Mabon Sean F. McDonough Board Members Absent: Deborah Feltovic Albert Manzi,Jr., Vice Chairman Beth Wescott Staff Members Present: Julie Parrino, Conservation Administrator Alison McKay, Conservation Associate Donna Wedge, Secretary 7:30 pm Quorum was met. No General Business Recess for 15 min Reconvened at 7:45 pm DEP# 242-1168 127 Bridle Path (Chatson)((WPI)(Decision) Motion by Joseph Lynch to sign the decision with the condition that the bond should be set in the amount of $13,000 and the replication time frame will be plantings in the spring with continuing monitoring to the year 2004 before applicants will be in compliance, seconded by John Mabon. Vote: Unanimous. Recess for 7 min. Public Hearings 8:00 pm DEP#242-1162- 10 Commerce Way Grasso Hancock Environmental Ms. Parrino has left the room due to a conflict of interest. Jim Comeau from Hancock Engineering was present at the meeting. Joseph Lynch stated the parking area is a concern for papers and trash blowing around and he suggested a chain link fence be installed to protect the 25 feet No-Disturbance Zone area on the west side of the driveway. Jim Comeau stated shrub plantings have been requested by Natural Heritage to the rear of the building, adjacent to the wetland resource area. Jim Comeau stated DEP#242-1173- 169 Gray Street (Murphy) (Hancock Environmental) The applicant or a representative was not present for the hearing. Ms. Parrino left the room due to a conflict of interest. Alison McKay stated she had no communication with the applicants or Hancock Environmental. Scott Masse stated he wants to have abutters re-notified and the public hearing re-advertised. Motion with requirement to re-notify the abutters and to re-advertise and continue the hearing until December 18, 2002 meeting was made by Scott Masse, seconded by John J. Mabon, Vote: Unanimous. DEP#242-1174- Lot 4 Waverly Road (Highview LM(Seekamp Environmental Laurie Powers from Seekamp Environmental was present at the meeting. Joseph Lynch read the legal ads together for Lot 4 &Lot 5. Development on both lots was discussed simultaneously. Laurie Powers stated the two duplexes on Lot 4 are 100 feet from the boundary of the wetland area. Development of Lot 5 will be located within the buffer zone to BVW. In June of 2002, the applicants filed an RDA for confirmation of the wetland resource areas on the site. The ditch identified on the site was determined to have been abandoned and did not contain hydric soils. Ms. Parrino stated she conducted a site visit with Michael Seekamp in June of 2002 to review the wetland resource areas. Neighbors raised concerns about the flow of water in the ditch on the site. Joseph Lynch stated that conservation commission could regulate the run-off of the water on the property. Joseph Lynch stated he had concerns regarding the grading associated with driveway. Grading from elevation 62 feet down to 42 feet will produce high water velocity rates along the long driveways and an infiltration trench Swale may be required to infiltrate the water. Mr. Lynch stated a binder should be placed on the driveway upon grading completion. John J. Mabon stated there are steep slopes associated with the driveway grading. Laurie Powers stated silt fence backed by hay bales will be on the site. Hydro Seeding and jute matting along the slopes should be required. Chris Waszczuk of 26 Hathorne Place stated his concerns with the project. He is the property owner to the rear and is concerned about the runoff from the driveways. He also stated his concerns regarding to 2:1 side slope grading associated with the driveway. He questioned the zoning regulations in regards to multi-family zoning, street frontage and setback requirement. He expressed his concerns about the future development of Marengo Street, which is an undeveloped paper street. He feels abutters have fee rights to the paper street and would like the road to be constructed to town road standards. Abutters felt they had rights to the paper street and their permission was not sought for the development of the road. Scott Masse would like this issue further investigated and would like Mr. Waszczuk to submit a legal opinion from an attorney. Mr. Waszczuk presented for review, record plans from the registry of deeds to the Commission. Scott Masse requested that Mr. Waszczuk submit a copy of the plans to the Board. Mr. Waszczuk raised concerns about the historic wetland line and the differences in the topography of the land as shown on the old and new plan. Ronald Thorne from 20 Hathorne Place expressed his concerns about erosion controls and drainage and he is against the subdivision. Abutter, Paula Carl, from 32 Hathorne Place raised concerns about wildlife habitat and the conservation land behind her property. Joseph Lynch requested that Merrimack Engineering be present at the next hearing. Motion to continue to November 20, 2002 meeting, by Joseph Lynch, seconded by John J. Mabon. Vote: Unanimous.
