Great Pond load (Brooks School)with Section 3 of M.G.L. c. 40A; Educational Use. The
Planning Board has asked whether this is a permitted use.
The following is text from are email from Berg A elman, Manager of Solar Development;
Dear Dori,
Nexamp, in partnership with the Brooks School, is in the process of developing in a
ground mounted solar array on a piece of lard owned by Brooks, across Great Pond Road from
their campus, l exa p is leasing the properly from Brooks, and will be selling net metering
credits generated by the array to the school, leading to a steep discount in the school's electric
bills. The solar array will be owned by a for-profit emit a single-purpose LLC . A portion of the
electricity or credits for electricity may be sold to entities other than Brooks School under a
community shared solar model, depending on the requirements of upcoming stale solar policies.
Ne arrrp will be working with the school to incorporate the solar array into the school's
curriculum. Ne a p will make the solar production data available to the school for use in
its classrooms, and will work with teachers to design curricula that incorporates the

solar facility's data. Nexamp will also take classes on tours of the facility, and provide
hands-on demonstrations and guest lectures as needed, Lastly, there is a provision in
our agreement with the school for Nexamp to install renewable energy demonstration
projects, such as solar canopies, additional rooftop arrays, and electric vehioie charging
stations on the main Brooks campus, or set up scholarship funds, both of which would
e financed through our power purchase agreement.

RE: Is a ground mounted solar system aloud in an R1 Zone.
Planning Board Members,
To the best of my knowledge the Torn of North Andover has not adopted; Model Zoning for the regulation of
Solar Energy Systems.
Therefore Per Chapter 4oA Section
H 40A sec 3 states; No zoning ordinance or by-law shall prohibit or unreasonably regulate the installation of solar energy
systems or the building of structures that facilitate the collection of solar energy, except where necessary to protect the
public health, safety or welfare. This does net prevent the Planning Department and Conservation Department when
within the purview where necessary to protect the public health,safety, or welfare.
As quoted above, a Massachusetts municipality may not prohibit or unreasonably regulate solar energy systems except
where necessary to protect public health, safety or welfare. Therefore, although these systems must be allowed within the
community, they may be regulated through other provisions of the Zoning Bylaw.These systerxns could be regulated to
meet dimensional regulations and other performance standards as stated;
Chapter A Section : Solar access; "regulation of the orientation of streets, lots and buildings, maximum building
height limits, minimum building setback requirements, limitations on the type, height and placement of vegetation and
other provisions.
Summary: In a Residential 1 Zone (RI); Being in compliance with Summary of Dimensional Requirements uirements rnd Current
Edition of Massachusetts State Building Code 780 CMR, will be allowed by right and permitted. It is my opinion a ground
mounted system is a free standing structure, except when supported by footings,then becoming a permanent structure.
The Town of Borth Andover would have to adopt Model Zoning for the regulation of Solar Energy Systems in order to set
limitations, except where necessary to protect the public health,safety or welfare.

Land Disturbance Permit application for the proposed Brooks School Solar Farm in North Andover,
Massachusetts. Your comments are retyped below in italicized font, followed by responses in
common font.
1. Report of access road to supportfire apparatus,
The gravel access road is designed to support large 1lB- 7 tractor-trailers with sufficient space
provided to turn vehicles around in the staging area. A.turning radius analysis for a typical fire
truck is provided as are attachment to this letter.
. Hydrant would be needed by access road.
Fire hydrants are not normally needed for fire suppression at solar equipment installations of
this type. I examp has expertise in fire safety for solar applications and would life to offer a site-
specific fire safety training session with the North Andover Fire Department to run through the
appropriate actions in the event of a fire.
. Concerned on how vegetation would be maintained around and within the array area.
Mowing operations will be conducted two to four times per season, depending on the weather
conditions and resultant growth. Normally, two to four personnel using ride-on and self-
propelled mowers and weed whackers will perform the mowing operations. Vegetation will be
maintained in this manner in and around the arrays to promote access to the arrays.
4. Area of disconnects should be located at the entrance to the array,
c amp will provide a disconnect at the entrance to the array,as requested.
. A turning radius analysis for the access road entrance creeds to be included

note that large vehicle access to the site from Great Pond Road will occur from the South only.
