Premises Affected: 96 Dale Street North Andover,MA 01845,Map 37.13,Parcel 76,within
the R-3 zoning district.
HISTORY AND BACKGROUND
On June 25, 2020, the applicant requested a waiver of the Watershed Protection District Special
Permit, in accordance with the North Andover Zoning Bylaw section 195-4.24 Waiver of Special
Permit,so as to allow the construction of a 16'x 24' (384 SF)extension of an existing deck located
at the rear of an existing dwelling unit. The new construction is located more than 100' from a
delineated wetland resource area within the Non-Discharge buffer zone of the Watershed
Protection District.
DECISION
After a Planning Board meeting discussion on July 7, 2020, and upon a motion by J. Simons and
2"d by A. Preston, a vote was taken with regard to a waiver of the Watershed Special Permit. The
vote was 5-0,unanimous in favor of the waiver.
FINDING OF FACT
The Planning Board has made its decision based on the following findings:
• The deck extension is.located in the non-discharge buffer zone and is more than 100'
from a delineated wetland.
• Construction of the dwelling required the approval io a Watershed Special Permit in June
2013,thus a peer review of stormwater management design was completed for the
property.
• The proposed deck expansion will be above an existing ground level patio.
CONDITIONS
• The Applicant will install the appropriate erosion control prior to construction, which will
be inspected by the Town Planner prior to the start of construction.
• The Applicant will schedule two inspections with the Town Planner during the
construction process.

Re: Consideration for extension of current deck
We are applying for a permit to extend our current deck on the back of our house. We
live at 96 Dale St. and have been the only owners of the property since it's construction
in 2014, The extension of the deck is 16 x 24 equaling 384 sq feet. It will be attached to
the house on the back side adjacent to the existing deck above the existing ground level
patio and the project will not expand the existing footprint of the structure. The proposed
project will not impact anything regarding the wetlands and will not disturb existing
topography. This parcel is on the town sewer. We also agree to schedule a minimum of
two inspections conducted by the town planner during the construction process to
ensure proper erosion control is established during the construction process. The town
planner can stop construction if the proper erosion control is not in place.
