Brian Magnuson 180 Marbleridge Road North Andover,MA 01845 Premises Affected: 180 Marbleridge Road, North Andover, MA 01845, Map 37.B, Parcel 69,within the R-3 zoning district. HISTORY AND BACKGROUND On June 25, 2020, the applicant requested a waiver of the Watershed Protection District Special Permit, in accordance with the North Andover Zoning Bylaw section 195-4.24 Waiver of Special Permit, so as to allow the construction of a 7' x 40.83' farmer's porch, The new construction is located more than 100' from a delineated wetland resource area within the Non-Discharge buffer zone of the Watershed Protection District. DECISION After a Planning Board meeting on the above date, and upon a motion by J. Simons and 2"a by A. Preston, a vote was taken with regard to a waiver of the Watershed Special Permit. The vote was 5-0, unanimous in favor of the waiver. FINDING OF FACT The Planning Board has made its decision based on the following findings: • The farmer's porch is located within the non-discharge zone and are more than 100 ft. from a delineated wetland. • Runoff from this construction will infiltrate into the ground with the high permeability of the soils on site. • The proposed farmer's porch will be supported by sonotubes. CONDITIONS • The Applicant will install the appropriate erosion control prior to construction,which will be inspected by the Town Planner prior to the start of construction. • The Applicant will schedule two inspections with the Town Planner during the construction process. Ms. Enwright; We are writing to you to seek a waiver of special permit for removal of an existing landing and stairs construction of a farmers porch on the above parcel. The proposed construction is within Zone B,the Surface Water Protection District and is under the Zoning Bylaw Section 10.31. The proposed porch will be 7' by 40.83', supported by sonotubes.No changes in the topography will be required. The proposed construction will increase the impervious area on the lot by 257 s.f, essentially a 0.7%increase in impervious area on the site. Soil on the site are mapped by the NRCS as Hinkley soils, sand and gravel outwash deposits of highly permeable well drained soils. The rest of the site is mapped as Udorthents smoothed,these are well drained human altered soils generally consisting of sand fill material. With these soils,we would expect little or no significant amount of surface water runoff. Ma. G1S mapping shows the property to be about 2,500' from Lake Cochicewich,the town reservoir. It is unlikely that the proposed work could have any significant impact on the hydrology or water quality or water quantity. The proposed construction will be just over 100' from the wetland boundary. Most of the existing roof runoff is infiltrated to an underground roof infiltration system on the rear of the lot, and any precipitation and runoff from this construction will infiltrate into the ground with the high permeability of the soils on site.
