North Andover Conservation Commission Meeting Minutes

participation.
Members Present: The following identified themselves as present on the call: Louis A. Napoli, Chairman, Albert
P. Manzi, Jr., Vice Chairman, Joseph W. Lynch, Deborah A. Feltovic, John T. Mabon and Sean F. McDonough
Members Absent: Douglas W. Saal
Staff Members Present: The following identified themselves as present on the call: Amy Maxner, Conservation
Administrator
Meeting came to Order at: 7:05 p.m. Quorum Present.
Acceptance of Minutes
The minutes for the March 11, 2020 meeting are not ready for approval.
General New/Old Business
242-1676, Extension Request, Hillside Road, Lot 1 (Winslow Drive Realty Group, LLC)
The Administrator states the applicant has requested a second and final one year extension. The site is in
compliance. The wetland flagging is in place and the fieldstone wall and wetland markers were installed.
Brian Boyle, Winslow Drive Realty Group is present for questions.
A motion to grant a one year extension is made by Mrs. Feltovic, seconded by Mr. Lynch.
Vote 6-0, Unanimous.

Certificate of Compliance
242-1352, 1600 Osgood Street (Ozzy Properties)
The Administrator states the applicant is requesting a COC for the OOC, which governs the stormwater
facility maintenance. The new OOC (242-1776) for Amazon will supersede all previous OOC's and any
associated on-going conditions.
The Commission discusses the request for a Certificate of Compliance.
Mr. Lynch would like to know if DEP# 242-1776 includes areas that not cover under DEP# 242-1352.
Mike Howard, Epsilon Associates, Inc. states DEP# 242-1776 issued for the Amazon facility will
supersede
landowners.
A motion to issue a full and final Certificate of Compliance is made by Mr. Lynch, seconded by Mrs.
Feltovic.
Vote 6-0, Unanimous.

The Administrator states the applicant has requested a continuance via email. The project has not been
assigned a DEP# and they are waiting on a revised plan depicting a dewatering area and tracking pad.

The Administrator states the Town of North Andover has requested a continuance until the state of
emergency has been lifted and the applicant so granted. The monitoring and testing remains intact as
previously agreed.
The Commission agrees that although they are continuing the Amendment to the Order of Conditions
their rights of enforcement are not impeded by the continuance.
A motion to continue to a time to be determined is made by Mr. Lynch, seconded by Mrs. Feltovic.
Vote 5-0, Unanimous, Recused: Mr. Napoli.

Decisions

The Administrator reviews the drafted Order of Conditions with the Commission.
The Commission discusses condition #59. No-Snow Stockpiling signs are required to be installed in front
of the rain garden.
A motion to approve the Order of Conditions as drafted and amended is made by Mr. Lynch, seconded by
Mrs. Feltovic.
Vote 6-0, Unanimous.
242-1760, 4 High Street (AvalonBay Communities, Inc.)
The Administrator reviews the drafted Order of Conditions with the Commission.
The Commission discusses Condition #37 concerning a declaration of cross-easements, restrictions and
covenants, or equivalent, between the applicant and the
material be removed from the site and replaced with clean fill. The bond will be set in the amount of
$20,000. Condition #27 requires reporting for any rain event of a ½-inch or greater within a 24-hour
period. Condition #39 will require the applicant to submit a foundation as-built immediately upon
completion of the dwelling foundation. Condition #46 does not allow any large fuel storage tanks on-site.
Fueling will be required to take place outside the Buffer Zone in a location to be determined at the
preconstruction meeting.
A motion to approve the Order of Conditions as drafted and amended is made by Mr. Lynch, seconded by
Mrs. Feltovic.
Vote 5-0, Unanimous, Abstained: Mr. McDonough.
