Although,the dwelling unit is to be razed, the existing foundation will remain in place. e existing foundation is located less than 100' from a delineated wetland;thus,within the Non- Disturbance Zone. Portions of the driveway are located within the Non-Disturbance ' Sono and Non-Discharge Buffer Zones of the Watershed Protection District, DECISION Auer a Planning Board meeting on the above date and upon a motion b " A. Preston and by J. Simons, a vote was taken with regard to a waiver of the Watershed Special Permit.p rr �ta The vote was 5-0, unanimous in favor of the waiver. FINDING OF FACT The Planning Board has made its decision based on the following findings: The project will not create any new impervious area. ■ The project will not expand the existing footprint,will not disturb existing topography, and the property is on town serer. The exterior landscaping of law., shrubs and trees will be preserved. As previously designed,the roof runoff will be collected and discharged to the gear of the lot or into the existing drainage/wetland. Property is approximately 1,500 from the Lake; however the work iproposed within 1 ' on the wetland .on-disturbance zone . Erosion controls will be maintained during the course of construction. CONDITIONS The Applicant will install the appropriate erosion control prior to construction,which will be inspected by the Town Planner prior to the start of construction. The Applicant will schedule two inspections with the Town Planner during the construction process, * The Planning director shall approve any changes made to the criteria I fisted in the Findings of Facts, on which this decision is based. Any changes deemed substantial by the Planning Director may require an application for a Watershed Special Permit pn"or to re-- construction. The dwelh'ng had a house fire on April 25,2020,and sustained substantial damage,to the structure. As a result,the applicant is proposing to raze the structure,,construct a new single-family dwelling on the,foundation, resurface the driveway and install the applicable utilities. The existing foundation and driveway, footprint will not expand,. The property is, located is wifthl"n Zone B, the Surface Water Protection District,, and is under the Zoning Bylaw, Section .31. T he,proposea nouse construction,and resurfacing the driveway w HI. not require,any changes to the topography. The proposed construction wim.11 not i",ncrease the impervious area on the lot. The MassGIS mapping,shows the property to be approximately 1,500 ft. from Lake Cochichewick, the town, reservoir. It is unlikely that the proposed work will have any impact on the hydrology,water quality or water quantity. The applicant has filed with.the local Conservation Commission as the works proposed within 1 00 ft. of the buffer zone and existing foundation iis 46.5 ft from the welland. Erosion controls will,be set and maintained for the duration of the project. The exterior landscaping of lawn, shi,ubs and trees will be preserved. As previously designed, the roof runoff wl"llbe collected and discharged tothe rear of the lot or into the existing drainage/wietland.
