10 Section 195-8.11 Site Plan Review and 195-10.7 of the North Andover Zoning Bylaw. The Applicant proposes the
11 construction of a 12' paved drive wrapping around the existing building, four parking stalls and stormwater
12 improvements. The project is located within the Corridor Development District I (CDD-1) Zoning District.
13 M. Gregoire: This is a continuation from the February 4"meeting; all reviews are complete. Fire has no trouble
14 accessing the site;they'll review the change of use requirements during the permitting stage. A draft decision has
15 been prepared for this evening. A stop line and stop sign were added to the site; shed was relocated behind the
16 building; privacy fence was noted to shield headlights. Town engineer requested copy of inspection log related to
17 the O &M plan.
18 Adarn Marchionda,Marchionda Associates: All comments were addressed in the updated plan.
19 MOTION: A. Preston made a motion to close the public hearing for Site Plan Review Special Permit for 633
20 Turnpike Street,North Andover, MA, Marchionda&Associates, L.P. P. Boynton seconded. The vote was 5-0,
21 unanimous in favor.
22 MOTION: J. Simons made a motion to approve the Site Plan Review Special Permit for 633 Turnpike Street,
23 North Andover,MA,Marchionda&Associates, L.P, as amended. P. Boynton seconded. The vote was 5-0,
24 unanimous in favor (K Cor-nier voted).

26 21 High Street•,_RCG: Application for a Definitive Subdistrict-A Master Plan (East Mill) under Chapter 195
27 Article 18 Downtown Overlay District of the North Andover Zoning Bylaw. The Applicant seeks approval of a
28 Definitive Master Plan for existing uses and improvements at East Mill to bring the property into compliance with
29 the overlay district guidelines. No changes are proposed to the property for structures. The property is located in
30 the 1-S and R-4 Zoning Districts, and Downtown Overlay District SubDistrict-A (Historic Mill Area).
31 Tania Hartford, RCG NA Mills &John Smolak, Smolak&Vau lg parr: We have been working with Planning
32 regarding comments to the decision. We have nothing new to add. We request the Open Space be referred to as a
33 Conservation Easement v. a"restriction"in order to save time; a restriction involves a long process of reviews
34 with the state. It's not the PDD any longer and it's not a buildable area, maybe we do proceed with the fill
35 Conservation restriction?The right of way will not be constructed it is considered a"paper street".
36 M. G regoire: We have identified the Open Space in the decision. (displayed map of pond and greenspace)This
37 was required under the PDD. Under the new overlay there is no stipulation requiring Open Space, however we and
38 we want to preserve the Open Space with this new restriction. Board agreed this condition (#62) should occur in
39 both decisions-Def Subdivision and Def SubDistrict-A Special Permit.
40 T. Hartford: The restriction hasn't been put in place; it is filed when the PDD is closed. We never closed the PDD,
41 however we have this map and the designated Conservation area but the restriction has never been drafted.
42 J. Smolak: You want your build out to be complete(East Mill)before you impose a formal Conservation
43 restriction particularly if you look to amend it because it requires 2/3 vote of the state legislature.

44 MOTION: P. Boynton made a motion to close the public hearing for 21 High St., RCG, Definitive SubDistrict-A
45 Master Plan (East Mill). A. Preston seconded. The vote was 5-0, unanimous in favor.

49 21 High Street,RCG: Application for approval of a proposed 3-lot Definitive Subdivision plan on an
50 approximate 18.5-acre parcel of land located at what is known as East Mill located off High and Water Streets.
51 The premises affected is located within the I-S and R-4 underlying zoning districts, as well as the Downtown
52 Overlay District SubDistrict-A(Historic Mill Area).
53 M. Gregoire: The performance guarantee is referenced in the requested waiver chart; noted as request withdrawn.
54 J. Smolak: RCG may separately finance some of these lots, including Tire Flats. Instead of requiring the roadway
55 issue to be dealt with in advance,we included a performance guarantee that could be the site opening bond as
56 security for performance;releasing the roadway from the statutory covenant conveying the bond to an RCG entity.
57 MOTION: P. Boynton made a motion to close the public hearing for the 3-lot Definitive Subdivision for 21 High
58 Street(East Mill), RCG. A. Preston seconded. The vote was 5-0, unanimous in favor.
59 MOTION: J. Simons made a motion to approve the Definitive Subdivision for 21 High Street(East Mill), RCG,
60 as amended. A. Preston seconded. The vote was 5-0, unanimous in favor.

62 DISCUSSION
63 4 High Street,RCG West Mill NA LLC: Request for Insubstantial Change to the Definitive Subdivision Plan
64 approved on January 9, 2020,to allow for posting of a performance bond in an amount deemed satisfactory to the
65 Board, in order for the Applicant to obtain a Form J and release the statutory covenants in lieu of construction of
66 the roadway and strict compliance with the provisions set forth in Sections 37, 53 and 69-71 of the approved
67 subdivision Decision.
68 Tania Hartford &John Smolak: Both RCG and Avalon intend to construct the subdivision roadway simultaneous
69 to the development of Lots 2 &3; Avalon intends to construct the roadway at the same time. When putting the
70 covenants together for Lots 2 &3 they couldn't be released from the Form I covenant until the roadway was
71 completed. A surety will be posted for the construction of the road such that Lots 2 &3 can be conveyed and
72 released from the covenant enabling the sale of the property and the construction of the roadway. The Insubstantial
73 Change allows for the posting of the performance bond, to release the Form J and additionally, if the Board agrees,
74 Avalon would be willing to post the$40K performance bond as the security for the development of the roadway.
75 The time period is open ended and the bonds should remain separate.
76 MOTION: J. Simons made a motion to accept the Insubstantial Change for 4 High Street, RCG, West Mill NA
77 LLC and approve the allowance for the posting of a performance bond in an amount deemed satisfactory to the
78 Planning department and DPW for the construction of the subdivision roadway in order for the applicant to obtain
79 a Form J,releasing the statutory covenants in lieu of the formal construction of the roadway and strict compliance
80 with the provisions set forth in the approved subdivision decision, A. Preston seconded. The vote was 5-0,
81 unanimous in favor.

83 127 Marblehead Street,Centry 1 Realty Trust,Eugene Faye Trustee: Application for a Site Plan Review
84 Special Permit under Part 3 and Section 195-10.7 of the North Andover Zoning Bylaw. The Applicant proposes to
85 convert the existing building into a four(4) unit multifamily structure with parking for 8 cars at the rear and north
86 sides of the property. This project is located within the Residence 4(R-4)Zoning District.

89 objections. We had proposed the larger parking area to be pervious; not the additional area. We have not received
90 an answer on parking along the street.
91 E. Goldberg: Requested to review parking bylaw; typically, if there is no street sign there are no rules. Suggested
92 restricting number of vehicle guests in the lease. Great project; layout is really good.

101 Board determined project landscaping needs further attention alongside Turnpike Street. Staff Planner to discuss
102 planting alternatives, i.e. 4-10 ft. of low, deciduous hedges between the five existing trees with applicant.

105 Section 195-8.11. A(3)and common parking areas and multiple use facilities under Article 8 Part I off Street
106 Parking and Loading of the North Andover Zoning Bylaw. The Applicant proposes to construct a 25'x 75'
107 addition at the rear of half of the existing building and change the use of a portion of the building to an indoor

155 500 Great Pond Road,North Andover Country Club: Contractor, Andrew Jones of Windover Construction
156 provided update on construction status and discovery of aii underground, cast in place 3 x 5' concrete fuel tank on
157 site. Tank to be removed, soil to be tested, erosion control is in place. Conservation and Planning were contacted
158 immediately; no leaching visible. License with the EPA will be obtained; material will be disposed of properly.

160 Amendment to the I-2 Zoning District: Allow for a sign master plan by a Planning Board Special Permit.
