HomeMy WebLinkAbout2002-01-09 Conservation Commission Minutes' f - Conservation NACC Minutes Senior Center North Andover 1/9/02 Members Present: Scott Masse, Chairman, Albert Manzi, Jr., Vice Chairman, Joseph Lynch, Jr., Beth Wescott, John Mabon and Robert Cerchione, Associate. Staff Present: Richard Paquette, Jr., Conservation Administrator and Linda Magee, Secretary Members Absent: Deborah Feltovic, Robert Mansour and James Demotses, Associates. The meeting was called to order at 7:10 P.M. Minutes under review Quit Claim Deed for Salem Forest IV NACC signatures required General Business: 242-991 - Bond Reduction Request 140 Willow St. (Dogleg Realty Trust) (West Envir.) Applicant, Steve Webster and Wetland Scientist, Mark West, were seeking a $25K Bond reduction for the intensive shrub planting in the wetland replication area. Mr. Paquette stated he had visited the site and was satisfied with the plantings. Steve Webster stated they would put $5K aside for future management and stabilization of the plantings. Mark West explained that the shrubs they planted were 3 to 4 feet to give them a head start to shade out the purple loosestrife and the additional plantings this fall will compete with the invasive species. Mr. Lynch questioned if the shrubs could actually compete with the purple loosestrife. Mark West stated that the percent dominance of purple loosestrife has been reduced from 86%to 60% with these plantings and will continue to aid in the reduction of purple loosestrife in the years to come,plus the shrubs grow fast. Mr. West stated the wetland replication area has 160 shrubs growing now and that white pines and ashes had been planted also to help with the shading effect. Mr. West added that wetland replication monitoring will continue through next year's growing season. 4Mr. Manzi asked Mr. West for a maintenance breakdown, hourly, specifically an average wetland scientist hourly pay. Mr. Manzi stated he was trying to adequately insure the performance of shrub plantings. Mr. Paquette stated his concerns to the NACC to address the wetland replication area size while calculating the reduction figure. Mr. Paquette continued stating his concern with a discrepancy of the proposed wetland replication area depicted on the As-Built. Mr. Paquette stated that the Order of Conditions calls for 14,985 s.f of wetland replication and the As-Buit depicts 14,395 s.f, leaving a difference of 590 s.f. Mr. Webster stated that on the amended Order of Conditions 431 explained the difference. Mr. Paquette stated that this only showed 324 s.f. Mr. Masse stated that a Modification to the Order of Conditions should be done to clear up any issues with the wetland replication size difference before the Applicant would be able to seek a Cretifcate of Compliance. On a motion by Mr. Manzi seconded by Mr. Mabon, the NACC voted 3 to 2 to approve and 1 abstain, to release $14, 970.00 and hold back$15K Bond Reduction Request as drafted. 242-158 - PCOC (administrative) 207 Bear Hill lot 17A (Designer Homes by Zachary & Thomas W. Callahan) Mr. Paquette stated there were no wetland filings and he had no issues with the project. He recommended the NACC issue a Partial Certificate of Compliance. On a motion by Mr. Manzi, seconded by Mr. Mabon, the NACC voted unanimously to grant the Partial Certificate of Compliance as drafted. 242-461 - PCOC (administrative) 45 Sugarcane Ln. /Jerad Pl. (Robert Januz) Mr. Paquette stated there were no wetland filings and lie had no issues with the project. He recommended the NACC issue a Partial Certificate of Compliance. On a motion by Mr. Manzi, seconded by Mr. Mabon, the NACC voted unanimously to grant the Partial Certificate of Compliance as drafted. 242-792 - PCOC Request Lot IA (Woodlea Estates) (Ashwood Co.) Mr. Paquette stated he had no fiirther issues with the project and recommended the NACC issue a Partial Certificate of Compliance. On a motion by Mr. Manzi, seconded by Mr. Mabon, the NACC voted unanimously to grant the Partial Certificate of Compliance as drafted. 242-896 - OOC Extension Request 285 Summer St. (Lemonias Devel. Co.) Mr. Paquette noted this was the 2°d Extension on this project. Mr. Paquette stated he had no issues with the project and recommended the NACC issue an Extension. On a motion by Mr. Manzi, seconded by Mr. Mabon, the NACC voted unanimously to grant the Extension to the Order of Conditions as drafted. 8:00 P.M. Notice of Intent(s) 242-1099 - Rte. 114 Turnpike St. (Mesiti Devel) (Marchionda) Representative, Paul Marchionda requested a continuance to 2/13/02. On a motion by Mr. Lynch, seconded by Mr. Manzi, the NACC voted unanimously to continue to 2/13/02. 242-1058 - Lot 13 Nutmeg Lane-map 38 parcel 284 (No. Andover Land Corp.) (B.Osgood, Jr.) Representative, Ben Osgood Jr., submitted new plans depicting a stone wall instead of wood. Mr. Lynch asked if he had exhausted all reasonable alternatives. Mr. Osgood stated that he had, and if he proved the garage it would make the house much smaller. Paquette was satisfied with the revised plans and supporting information submitted by Mr. Osgood. On a motion by Mr. Mabon, seconded by Mr. Lynch, the commission voted unanimously to close the public hearing and issue a decision within 21 days. 242-1111 _ 200 Chickering Rd. (Terra Properties) (Merrimack Eng) This NOI is currently undergoing stormwater review. Mr. Masse and Mr. Manzi want it stated for the record that they maintain no involvement in this public hearing. On a motion by Mr. Lynch, seconded by Mr. Mabon, the NACC voted unanimously to continue to 1/23/02. 242-1065 - Boxford St. 104D Town of North Andover (Ben Gary) Mr. Paquette stated the test pit results were favorable and that the project was in compliance with all setbacks. No Abutters comments. On a motion by Mr. Mabon, seconded by Mr. Manzi, the commission voted unanimously to close the public hearing and issue a decision within 21 days. 242-1115 - Maritimes &Northeast Pipeline, LLC (TRC Environmental) Mr. Masse stated that the Conservation Administrator, Richard Paquette has a conflict of interest with this project and has set up a 3`d party review with Seekamp Environmental Consulting and with regards to the NACC there will be no comment this evening. Representative Jon Bonsall (legal advisor)presented a slide show of construction procedures and the permitting process. Representative Michael Lychwala (Senior Wetland Ecologist) continued with a presented slide show of the project description and environmental issues. The slides had pictures and verbal descriptions of construction procedures and proposed impact mitigation and minimization measures. Mr. Lychwala stated that all personnel are trained in Conservation and environmental issues and monitoring for the wetlands was required for 3 years. Abutter Larry Flynn inquired about details on the approach and impact to the abutter. A representative from Maritimes & Northeast met with Mr. Flynn off to the side to answer his questions in detail. Mr. Manzi inquired if the NACC had any jurisdiction over this project. Mr. Jon Bonsai stated that the track r record of Maritimes &Northeast is to work closely with the NACC and will address concerns, but the NACC cannot delay or interfere with the project. An Abutter questioned well water impact. Mr. Lychwala stated within 250 ft. of the project Maritimes &Northeast will do blasting tests with the abutter's approval. On a motion by Mr. Lynch, seconded by Mr. Manzi, the NACC voted unanimously to continue to 1/23/02. 242-1116 - Lot 16 Fernview Ave./Rte. 125 Heritage Green Condominium Trust (Karen Sorkin) (Neve Assoc.) Representative John Morin submitted plans 242-1114 - Meetinghouse Commons, LLC Dale/S. Bradford St. (Epsilon Assoc.) Mr. Masse stated that the Conservation Administrator, Richard Paquette has a conflict of interest with this project and has set up a aid party review with Seekamp Environmental Consulting and with regards to the NACC there will be no comment this evening. Decisions 242-1065 - Boxford St. 104D Town of North Andover(Ben Gary) Mr. Paquette suggested bond to be set at $5K. Mr. Lynch stated that because it was the maintenance of two fields it should be increased to $1 OK. Mr. Lynch stated that individual teams need to police their clean-up. Mr. Cerchione suggested a fence, but the rest of the board agreed it traps liter and is not aesthetically pleasing. Mr. Masse said Ire wants the Applicant to submit an O&M Plan for trash, outhouses, etc. and incorporate it as a pre-construction condition, then, as an ongoing condition to maintain it. On a motion by Mr. Lynch, seconded by Mr. Mabon, the NACC voted unanimously to approve the Order of Conditions as drafted and amended. On a motion by Mr. Lynch seconded by Ms. Wescott, the commission voted unanimously to adjourn.
