O'Leary, Chairman; William Morton, Secretary; Arthur DrY, John J.. Shields and ~enry E. Lv~d. This ~oeting was called to further dis~_*s the petition of Theodore I. Frei~e for a gasoline station. ~r. ~reiJe and his brother ~ere present; also, Atty.. Joseph ~acigalupo and ~r. Pieroe the engineer fo~ Atlantic. Ref~4-~ Company. Chairman O'Leary explained that the purpose of the meeting was se that the Board eould see s~aeth4-8 done ~ith the r~-a4~ land because that goes in ~ith the rest of it. The Board is concerned about beautifying the strips on both sides of the station and don't want any land le~ vadeveloped or not ~aint-~d. ~r. Pierce explained __+~__t they made a stvd~ of the traffie eeaditions and felt thet the entrance and emit being farther a~ay frc~ the intex~eetion would be better and wouldnmt cause a~ more congestion. They can ~ove them if the ~ ~nts them to. It is very expensive to Mt-top and fill, so they le~ the rest undeveloped. They can landscape it if the Board desires. ~r. Shields says he is very ~eh ag,~st leaving any land ~developed. It ~ be developed in its entirety. Maybe y~u can suggest to us what you can do. Mr. Pierce said that at this ~c~ont they have no plans for it. They ~ ~_~- every effort to eo~perote; ~ake any suggestions you may have. Mr. Shields feels that so~e landscap~,~, gra~-~, seeding, ets. and mA~nta~-~-~ would be a definite advantage to the gasoline station. Pierce said one side is totally developed. Atty. Ralph Finck brought in new plans and showed them to the Board. This petition had been tabled from the August 12 hearing until new plans were pz--~sented. The Board discussed how the lots were re-arranged. Mr. Shields made a motion to take the petition under advisement. Mr. Lund seconded the motion and the vote was unanimous. Atty. John J. Willis was present. Chairman 0'Leafy read a letter received from Atty. Willis regarding the decision for the apartment development for R. & S. Const. Co. He explained why held like th~cision to read without any conditions, because it has to go through the F~A. H~/~up~ly any plans necessary, but he has to get results from this Board before they go to the FHA - itfs like putting the cart before the horse. Mr. Shields helped to explain further since he had also had dealings with the FI~ and said the special permit can't have any strings on it because the government sets up a code which is alot stricter tt~ anything this Board can put on it. Atty. Willis 'explained how things may have to be changed as the building goes along and what difficulties wo~ld result if conditions were put on it. The FHA specifications will be more than enough than what the Building Inspector requires. They ~ spend about $12,000 a unit and there w/_ll be 128 units. A peA~t to build in accor~A~oe with the Zoning By-Laws will eliminate all conditions. Mr. Shields said if the developer gave the Board a letter that no building would he performed until the special permit is given and then get the plans. Atty. Willis said he would give a letter to that effect. The Building Inspector gets a copy of the decision and he can't give a permit until the plans are provided. The Zoning Law is very clear under the Apartment Development. Donft think site plan review includes building plans, specifications, etc. Mr. Shields m~de a motion to accept the letter. Mr. Lund seconded the motion and the vote was unanimous. CHAREST: The Board discussed the Charest petition. the boulders pushed on his land. Mr. Lund said Buturlia was objecting to M~. Morton said Charest is not touching the lot that is next to Bu~urlia's. He~s just changing the other 2 lot lines. Mr. Shields ,~de a motion to Grant the petition. Mr. Mor~on seconded the motion and the vote was unanimous. The usual reasons for granting applyl The Board signed the necessary plans. FREI JE: The Board discussed the Freije petition. Mr. 0'Leary said the Board should take under consideration that the Police Dept. says it is a dangerous situation. Mr. Lund questioned if that would be any more of a hazard than if anything else went in there. Mr. Shields said they wanted the Curtain Shop there and it was thrown do~n. He is asking for a legal permissive use; he has made an investment - what's he going to do ~rlth it? Sept. ~0, 1963 - Cont. Mr. Lund said the abutter bought that house knowing it w~s in an Industrial area. He was told - his eyes were open. This lot is the s-m~ land that Bonalli & Corradino applied for a gas station permit. If it was approved before, then we will go along ~ith it again. (The clerk will check further on the Bonelli & Corradino petition). Mr. Shields made a motion to post-pane making a decision untilthe next regular meeting. Mr. Lund seconded the motion and the vote was unanimous. Mr. Lund said the Board of Health threw down the other person who was 200 feet farther away. He'd like to see what they do with this. The meeting adjourned at 9:30 P.M~
