Chairman Lynne Rudnlckl Peter 13oynton 58 Country Club Circle Watershed Special Permit June 20,2017 Page 2 of The public hearmng on the above referenced application was opened on Maroh 7, 2017 and closed by the North Andover Planning Board on June 20. 2017. n June 20, 2017,upon a motion mane by Lynne Rudnicki and seconded by Peter Boynton to GRANT a watershed Special Permit so as to construct a retaining wall, inground pool, spa, walk-way, patio, fence and associated grading,and landscaping in the Non-Discharge Zone andNon-Disturbance Zone of the Watershed Protection District under the requirements of Section .i . .e.ii, 10.3, and 10.31 of the North Andover Zoning Bylaw. This Special Permit was requested by Donald Stanley, 58 Country Club Circle Forth Andover,NIA 01845 on February 2, 2017. The Applicant submitted a complete application, which was noticed and reviewed in accordance with Section 10.52 of the Town of North Andover Zoning Bylaw and MGL Chapter 40A, Section 9. The motion to approve was subject to the FRq-DINGS I S FACTS and SPECIAL CONDITIONS set forth in this decision.. The Applicant is hereby notified that should the Applicant disagree with this decis'ion, the Applicant has the right, under MGL Chapter 40A, Section 17, to appeal this decision within twenty days after the date this decision has been filed with the Town Clerk. n accordance with 4.136 the Planning Board makes the fending that the intent of the Bylaw, as well as its specific criteria are met. This decision spec cally;stated by the Planning Board makes the following FUMINGS of `ACT: 1 The project is located within an extremely env oninental sensitive area and in close proximity to Lake Cochichewick, the Town's sole dunking eater supply-, however, the final design includes the implementation of Best Management Practices that reflect extensive discussions between the 'Town and Applicant to ensure the continued protection of Lake Cochichewick and the safety and welfare of the residents of Forth Andover. a The construction has been reviewed by Town Staff and the 'own's consulting engineer, Lisa Eggleston, as evidenced in email correspondences dated May 4, 2017, and with the application of the erosion control measures and modifications to the drainage and stormw ter management designs,the consultant concluded that there will not be significant degradation to the quality or quantity of water in or entering Lake Cochichewick. Further, adequate safeguards have been provided to m tigate pollutants from entering Lake Cochichewick tlu ough the instal ation i nplementation of Best Management Practices. 2 As required by theTown of Noah Andover's Zoning Bylaw Section 4.136.c.ii.3 and .1 .c.iii. , in ,order to construct a new structure in the Non-Disturbance Zone and within the Non-Discharge Zone the Applicant has received a Variance from. the Forth Andover Zoning Board of Appeals. The ZBA. had recommended the Applicant remove the entire pool from the Non-Disturbance Zone. However, after the wetlands were confirmed it was shown that at least 1 + square feet of the pool would still be in the Non-Disturbance. The ZBA4 found that the now location limited the impact in the Non-Disturbance Zone and therefore approved of the location. 3) The existing structure is connected to the'Town sewer and water systems. 4) Where is no reasonable alternative location outside the General, Non-Disturbance, and the Non- Discharge Zones for any discharge,structure or activity. r s 8 Country Club Circle Watershed Special Permit June 20,2017 Page 3 of 5 In addition, in accordance with Section 10.31 of the Forth Andover Zoning Bylaw, the Planning Board makes the following FMINGS OFFACT.- 5) The specific site is an appropriate location for the proposed use as all feasible stormwater and erosion controls have been placed on the site. 6) The use will not adversely affect the neighborhood as the lot is located in a Residential 1 Zoning District. 7 There will be no nuisance or serious hazard to vehicles or pedestrians, 8 Adequate and appropriate facilities are provided for the proper operation of the proposed use. 9) The lot was created after 1994 and is subject to the Conservation Zone,as described in section 4.136.2. Table 1. l The Planning Board also Tales a specific finding that the use is in harmony with the general purpose and intent of the North Andover Zoning Bylaw. I2 The Planning Director shall approve any changes made to these plans. Any changes deemed substantial by the Blaring Director would require public hearing and modification by the planning Board. 13 Best Management practices to protect the watershed from contamination with swimming pool chemicals used and stored on the property have been identified the "Swimming fool Maintenance Pl ". Applicant shaU incorporate the following conditions as a cued restriction and a copy of the recorded deed restriction shall be submitted to the Planning Department anent and included in the Bile. a Fertilizers are limited to those which are either organic or slow-release nitrogen and phosphorous-free,non-organic pesticides and herbicides use will be prohibited,and the use of coal tar-based pavement sealants will be prohibited. b) All future property owners will maintain the rain gardens and will not re-grade or otherwise alter their f netionality as stoi-nwater management structures. c) Any proposed net increase of impervious surface on the lot in the future,beyond what i allowed by this decision,will not be allowed. 1 A performance guarantee bond of four thousand dollars $ , m d e out to the Town of North Andover must be posted to insure that the construction, erosion control, measures, and perfonn n e of any other condition contained herein will take place in accordance with the plans and the conditions of this decision and to ensure that the as-built plans will be submitted. 1 The Applicant shall designate an independent Environmental Monitor who shall be chosen in consultation with the Planning Department. The Monitor shall submit weekly reports during the entire duration or the project and must be available upon four hour notice to inspect the site with the Planning Board staff`. The Planning Staff may reduce the frequency of reports upon review of such a request from the Applicant: 2 All erosion control measures as shown on the plan must be in place and reviewed by the Planning Staff. 1 pre-construction meeting must be held with the developer, their construction employees, Planning Department (arid other applicable departments) to discuss scheduling of inspections to be conducted on the project and the construction schedule. PRIOR TO THE RELEASE OF ESCROW FUNDS AND PERFORMANCEBOND 2 The Applicant shall submit an as-built plan stamped by a Registered Professional Engineer in Massachusetts that shows all construction,including storrnwater mifigafion trenches and other pertinent site features. This as-built plan must be provided in paper form as knell as in Sf (Standard Digital File) format. The Applicant must also submit a letter from the architect and engineer of the project stating that the pool installation and site layout substantially comply with the plans referenced at the end of this decision as endorsed by the planning Board.
