BOARD OF SELECTMEN MINUTES August 10, 2020
CALL TO ORDER: Chairman Chris Nobile called the meeting to order at 3:00PM. In accordance with
Governor Baker’s Executive Order issued on March 12, 2020, suspending certain provisions of the Open
Meeting Law due to the ongoing COVID-19 public health emergency, this meeting took place via
conference call. All Board members and staff participated in this meeting remotely.
ATTENDANCE: The following identified themselves as present on the call: Laura Bates, Phil
DeCologero, Rosemary Smedile, Richard Vaillancourt and Chris Nobile. Deputy Town Manager, Denise
Casey and Director of Administrative Services, Laurie Burzlaff were also present.
Chairman Nobile read the following statement:
Pursuant to Governor Baker’s March 12, 2020 Order Suspending Certain Provisions of the Open Meeting
Law, G.L. c. 30A, §18, and the Governor’s March 15, 2020 Order imposing strict limitations on the
number of people that may gather in one place, this meeting of the North Andover Board of Selectmen is
being conducted via remote participation. No in-person attendance of members of the public will be
permitted, but every effort will be made to ensure that the public can adequately access the proceedings
as provided for in the Order. A reminder that persons who would like to listen to this meeting while in
progress may do so by tuning in to Comcast channel 8 or Verizon channel 26 or online at
www.northandovercam.org. If you have public comments, please email selectmen@northandoverma.gov
CONSENT ITEMS
Vote to sign warrant for primary on September 1, 2020
Request of Chief William McCarthy to surplus Emergency One Cyclone fire engine
Appointment of election workers
Phil DeCologero made a MOTION, seconded by Rosemary Smedile that the Board of Selectmen
approve all matters contained under Consent Items as presented. Roll call vote: Bates-yes;
DeCologero-yes; Smedile-yes; Vaillancourt-yes; Nobile-yes. Motion approved 5-0.
LICENSING COMMISSION
Richard Vaillancourt made a MOTION, seconded by Rosemary Smedile to open a meeting of the
North Andover Licensing Commission. Roll call vote: Bates-yes; DeCologero-yes; Smedile-yes;
Vaillancourt-yes; Nobile-yes. Motion approved 5-0.
Request of Ashley Piazza of Smolak Farms for one day wine and malt licenses for the Whim Dinner
Series on August 12 and 26, 2020 from 5:30PM to 9:00PM
Given the Governor’s new limitation on the number of people for gatherings, the Board discussed whether
the tent would be considered indoor or outdoor. Ms. Burzlaff indicated that the building inspector will
confirm. If it does not have sides, they are limited to 50 people including staff. If it has sides, it would be
considered indoor and would be limited to 25 people including staff.
Richard Vaillancourt made a MOTION, seconded by Chris Nobile that the Board of Selectmen,
acting as Licensing Commissioners, approve the request of Smolak Farms for two one day wine
and malt licenses for the Whim Dinner Series on August 12 and August 26 contingent upon
compliance with the governor’s order limiting the number of people for gatherings. Roll call vote:
Bates-yes; DeCologero-yes; Smedile-yes; Vaillancourt-yes; Nobile-yes. Motion approved 5-0.
Request of Kate Bibeau of Stevens Coolidge Place for summer picnic concerts on August 13, 20 and 27,
2020 from 5:00PM to 8:00PM
This request was withdrawn due to the Governor’s latest order regarding gatherings. The applicant is
requesting a refund of the application fees for all events canceled due to COVID. There have been 4
events canceled for a total cost of $300.
Chris Nobile made a MOTION, seconded by Laura Bates that the Board of Selectmen, acting as
Licensing Commissioners, approve the request of Stevens Coolidge Place for a refund of the
application fees in the amount of $300 for events that were canceled due to COVID-19. Roll call
vote: Bates-yes; DeCologero-yes; Smedile-yes; Vaillancourt-yes; Nobile-yes. Motion approved 5-0.

Chris Nobile made a MOTION, seconded by Laura Bates to close a meeting of the North Andover
Licensing Commission. Roll call vote: Bates-yes; DeCologero-yes; Smedile-yes; Vaillancourt-yes;
Nobile-yes. Motion approved 5-0
ADJOURNMENT
Rosemary Smedile made a MOTION, seconded by Richard Vaillancourt to adjourn the meeting at
3:15PM. Roll call vote: Bates-yes; DeCologero-yes; Smedile-yes; Vaillancourt-yes; Nobile-yes.
Motion approved 5-0
