Mabon Staff'Members Present: Julie Parrino, Conservation Administrator Donna Wedge, Secretary Staff Members Absent: Alison McKay Meeting came to order at 7:05pm Quorum met. General Business 7:05pm. _DEP#242-1106, COC, 190 Farnum Street (Battalagine) Ben Osgood, Jr. was present at the meeting. Ms. Parrino stated there was an Order Of Conditions issued for the replacement of a subsurface sewage disposal system on 12/12/01. Work is completed and in compliance. Ms. Parrino stated she received a certification letter and an as-built plan. Motion to issue COC by Joseph Lynch, seconded by Albert Manzi. Vote: Unanimous. D_EP#242-1101, COC, 2170 Turnpike Street (Balboni) Ben Osgood Jr., was present at the meeting. Ms. Parrino stated the Order of Conditions was issued on 9/5/01 for construction of a replacement septic system within the buffer zone. Ms. Parrino stated work has been completed in compliance with the Order and the area where work was conducted is completely stabilized. Motion to issue CDC by Joseph Lynch, seconded by Albert Manzi. Vote: Unanimous. DEP#242-1148,Bond Reduction, 895_Forest Street(Simonson) Applicant was not present at the meeting. Applicant requesting a $2,000 bond reduction from a posted bond of$3,000. Ms. Parrino stated the restoration plantings were planted in September and the boulder wall is half completed. The applicant substituted hathorne plantings with a boulder wall. Albert Manzi stated the plantings have not been planted long enough to allow for a bond reduction and would like to wait until September 2003 before considering a bond reduction. Scott Masse stated his concerns about the " survivability of the plants and whether the remaining bond would cover the cost of replanting. Albert Manzi stated this was a big violation and a fine was not levied on the applicant. Joseph Lynch questioned if Peter Simonson is cooperating with the Conservation Commission requirements. Ms. Parrino stated Mr. Simonson has been cooperative since the discovery of the violation. Motion to issue bond reduction of $1,000.00, by Joseph Lynch, seconded by Deborah Feltovic. Discussion followed. Albert Manzi stated the plantings are not even one year old yet. Motion failed. Motion to deny bond reduction by Scott Masse, seconded by Deborah Feltovic. Vote: Unanimous. Recess for 20min. Public Hearings 8:00pm. DEP#242-1162- 10 Commerce way (Grasso)(Hancock Enviiromentai) No one present at the meeting. Ms. Parrino stated the applicant is reviewing the letter submitted by Lisa Eggleston and have requested a continuance to the December 18, 2002, meeting. Motion to continue to December 18, 2002, meeting by Joseph Lynch seconded, by Albert Manzi. Vote: Unanimous. DEP#242-1174 Lot 4 Waverly Road Hi hview LLC)(Seekamp Environmental Ms. Parrino stated the abutter Chris Waczuk has submitted a letter written to Robert Nicetta, Building Inspector, and a letter from his lawyer. The applicant requested a continuance to December 18, 2002, meeting in order to address topo issue and legal issues. Motion to continue to December 18, 2002 meeting, by Albert Manzi, seconded by Joseph Lynch. Vote: Unanimous. DEP#242-1175 Lot 5 Waverh Road Hi hview LLO(Seekaralft Environmental Ms. Parrino stated the abutter Chris Waczuk has submitted a letter written to Robert Nicetta, Building Inspector, and a letter from his lawyer. The applicant has requested a continuance to December 18, 2002 meeting in order to revise plans and address topo issue and legal issues. Motion to continue to December 18, 2002 meeting, by Albert Manzi seconded by Joseph Lynch. Vote: Unanimous. DEP#242-1177 29 Johnnycake Street DelPa io Neve Greg Hogmuth from Neve Associates was present at the meeting. Sean McDonough read the Legal Ad into the record. Mr. Hogmuth from Neve Associates stated the applicant will be building a three season room where the existing deck is now. The deck will be removed and the three season room will replace the deck. Mr. Hogmuth stated the structure will be 55 feet from the wetland area. Mr. Hogmuth stated they have not heard from Natural Heritage and it has been 30 days. Ms. Parrino stated there was previous disturbance in the location of the proposed structure. Ms. Parrino stated all flags have been reviewed and approved with the exception of flag 101 which conflicts with a previously approved delineation conducted on the abutting property. Ms. Parrino also stated the erosion controls should be extended. Ms. Parrino stated previous filing DEP#242-876 permitted the septic system replacement on the property and the project received a Certificate of Compliance. . Motion to continue to December 18, 2002 meeting, by Albert Manzi, seconded by Deborah Feltovic. Vote: Unanimous. DEP#242-1178, 83 Lost Pond Road-(Madden) (Giles) Mr. Frank Giles was present at the meeting. Sean McDonough read the Legal Ad into the record. Frank Giles stated the work being proposed is 85 feet for the wetland line. Ms. Parrino stated she approved the flagged area but the area must be re-flagged as the flagging is old and torn. Frank Giles stated the area under the three season room will be converted into basement living space and will have a foundation. Ms. Parrino stated work will be located in a previously disturbed area. Grass clippings were identified in and along the 25 foot No-Disturbance Area. Ms. Parrino stated the house development was approved under a previous subdivision filing. Motion to close and issue decision in 21 days by Deborah Feltovic, seconded by Albert Manzi. Vote: Unanimous, DEP#242-1169-2357 Turnpike Street (Valley Really Trust) (West Environmental) Gerry Lynn Darcy, Lisa Eggleston, Steven Trettel, and Mark West were present at the meeting. Steven Trettel submitted a letter and a drainage report on for the 182 acre watershed for the site. Mr. Trettel presented topographich map of the site, boundary and watershed. Steve Trettel stated the site is filled with concrete and rubble, with lots of fill in the wetland area. Steve Trettel presented an overview of the analysis conducted of the conditions that would result on site if no detention was provided. He reviewed peak flows for pre and post development and discussed the 2, 10, and 100 year storm analysis. There is a rapid runoff pre-construction rate due to fill and shallow bedrock on the site. Steve Trettel stated post development impacts to water levels in the wetlands is practically immeasurable and any detention will improve runoff. Site drainage is broke up into seven drainage areas and Mr. Trettel explained the flow patterns in each of the watersheds. Lisa Eggleston stated she wants the design to incorporate the same pre-development flow patterns for the post development. The proposed design diverts water in different directions than the current flow patterns. The detention ponds have been located to minimize drainage problems that currently exist. Steve Trettel described proposed drainage patterns for post development. Steve Trettel stated two stormceptors are to be located on the lower meadows to deal with the stormwater discharge near the wetland crossing. The design results in a small loss of overland waterflow to the vernal pools. The design will direct roof runoff to the vernal pool to compensate for the loss. Steve Trettel went over the hydrologic analysis as presented in a table. The design merely puts back the existing water flow to the vernal pools but does is the design sufficient for maintaining the vernal pool habitat. Discussion of installing gravel trenches to allow the water to reach the pools. Lisa Eggleston discussed the review letter dated 12/4/02/. There may be impacts to wetland systems as a result of the water being re-routed to different locations post construction. Steve Trettel stated the best case scenario is to pave over rubble to prevent water flow thru the rubble, thus reducing the disruption of measurable lead in the soils, which will result in higher water quality. In addition stormwater will be treated in the detention ponds. Joseph Lynch stated roof drainage discharge and flow disruption to the vernal pools must be shown on plans and method of delivery must be resolved. Lisa Eggleston wants to reproduce the existing drainage patterns for post development. Joseph Lynch stated the board members need to know who will be cleaning the drainage units. The O&M plan needs to specify maintenance of the structures and clarification must be presented on the type of condo association. Will the upper and lower developments be separate associations?Perpetual conditions must be placed in the O&M and prior to a COC sign off, affidavits by the association must be submitted recognizing the perpetual O&M plan. The development has been renamed Oaridge Village (upper meadows) and Mapelwood Reserve (lower meadows). It was questioned whether development of the site would be phased or constructed all at once. Albert Manzi stated plans have to be accurate or a modification will be necessary. Motion to continue to January S, 2003 meeting, by Sean McDonough, seconded by Deborah Feltovic.
