NORTH ANDOVER BOARD OF HEALTH ORDER TO CORRECT
Issued under the provisions set forth in Massachusetts General Laws Chapter 111 Section 122

Dear Homeowner,
A letter was sent to you in November regarding a sewer cleanout servicing your
property that was backing up and overflowing onto the land between 345 Abbott St and 353
Abbott St.This letter also contained a drawing from the Department of Public Works showing
the sewer line containing the cleanout coming from your house.The letter asked for you to have
a licensed drain or sewer company come out and resolve the issue at hand.A recent inspection
noted that the sewer cleanout is still not fixed.
You are hereby ORDERED to correct the violations within 15 days of receipt of this
letter. Failure to comply with the specified time period will result in a fine of up to$1,000 per
day in accordance with Massachusetts General Law,Chapter 111,Section 122,as well as other
enforcement actions.This fine will continue to accrue until the subject property is brought into
compliance with this Order to Correct. Each day or portion thereof during which the violations
continue shall constitute a separate offense.
Once completed,a receipt of the work completed must be submitted to the North
Andover Health Department. On receiving the receipt for work completed,a re-inspection will
occur to ensure the issue had been fixed.
You have the right to request a hearing before the Board of Health if you feel this Order
to Correct should be modified or withdrawn. A request for said hearing must be made in
writing and received by the Health Department within seven(7) days from receipt of this
Order. At said hearing you will be given an opportunity to be heard and to present witnesses
and documentary evidence as to why this Order should be modified or withdrawn. All affected
parties will be informed of the date,time and place of the hearing and of their right to inspect
and copy all records concerning the matter to be heard. You may be represented by an
attorney. You have a right to inspect and obtain copies of all relevant records concerning the
matter to be heard.
