BOARD OF SELECTMEN MINUTES February 24, 2020
CALL TO ORDER: Chairman Richard Vaillancourt called the meeting to order at 7:00PM in Meeting
Room at Town Hall.
ATTENDANCE: The following were present: Chairman Richard Vaillancourt, Clerk Rosemary Smedile,
Licensing Chairman, Regina Kean, Chris Nobile, Phil DeCologero, Town Manager, Melissa Murphy
Rodrigues, Deputy Town Manager, Denise Casey and Director of Administrative Services, Laurie Burzlaff.
PLEDGE OF ALLEGIANCE
PUBLIC COMMENT
Stan Limpert of 43 Stonecleave Road, encourage the Board to accept the donation of the Stevens Moses
bedroom set.
Peter Breen of 770 Boxford Street thanked the Board for hiring the Town Manager.
Karen Lauro, 591 Massachusetts Avenue, provided some documents to the Board and objected to the
removal of the public shade trees on Massachusetts Avenue and stated she did not receive
compensation for the trees that were removed.
Stephanie Sewade of 287 Chickering Road stated that there was no mention of the tree that was taken
on her land in the report. Ms. Sewade stated that they need to resurvey and that she has not gotten
compensated for any permanent easement. Ms. Sewade provided documents to the Board.
GOVERNMENTAL REPORTS
Auditor’s Report
Frank Suretti and Maura Stone of Powers and Sullivan presented information from the audit for Fiscal
year ended June 30, 2019. No material deficiencies were found.
Peter Breen asked how many other towns have the AAA bond rating and when will OPEB be funded.
FY20 2nd quarter financials
Lyne Savage provided a summary of the financials through December 31, 2019. Revenues are slightly
lower than this time last year but not an issue. Everything else is on track with the budget.
NEW BUSINESS
Vote to approve removal of public shade trees-Massachusetts Avenue/Chickering Road
The Board was provided with a memorandum from Jim Stanford regarding tree removal for the MADOT
project. Town Manager Rodrigues explained that a public hearing happened earlier in the day at the trees
and two objections were filed so the Board must vote on whether to approve the tree warden’s
recommendation to remove 7 trees. Ms. Rodrigues indicated that Paul Stedman from MADOT informed
her that 22 trees are on state land and will not be transferred to the Town until the project is complete.
Approval does not need to be given for those trees located on state land.
Chris Nobile made a MOTION, seconded by Regina Kean that the Board of Selectmen approve the
removal of 7 trees as outlined in memorandum from DPW Director, Jim Stanford. Motion approved
5-0.
Request of Tim Breen, Chris Buco and Jake Munroe to use the Town Common on Saturday, May 30,
2020 from 8:00AM to 7:00PM for the “Crafts for a Cause” fundraiser
Tim Breen, Chris Buco and Jake Munroe presented information regarding their application to use the
common for the “Crafts for a Cause” fundraiser. As per the Use of Town Common regulations, the event
would require a security deposit given the amount of people expected.
Chris Nobile made a MOTION, seconded by Regina Kean that the Board of Selectmen approve the
request of Tim Breen, Chris Buco and Jake Munroe to use the Town Common on May 30, 2020
from 8:00AM to 7:00PM for the “Crafts for a Cause” fundraiser subject to receipt of a security
deposit in the amount of $1000. Motion Approved 5-0.
Appointment of Patrick Coutermarsh to the Festival Committee
The appointment subcommittee is recommending Patrick Coutermarsh be appointed to the Festival
Committee.

Phil DeCologero made a MOTION, seconded by Chris Nobile that the Board of Selectmen appoint
Patrick Coutermarsh to the Festival Committee for a term ending June 30, 2020. Motion approved
5-0.
LICENSING COMMISSIONERS
Regina Kean made a MOTION, seconded by Chris Nobile to open a meeting of the North Andover
Licensing Commission. Motion approved 5-0.
Renewal of Entertainment License for Stevens Coolidge Place
Katherine MacDonald from the Stevens Coolidge Place provided the Board with a list of conditions they
were willing to agree to in order to help alleviate the concerns of the neighbors. In addition to the list, they
will also not be having any more stand-alone beer gardens. Ms. McDonald explained that they do not
rent out their space and are not an event center.
Chairwoman Kean asked for any public comment.
Melissa Rivers of 179 Andover Street said she appreciates the accommodations being made by the
Stevens Coolidge Place but she would still like to see a limit on the number of larger events.
Kelly Cormier of 169 Andover Street is looking to limit the number and size of events.
Mike Fina of 124 Olde Village Lane stated that the Stevens Coolidge Place has turned into an event
center.
The Board was appreciative of the steps taken by Stevens Coolidge to address the issues. Mr.
DeCologero suggested 8:00PM for an end time. The Board discussed the traffic and use of Wood Lane
by vendors and if they could limit the number of events.
Town Manager Rodrigues explained that conditions may only relate to public safety, health or order or to
guard against creation of a nuisance and to protect patrons. Ms. Rodrigues indicated the hours for
Smolak Farms are until 9 on Monday through Thursday and 10 on Friday and Saturday. Stevens Estate is
until 1:00AM every day.
Richard Vaillancourt made a MOTION, seconded by Chris Nobile that the Board of Selectmen,
acting as Licensing Commissioners, renew the Entertainment License for the Stevens Coolidge
place through December 31, 2020 with the hours of 10:00AM to 8:00PM Sunday through Thursday,
10:00AM to 9:00PM on Friday and Saturday and with the following conditions: Licensee must
move the stage away from the neighborhood to the new event lawn or Hemlock Lawn, stage
facing south east (towards 115 Andover Street); amplifiers on stage must face south east (towards
115 Andover Street); the Stevens-Coolidge Place agrees not to hire Rock Groups or Heavy Metal
Groups, known for their loud music; bathroom facilities must be located 100 yards away from
residential property line; and vendors may only use Andover Street for entrance and exit. Motion
approved 5-0.
Request of Stevens Coolidge Place for a one day wine and malt license for a picnic concert on June 20,
2020 from 12:00PM to 7:00PM
Richard Vaillancourt made a MOTION, seconded by Rosemary Smedile that the Board of
Selectmen, acting as Licensing Commissioners, approve the request of Stevens Coolidge Place
for a one day wine and malt license for a picnic concert on June 20, 2020 from 12:00PM to 7:00PM.
Motion approved 5-0.
Request of Stevens Coolidge Place for a one day wine and malt license for a members only cocktail party
on March 20, 2020 from 6:30PM to 8:30PM and for waiver of police detail
Richard Vaillancourt made a MOTION, seconded by Rosemary Smedile that the Board of
Selectmen, acting as Licensing Commissioners, approve the request of Stevens Coolidge Place
for a one day wine and malt license for a members only cocktail party on March 20, 2020 from
6:30PM to 8:30PM and to waive the police detail. Motion approved 5-0.
Request of Merrimack College for two one day wine and malt licenses for receptions at Cascia Hall on
April 1, 2020 from 5:00PM to 7:00PM and on May 12, 2020 from 11:30AM to 6:00PM

acting as Licensing Commissioners, approve the request of Merrimack College for two one day
wine and malt licenses for receptions at Cascia Hall on April 1, 2020 from 5:00PM to 7:00PM and
on May 12, 2020 from 11:30AM to 6:00PM. Motion approved 5-0.

Request of Gregg Lindsay of Good Day Café for an annual entertainment license
Phil DeCologero made a MOTION, seconded by Rosemary Smedile that the Board of Selectmen,
acting as Licensing Commissioners, approve the request of Gregg Lindsay of Good Day Café for
an annual entertainment license. Motion approved 5-0.
Phil DeCologero made a MOTION, seconded by Rosemary Smedile to close the meeting of the North
Andover Licensing Commission. Motion approved 5-0.
APPROVAL OF MINUTES
Phil DeCologero made a MOTION, seconded by Chris Nobile to approve the Open Session Minutes
of January 13, 2020. Motion approved 5-0.
CONSENT ITEMS
Vote to open the 2020 Annual Town Meeting Warrant for May 19, 2020 and to close the warrant on
March 23, 2020 at 4:30PM. All articles must be time stamped by the Town Clerk’s office by warrant
closing
Request of Margie Rothschild on behalf of the North Andover Farmers Market to close First Street every
Sunday beginning June 14, 2020 through October 4, 2020 from 8:00AM to 3:00PM
Accept donation of Moses Stevens’ bedroom set from the Stevens Family to the Stevens Estate
Accept donations from the youth sports groups to be used towards the fields/facilities
1. North Andover Little League- $6,430.00
2. North Andover Youth Lacrosse Association- $3,000.00
3. North Andover Booster Club- $10,050.00
4. North Andover Youth Soccer Association- $19,890.00
Chris Nobile made a MOTION, seconded by Rosemary Smedile that the Board of Selectmen
approve all items listed under Consent Items. Motion approved 5-0.
OLD BUSINESS
Vote to adopt Town Manager’s Fiscal Year 2021 Recommended Budget
Mr. DeCologero asked about the SPED Stabilization account. Ms. Rodrigues explained that it is not really
a stabilization account because it’s being used to subsidize the operating budget every year. She has
recommended a Finance Reserve Account that can be accessed during the year for emergencies.
Finance Committee has to approve any expenditures from the account.
Regina Kean made a MOTION, seconded by Chris Nobile that the Board of Selectmen adopt the
Town Manager’s Fiscal Year 2021 Recommended budget. Motion approved 5-0.
TOWN MANAGERS REPORT
The Board was provided with the job posting/vacancy log.
Town Manager Rodrigues announced Cleargov launched today. It is an online tool that allows for the
public to see all the financial information for the Town. Ms. Rodrigues also announced early voting from
February 24-28.
