DISCUSSION ITEMS: Rea Street,LRC Builders,LLC: Request for endorsement of lot release(FORM J) M. Gregoire: This 7- lot residential development was approved in 2018.The applicant is seeking a Form J to release all seven lots which have been completed along with most of the road work and utilities;the site is under construction.Applicant has submitted documentation required under conditions. Verification of an easement is needed; I recommend that once we receive the required documents the Board grant the endorsement of the Form J. D. Innis,LRC Builders: I believe I have access to the documents you are seeking. J. E►right: We are seeking a recorded drainage easement and a Conservation Restriction or Open Space Restriction as required by Natural Heritage and Endangered Species Program. I trust these documents are in place as the Applicant couldn't have gotten this far without them;however, we need locate the copies. The Form J will be need to be submitted with the engineer's stamp. J. Simons: Has the bond amount been set? M.Gregoire:DPW has reviewed scope of potential outstanding work; cash bond for$107K will be payable to the Town. J. Simons: Explained two projects of particular interest this year are the Stevens Memorial Entrance Stairway;mitigating a water problem underneath that staircase. The other significant project is the Schofield Mill. This wiII make that facility very solid going forward.This mill is the original mill in North Andover and perhaps the first of its type built in the Merrimack Valley. Annual Town Meeting Warrant Article 29: Citizen Petition-Adoption of a 3-year moratorium of crumb rubber in-fill oil artificial turf. Keith Connors: Explained Citizen Petition is not a moratorium on all synthetic turf,does not prevent the Town from laying down artificial turf on public land in North Andover,does not require North Andover to replace any existing artificial turf fields that contain crumb rubber and emphasized it is only a moratorium on the construction or installation of synthetic turf with crumb rubber infill. There exists troubling concerns around the safety of crumb rubber and children.Towns are being urged to research safer alternatives to toxic chemicals;EPA no longer backs the use of crumb rubber. Listed 7 facts of crumb rubber.This moratorium is non-binding and will allow time for the Town to research this safety issue. Concord MA,recently had a three year binding moratorium oil this issue. J. Simons: The BOS should address this for appropriateness and is this sentiment at the community level only or nationwide? A.Preston: Since this is non-binding it should be taken tip with the BOS v, appearing as a warrant article. P.Boynton: Does the 3 year period have any significance with respect to the planned financing of the NAMS project?Does this put any of that in jeopardy?Why non-binding? E. Goldberg: Yes,the Middle School project is currently on appeal and could be affected by this. If that case were to wrap tip this year,it would likely be bid next year. I would agree this doesn't need to be a warrant article. K. Connors: I don't know the impetus behind why this is designed as non-binding; this applies to future permitted projects. The Town also proposes to install a segment of sewer main but none of this work is located in the 100 foot buffer zone to wetland resource areas. Ill addition to the WSP Waiver request,we filed an NOI with Conservation. D.DeRoche: Described majority of work in the existing right of way. Area in watershed limits are near 133 and Great Pond Road intersection;opposite of that,a 5' sidewalk will be provided to replace a dirt path with curbing. Stretch in front of Mobil Gas Station continues to intersection at Sutton Street. Existing delta islands will be reconfigured with paved walkways. This project is within the Industrial 2(1-2) Zoning District. M. Greer: This opened on January 7,2020. At that time,the Building Commissioner determined 77 parking spaces were required. Based upon the revised narrative,the Applicant is requesting a reduction in the number of parking spaces. Fire, Police and Conservation have no concerns;Board of Health is seeking Title 5 information. A revised plan showing new parking layout and dimensions needs to be submitted. The proposed project will include the relocation and redevelopment of a portion of an existing 6MW Solar Energy System onto proposed Lot C for purposes of a Large-Scale Ground-Mounted Solar Energy System, including upgrades to access,utilities,stormwater management, lighting, landscaping, and other associated improvements.This project is located within the Industrial-2 (1-2)Zoning District. Changes have been made to the application to include an ANR related to the Definitive Subdivision.Noted options for getting employees to and from the site, i.e.hourly single bus lane. Jolty Plante,P.E.,Langan Engineering: Provided update on Traffic Impact Study,peer review and proposed improvements and mitigation. Employee total for site is 1800-2,000.Preparing to submit permit application to MassDOT.Noted significant amount of ride sharing is anticipated with industrial tenant. Tim O'Neil, Langan Engineering: Briefly reviewed Water and Sewer peer review. All comments have been addressed. Provided a high level summary of lot line reconfigurations. Brian Vaughan: Described detailed lot line revisions due to DPU Regulations related to arrangement of solar system arrays which cannot cross over lot lines.What was formally the subdivision roadway becomes a permanent access easement. John Snnolak: Summarized lot line reco€lfigurations. An"option" for Amazon and Hillwood is to return to the original subdivision proposal. Undertaking the re-lotting exercise,combining lots, helps us avoid a petition process taking 8-16 months. After the solar is moved from Lot B,the ANR process will be used to create 2 separate lots;Lot B which is approx.I 10 acres;a new revised Lot A which combines Lots A& C and the subdivision roadway into a single lot(approx, 57.5 acres)with a permanent access casement running from Osgood St. across the newly formed Lot A to the Amazon-Lot B. The improvements shown on the plans will not be changing;this exercise in lotting helps its move the solar array from I..ot B over to the existing solar buildings 20&21 and on the formerly proposed Lot C.We need to go through the definitive subdivision process, currently. We could withdraw or continue to the end of the year without action. Lot B would continue review as a conforming ANR lot with the only change that the subdivision roadway being part of Lot A. The only substantive change in permitting is we need an additional Solar Setback Modification Special Permit under the Solar Energy Systems Bylaw 8.8.B2 providing all large scale ground mounted solar systems have to be installed in the side or rear yard and be located no nearer the street than the building line of the principle structure. With the new lot configuration,the solar array on former Lot C is closer to the setback of Osgood St.than buildings 20&21;we need a Solar Energy Modification Special Permit, in addition to the other permits you have been currently reviewing.This would be allowed through the recently amended zoning bylaw provisions for setbacks approved at the June special town meeting. Summarized lot consolidation. Special counsel for the town has been reviewing this with special counsel for the owners of 1600 Osgood Street and Hillwood. I respectfully suggest we are the point where we can start reviewing draft decisions and get to a decision on May 5th. We will prepare a legal ad that will be run in tine for the next hearing. J. The premises affected is located within the Residential 4 (R-4)Zoning District. The Applicant intends to make roadway improvements and construct a single-family house on the new parcel. M. Gregoire: Provided brief history of the project which transitioned from an ANR to a Definitive Subdivision at the suggestion of the Board due to limited frontage on Great Oak Street. The application has been submitted to the DPW for review which we will have for the next meeting. Great Oak is currently maintained as a public way; it will become a private way. Jim Murray,EU.:The town has plowed and picked up trash there since 1923,As noted on the plans the town will not have any responsibility for maintenance now.Deed for Lot 72B to include homeowner's maintenance clause for maintenance and snow plowing;roadway is being improved to be asphalt not gravel.Conditions agreed to are amended on updated plans. Richard Mead, P.E.: Described mitigations being made for runoff on the 12 ft.wide proposed paved roadway. Gravel will transition into paved roadway. J. Em i�ht:The proposal includes waiving roadway construction standards. The DPW would no longer be responsible for maintenance or snow plowing. The roadway design is equivalent to a long driveway and the stormwater review has been completed by the Town Engineer. His comments have been addressed in the plans. E.
