242-498 . 140 Willow Street, Lot 9 North Andover Business Park.
B. Sousa seconded, motion carried.
W. Vicens motioned we accept the amended Order of Conditions as
amended on South Cross Road (No DEQE # assigned) . B. Sousa
seconded, motion carried.
W. Vicens motioned we accept the Order of Conditions as amended
on English Circle #242-497 . B. Sousa seconded, motion carried.
W. Vicens motioned we issue an Order of Conditions as amended on
Boston Ski Hill #242-500. B. Sousa seconded, motion carried.
B. Sousa motioned we accept the Notice of Non-Significance on
Route 125 (#242-499) . W. Vicens seconded, motion carried.
